AGREEMENT
THIS AGREEMENT made and entered into this
27thdayof
September
A.D., 1977, by and between the CITY OF CLEARWATER,
FLORIDA, a municipal corporation hereinafter referred to as "City" and PINELLAS COUNTY,
a political subdivision of the State of Florida, hereinafter referred to as "County";
WITNESSETH:
WHEREAS, the City of Clearwater shares with Pinellas County in a great
concern for the people of our commun ity; and
WHEREAS, the City of Clearwater shares with Pine lias County in maintaining
and enhancing the qual ity of its environment, waterways, bays and marine activities; and
WHEREAS, the apening of Dunedin Pass will have many beneficial results for
the Upper Suncoast Regian by the restoration of natural water flow and improved water quality
in Clearwater Bay; retardation of silting and pollution; improved traffic conditions on the
Clearwater Causeway by reducing the frequency of openings of the drawbridge; and provide
another emergency outlet for vessels to enter into a harbored area; and
WHEREAS, the United States Corps of Engineers is not likely to undertake the
task of opening Dunedin Pass by dredging; and
WHEREAS, the University of Florida is conducting a study of silting in
,Clearwater Pass and it is anticipated that this study will recommend corrective actions
which wi II require dredging of the Pass, the City is therefore considering acquisition of a
dredge for th is purpose; and
WHEREAS, toward this end, the City of Clearwater is undertaking the
preparation of bid specifications, personnel requirements and budgeting for a dredge,
support equipment and personnel for this purpose by direction of the City Commission at
its meeting of May 19, 1977, and the City has included in its Budget for the 1977-78 fiscal
ye_ar funds for the possible acquisition of the dredge, support equipment and personnel, which
dredge is expected to cost approximately $395,000 and personnel and operatlona-I coSIs per-
year are estimated at $140,000; and
WHEREAS, there ore additional silting problems in the environs of Clearwater Bay,
particularly in Dunedin Pass which could be cleared with the use of such a dredge; and
WHE'REAS, Pinellas County is agreeable to contributing $75,000 toward the purchase
of I'his dredge on the condition that said dredge will be made available at an appropriate time
wirhin twenty-four (24) calendar months following the transfer of funds fr~m the County to

NOW,
THIEFO RE, in consideration of the mutul: promises ond covenants
herein contained, the said parties agree as follows;
1. The City d~ring its fiscal year 1977-78 agrees to purchase a dredge and
support equipment and personnel necessary to operate :11e dredge.
2. The County agrees to make available $75,000 in funds to the City to be
utilized by the City in the acquisition of the dredge. Sa.id funds shall be made available
to the City immediately upon its notification to the County that a bid for the purchase of
the dredge has been accepted. The City covenants that said funds shall be utilized
solely for the purchase of said dredge.
3. The City agrees that use of the dredge and supporting equipm8nt for
clearing and maintenance of various waterways, with the understanding that Clearwater Pass
will have first priority, ano! that the opening of Dunedin Pass wi II have second priority for
the use of said equipment.
4. The City agrees to complete all necessary arrangements with State
regulatory agencies and to ,closely cooperate with the County in seeking the support of
the City of Dunedin, Flari~a, and private property owners, if appl icable, prior to
commencing clearing operations in Dunedin Pass toward the mutually desired goal of
providing the City with written notification, concurred in by the City of Dunedin and
other applicable agencies, indicating that all preparatory steps have been completed.
5. The parties agree that this agreement may be terminated at any time prior
to the City's accepting bids leading toward the purchase of the dredge and supporting
equipment.
IN WITNESS WH EREOF, the parties hereto have executed this Agreement the
day and year first above written.
