DOUGLAS AVENUE FROM SUNSET POINT ROAD TO NORTH CITY LIMITS OF CLEARWA TER#

Director of P~blic Works and Engineering Douglas M. Carter
presented an agreement executed by the Clny ot Clearwater tor the ac-
quisition of right ot way tor Douglas Avenue in which the City agreed
to p~y "allot the costs other than those incurred by actual employees
ot the COlinty"-such as the services ot the Legal DepaItment if condenma-
tion suits become necessary.
Mr. Carter added that the po~tion of County Road 33 (Douglas
Avenue) involved runs from Sunset Point Road to the North city limits
of Clearwaterj that the County Attorney had approved the agreementj and
that the County Administrator and the Engineering Department both recom-
mend approval of the agreement.
Commissioner Brumfield moved# seconded by Commissioner Taylor
and carried, that the agreement be approved with authority for the Chair-
man and the Clerk to sign and attest, as recommended by the County En-
gineer.

AGREEMENT
THIS AGREEMENT, entered into this 7th day of January
1969, by and between the CITY OF CLEARWATER, FLORIDA, a municipal
corporation, hereinafter called the "City", party of the first part; and the
BOARD OF COUNTY COMMISSIONERS OF PINELLAS COUNTY, FLORIDA,

WITNESSETH:
WHEREAS, the County is engaged in obtaining the necessary
rights of way for County Road 33 (Douglas Avenue) from Sunset Point Road,
North to City Limits of Clearwater; and
WHEREAS, this necessary right of way is partially within the City
limits of the City of Clearwater; and
WHEREAS, it would be to the mutual advantage of both parties
for the County to acquire this right of way within the City limits;

NOW, THEREFORE, in consideration of the mutual performance
of the terms and conditions contained herein, the City does agree to the
following:
That the right of way for County Road 33 (Douglas Avenue)
within the City limits will be obtained by the County.
That the City will reimburse the County for the sum total
of expenditures advanced by the County for Title Searches,
Appraisals, Purchase of Right of Way, Condemnation Costs,
Attorneys Fees and Court Costs for those properties
acquired within the City limits. It is understood by both
parties that the City shall assume all costs as itemized
above, but that such costs' shall not be limited to those
specified items.
It is also understood that the City will not be required to .
reimburse the County for any salaries of County Employees
involved in acquisition of required right of way.
That the repayment to the County by the City will be made
on or before ninety (90) days after acquisition of all
necessary right of way.
