underB ig ed municipali ties '( hereinaf ter refer red to individually
as the 'CITY" and collectively as the "CITIES"), and the Board of
County Commissioners of Pinellas County, Florida (hereinafter
referred to as the "COUNTY").
WHEREAS, the statewide goal of the Solid Waste Management Act
of 1988, Ch. 88-130, Laws of Fla. (hereinaf ter refer red to as the
"ACT") is to reduce the amount of municipal solid waste being
disposed of at solid waste management facilities by at least 30
percent by 1994: and
WHEREAS, in an effort to reach this goal the ACT requires
counties to develop and implement recycling programs within their
jurisdictions to return valuable materials to productive use, to
conserve energy and natural resources, and to protect capacity at
solid waste management facilities: and
WHEREAS, the ACT requires that said recycling programs be
initiated by July 1, 1989: and
WHEREAS, the ACT encourages counties and municipalities to
form cooperative arrangements for implementing solid waste
recycling and education programs: and
WHEREAS, the ACT created the Solid Waste Management Trust
Fund to provide incentive grants to assist qualifying counties and
municipalities in the operation of solid waste management
recycling and education programs: and
WHEREAS, Section 403.7095(3)(c), Fla. Stat. (Supp. 1988)
provides that no local government match is required for these
incenti ve grants if the municipalities represent ing seventy-f i ve
percent (75\) of the incorporated population of the County apply
jointly with the County, or, if one of such municipalities has a
population exceeding twenty-five percent (25\) of the incorporated
population of the County, no match is required if municipalities
having at least seventy-five percent (75\) of the remaining
incorporated population of the County apply jointly with the
County to the Florida Department of Environmental Regulation
(FDER) for these incentive grants: and
WHEREAS 0 in order to apply jointly for the incentive grants
the County and the municipalities must enter into inter local
agreements that determine how the grant funds. if awarded, sha 11
be used: and
WHEREAS 0 grant applications submitted to FDER must include
copies of the interlocal agreements between the County and
participating municipalities: and
WHEREAS, the participation and cooperation of the CITIES and
the COUNTY is essential to the successful award of a state
incentive grant and th~ development and implementation of a
successful recycling and education program in Pinellas County: and
WHEREAS, it is the desire of the CITIES that the COUNTY
apply to FDER on behalf of the CITIES and the residents of the
Cities and the unincorporated area of the County for available
recycling and education incentive programs.
NOW THEREFORE, the COUNTY and the CITIES hereto mutually
agree as follows:
1. This Agreement shall be effective from the date it is
filed with the Clerk of the Circuit Court of Pine11as
County and shall remain in effect until September 30,
1994. The Agreement may be terminated in writing by
any party after the first grant year. Notice of said

termination shall be given in writing to the other
party at least one (1) month prior to the close of any
grant year. and shall be effective as of the close of
that year. Upon such notice becoming effective. this
Agreement shall terminate as to the party giving such
notice but shall continue in effect until September 30.
1994. as to all other parties so long as grant money is
available. without a match. to the County pursuant to
Section 403.709S(3)(c). Fla. Stat. (Supp. 1988). In
the event grant money ceases to be available without a
match. this Agreement shall terminate as to all
parties. Notwithstanding termination. any accrued
rights or duties shall remain effective. such as the
payment of undistributed grant money received by the
County and the furnishing by CITIES of information
necessary for reporting requirements.
Each CITY shall cooperate with the COUNTY to the
fullest extent practical in providing information
necessary to (a) complete the grant applications in
accordance with the requirements of s. 403. 709S (6) Fla
Stat. (Supp. 1988). the first application to be
submitted by March 1. 1989. unless extended by FDER.
and succeeding applications to be submitted by October
1 of each year from and including 1989 through 1994:
(b) develop a recycling program to be implemented
within t.he COUNTY and CITIES. ~. copy of which program
is to be submitted with the grant application that is
to be submitted by October 1. 1989. and with each
succeeding grant application: and (c) prepare the
COUNTY's annual report to FDER on recycling activities
as required by s. 403.706(7) Fla. Stat. (SUpp. 1988):
The COUNTY shall submit the incentive grant
applica'tions to FDER on behalf of the COUNTY and the
CITIES during the period covered by this Agreement and
by the application deadlines to be established by FDER.
The COUNTY shall. by October 1. 1989. and each year
thereafter. report to FDER the COUNTY's annual solid
waste management and recycling activities for the
duration of the period,covered by this Agreement.
The COUNTY shall distribute the incentive grant monies
awarded by FDER to the COUNTY and CITIES based on their
pro rata share of these monies. According to the Act.
the total incentive grant amount available to each CITY
will be determined by dividing the available state
funds by the total population of all eligible
applicants. and mUltiplying this amount by the
population of the CITY. population figures are
determined from the most recent population census in
accordance with s. 186.901 Fla. Stat. (1987).
Grants awarded to the COUNTY by FDER shall be forwarded
in appropriate amounts to the CITIES within thirty (30)
days of recei~t.

The solid waste recycling and education grants provided
to the COUNTY and CITIES by FDER may be used for any of
the following purposes:
a. capital costs:
b. If justified. te~porary operation of subsidies
for recycl ing paper. glass and plast ic. and in
composting organic materials:
c. Promotion of recycling. volume reduction. and
proper disposal: and
d. Market development for recyclable materials.

8. Each CITY for itself agrees to provide a written
account of expenditures from the grant award used for
implementation of the recycling program within the
CITY. Documentation of expenses is required in
sufficient detail to meet the requirements for
reimbursement placed on the COUNTY by FDER for the
grant award.
9. A recyclable materials recycling program shall be
developecl by the COUNTY in consultation with the CITIES
and presented to the governing bodies of each by their
respective staff for approval prior to September 1.

11. Upon receipt by the COUNTY of any information.
directives. grant operating procedures. other
correspondence concerning any grant applied for
pursuant to this Agreement or in furtherance of this
Agreement. the COUNTY shall within ten (10) working
days forward copies thereof to the CITIES in the manner
provided for notice in this Agreement. Likewise, the
COUNTY shall in the manner provided for notice in this
Agreement afford to each CITY thirty (30) days' prior
notice of the accounting required of the CITY pursuant
to this Agreement (or grant or contract) obtained as a
direct or indirect result of this Agreement.
12. Any notice that may be given by one party to the other
pursuant to or as a result of this Agreement shall be
given by posting it as regular. first class, United
States mail. postage prepaid or by hand delivery.
Any party to this Agreement may unilaterally designate
the address of or person to whom notice is to be
directed by giving notice thereof to all other parties
hereto.
IN WITNESS WHEREOF. the parties hereto have caused this
Agreement to be executed by their duly authorized officers the day
