INTERLOCAL AGREEMENT
THIS AGREEMENT, made and entered into this & day of ~
199 f, by and between Pinellas County, a political subdivision of the State of Florida,
hereinafter referred to as the "COUNTY," and the Cities, municipal corporations within
Pinellas County under the laws of the state of Florida, hereinafter referred to as the
"CITIES," as follows:
RECITALS:
1, Section 212.055(2), Florida Statutes (1988 Supp,), authorized the COUNTY
to levy a discretionary sales surtax of one percent (1 %) throughout Pinellas County, Florida
("Discretionary Surtax"), subject to referendum approval, to finance, plan and construct
infrastructure, as defined in Section 212,055, Florida Statutes,
2, On November 7, 1989, the levy of the Discretionary Surtax for an initial ten
(10) year period was approved by a majority of those voting on the question at a
referendum,
3, Pursuant to Section 212,054(4), Florida Statutes (1988 Supp,), the Florida
Department of Revenue is responsible for collecting the Discretionary Surtax and
distributing the Net Proceeds (hereinafter defined) thereof to the COUNTY on a monthly
basis,
4, The Net Proceeds of the Surtax may be distributed pursuant to an Interlocal
Agreement entered into between the COUNTY and the CITIES,
5. By Agreement dated September 19, 1989, the COUNTY and the CITIES
entered into an Interlocal Agreement providing for the distribution of the Discretionary

Surtax, which Agreement expires January 31, 2000.
6, On March 25, 1997, the extension of the Discretionary Surtax for an
additional ten (10) years was approved by majority of those voting on the question at a
referendum,
7. The parties further recognize that it is in the best interest of the CITIES and
the COUNTY to enter into an interlocal agreement, which will run concurrently with the
extended levy of the Discretionary Surtax for the purpose of providing a distribution among
the CITIES and the COUNTY,
8. This Interlocal Agreement is authorized by Section 163,01, Florida Statutes,
which authorizes the cooperative exercise by agreement of two or more public agencies
of any power common to them.
NOW, THEREFORE, in consideration of the covenants herein contained and other
good and valuable consideration, the COUNTY and CITIES agree as follows:
Section 1. CONDITIONS PRECEDENT
As a condition precedent to executing this Agreement, each City must furnish to the
County evidence that its governing body has, at a duly-noticed and publicly-held meeting.

Improvement Plan and shall identify therein any material changes In the Original
Infrastructure Projects,
Section 2. DISTRIBUTION OF Discretionarv SURTAX
A. For purpose of this Section 2, "Net Proceeds" shall mean the amount of the
Discretionary Surtax collected in the COUNTY by the Florida Department of Revenue, less
the Department's administrative costs, up to three percent (3%), of collecting the
Discretionary Surtax,
B, During the term of this Interlocal Agreement, the Discretionary Surtax shall
be collected by the Florida Department of Revenue and the Net Proceeds shall be
distributed monthly to the Board of County Commissioners for distribution in accordance
with the terms of this Agreement.
C, The Net Proceeds shall be distributed between the COUNTY and the CITIES
within a reasonable time after receipt, as follows:
(1) Criminal justice and related facilities will be funded, on a priority basis,
in the total amount of Eighty Million Dollars ($80,000,000) pro-rata over the ten (1 OJ-year
term of this Interlocal Agreement. Thus, before the Board of County Commissioners
distributes the Net Proceeds received by it for any month, it shall apply to the funding of
criminal justice and related facilities so much of such Net Proceeds as shall equal the
lesser of (i) the Net Proceeds received by the Board for such month, or (ii) an amount
which, when added to all Net Proceeds so applied previously, will result in an average
monthly funding of Six Hundred Sixty-Six Thousand, Six Hundred Sixty-Six and 67/100

Dollars ($666,666,67) for such month and all prior months for which the Board has

Section 3. EXECUTION AND EFFECTIVE DATE
rhis Interlocal Agreement may be signed in counterparts by the parties hereto, This
Interlocal Agreement shall take effect upon the last date of execution by a party to this
Interlocal Agreement, but in no event later than February 1, 2000,
Section 4. SEVERABILITY
If any provision of this Interlocal Agreement is held invalid, the invalidity shall not
affect other provisions of the Inter/ocal Agreement which can be given effect without the
invalid provision or application, and to this end, the provisions of this Interlocal Agreement
are severable,
Section 5. TERM OF AGREEMENT
The term of this Interlocal Agreement shall run concurrently with the levy of the
Surtax, said levy being authorized for ten (10) years from February 1, 2000, until
January 31,2010,
Section 6. AMENDMENTS TO AGREEMENT
This Interlocal Agreement may be amended, in writing, upon the express formal
consent of the governing bodies of all the parties,
