TERMINATION WATER SERVICE FOR NON-PAYMENT SEWER SERVICE CHARGES PINELLAS COUNTY ORD. NO. 89-39 - l-- ,- -, lJ I AGREEMENT TIUSAGREEMENT, made and entered into this ~ay of ~ 19!:1.k, by and between PINELLAS COUNTY, a political subdivision of the State of Florida, hereinafter referred to as "COUNTY" and the CITY OF Q.EARWATER, a municipal corporation within the State of Florida, hereinafter referred to as "ClTY". WHEREAS, Pinellas County Ordinance No. 89-39 authorized interlocal agreements which govern the termination of water service for non-payment of sewer service charges in other jurisdictions; and WHEREAS, the COUNTY provides water service in numerous locations where a municipality provides sewer service; and WHEREAS, the COUNTY provides sewer service in numerous locations where a municipality provides water service; and NOW, TIIEREFORE, the parties hereto do hereby covenant and agree as follows: I. COUNTY OBUGATIONS TO DISCONTINUE WATER SERVICE TO CITY SEWER cusroMERS. 1. The COUNTY agrees to assist OTY in OTY'S efforts to collect delinquent sewer accounts by the discontinuance of COUNTY water service to CITY sewer' customers for non-payment in full for CITY sewer service. Such a delinquency of payment must be in excess of thirty (30) days, and the OTY must have provided reasonable notice to the CITY sewer customers of the delinquency. Water service will remain off until all accounts are paid in full, including but not limited to the turn-off charge, which charge will be deposited to funds of the Pinellas County Utilities. COUNTY assistance will be within the limitations of the laws of the State of Florida, the Ordinances of Pinellas County, and the policies of Pinellas County, (;,() O'~ i ,'; ! }, I ~ 'J -I) , // I' t./ l 1 \, " /i UU .,.,. t I 2. The CITY agrees to adopt such City Ordinances as shall be required to make the collection of sewer charges and termination of water service, to enforce said collection, legal and binding upon the CITY sewer customers . The CITY shall cooperate and assist in said collection by assuming direct responsibility for answering to the CITY sewer customers for the reasons and necessity for sewer charges as established or as may be amended from time to time. 3. The COUNTY agrees to perform this service for the CITY for all sewer accounts served by COUNTY water but reserves the right to reconnect water service on any accounts which become involved in a dispute or in litigation with the CITY or COUNTY, ll. TERMINATION. This Agreement shall be binding on both Pinellas County and the City of Clearwater.
