THIS AGREEMENT, made and ,entered into by and between,lHE CITY OF
CLEARWATER, a municipal corporation of the State of Florida, and PINELLAS
COUNTY, a political subdivision of the State of Florida,

l'HEREAS. Pinellas County and the City of Clearwater are desirous
of working together to improve drainage at selected locations; and
WHEREAS, Alligator Creek Channel "c" from Old Coachman Road to
Sunset Point Road in Pinellas County is in need of improvement; and

1~{EREAS, this improvement is proposed to include construction

and installation of box culvert and ditching in accordance with engineering
plans now being prepared by the County; and
WHEREAS, the County's Master Drainage Plan for Allen's Creek
indicates a need for expanded drainage detention for Allen's Creek in the
vicinity of Belcheer Drive and Lakeview Road; and
WHEREAS, the City desires to participate to the extent of $90,000.00
in the Alligator Creek Channel lie" project abovementioned; and
WHEREAS, the City holds fee title to property in the vicinity of
Belcheer Drive which is suitable for detention and said property has been
valued by the City at $90,000.00; and

WHEREAS, the City holds fee title to Tract "C", Sunset-Coachmen,

parcel adjacent to Channel lIell of Alligator Creek is currently aiding in
storrnwater control;
NOW, THEREFORE, in consideration of the premises and the sum of
$1.00 each to the other paidJ and for good and valuable considerations, it
is agreed as follows:
1. Pinellas County will complete the design of the improvements
for Alligator Creek Chanr~el "e" from Old Coachman Road to Sunset Point Road.
2. The City will allow the County to modify the existing storm-
water detention area within Tract "ell, Sunset-Coachman Center in accordance
with the County's consultant design, providing that it does not convert
the dry pond to a wet pond as shown on Pinellas County Consultant Preliminary
Plans dated 3/16/83,

allow the construction of Channel "en.
'4. Subject to acquisition of necessary Department of Environmental
Regulation permits Pinellas County will advertise and award the construction
contract for the Channel "c" improvement subject to receipt of acceptable" bids.
5. If the contract is not awarded in the 1982-83 budget year for
Channel "C", an additional year will be allowed for commencement of the project.
6. Upon award of the construction proj ect for Channel "c" the
City of Clearwater will deliver an executed deed to Pinellas County for the
Belcheer tract as described in Schedule "'A", attached hereto and made a part
of this agre~ent~
7. The City will provide the County with any City permits required
for excavation or County use of the Belcheer tract which is to be conveyed
pursuant to this agreement as well as any City permits or approvals required
for Tract "e", Sunset-Coachman Center upon County request for said permits.
8. The City will not further encumber either the Belcheer tract or
Tract II e" J Sunset-Coachman Center,
THIS AGREEMENT may be amended only by agreement of both the City
of Clearwater and Pinellas County ase:videnced by approval and execution at
a regularly scheduled meeting of said City and County.
