AGREEMENT
I
THIS AGREEMENT, made and entered into by and between THE CITY OF
CLEARWATER, a municipal corporation of the State of Florida, and PINELLAS COUNTY, a
political subdivision of the State of Florida.
WITNESSETH, That:
WHEREAS, Pinellas County and the City of Clearwater are desirous of
working together to improve drainage at selected locations, and
WHEREAS, Alligator Creek Channel 'c' from Old Coachman Road to Sunset
Point Road in Pinellas County is in need of improvement, and
WHEREAS,
this improvement is proposed to include construction and
installation of box culvert and ditching in accordance with engineering plans now
being prepared by the County, and
WHEREAS, the County's Master Drainage Plan for Allen's Creek indicates a
need for expanded drainage detention for Allen's Creek in the vicinity of Belcheer
Drive and Lakeview Road, and
WHEREAS, the City desires to participate to the extent of Ninety Thousand
and No/IOO Dollars ($90,000.00) in the Alligator Creek Channel 'C' project
abovementioned, and
WHEREAS, the City holds fee title to property in the vicinity of Belcheer
Drive which is suitable for detention and said property has been valued by the City
at Ninety Thousand and No/IOO Dollars ($90,000.00), and
wnBRSAS, the City holds fee title to Tract .C., Sunset-Coachman Center as
recorded in Plat Book 84, Page 81, Pinellas County Records and this parcel adjacent
to Channel .C. of Alligator Creek is currently aiding in stormwater control,
NOW THEREFORE, in consia~r~tion of the premises and the sum of One Dollar
($1.00) each to the other paid, and for good valuable considerations, it is agreed

1. Pinellas County will complete the design of the improvements for
Alligator C~eek Channel .C. from Old Coachman Road to Sunset Point Road.
2. The City will allow the County to modify the existing stormwater
detention area within Tract .e., Sunset-Coachman Center in accordance with the
County's consultant design, providing that it does not convert the dry pond to a
wet pond ~s shown

3. Pinellas cJmty will proceed to acquire oler needed land interests
and will apply for necessary Department of Environmental Regulation permits to
allow the construction of Channel 'C'.
4. Subject to acquisition of necessary Department of Environmental
REgulation permits Pinellas County will advertise and award the construction
contract for the Channel 'c' improvement subject to receipt of acceptable bids.
5. If the contract is not awarded in the 1984-85 budget year for Channel
.C., an additional year will be allowed for commencement of the project.
6. Upon aware of the construction project for Channel 'c' the City of
Clearwater will deliver an executed deee to Pinellas County for the Belcheer tract
as described in Schedule -A., attached hereto and made a part of this Agreement.
7. The City will provide the County with any City permits required for
excavation or County use of the Belcheer tract which is to be conveyed pursuant to
this Agreement as well as any City permits or approvals required for Tract 'C',
Sunset-Coachman Center upon County request for said permits.
8. The City will not further encumber either the Belcheer tract or Tract
.e., Sunset-Coachman Center.
This Agreement may be amendee only by agreement of both the City of
Clearwater and Pinellas County as evieenced by approval and execution at a
regularly scheduled meeting of said City and County.

#32 AGREEMENT WITH CITY OF CLEARWATER FOR JOINT IMPROVEMENT OF ALLIGATOR
CREEK CHANNEL "C. AND ALLEN'S CREEK DRAINAGE DETENTION - APPROVED FOR
EXECUTION
County Administrator Fred E. Marquis recommended approval
of an aQreement with the City of Clearwater accepted by said City on
April 29, 1983, re the joint improvement of Alligator Creek Channel
"c" and the drainage retention for Allen's Creek.
In his memorandum of May 19, 1983, Mr. Marquis indicated,
in part, that the City of Clearwater is desirous of contributing
$90,000.00 in the form of property located in the vicinity of Belcheer
Drive and Lakeview Road for the improvement of Alligator Creek Channel
"C," which is adjacent to City-owned property knowJas Tract "C,"
Sunset-Coachman Center; and that through the use of said property to
be contributed by the City, pinellas County will be able to expand
drainage detention for Allen's Creek.
Commissioner Tyndall moved, seconded by Commissioner Cazares
and carried, that the agreement be approved for execution.
