JAIL FACILITIESAGREEMENT
THIS AGREEMENT, made and entered into this 2,2.&'- L day of
)-("-,4-1-9-67 by and between PINELLAS COUNTY, a political subdivision
of the State of Florida, hereinafter called the County, and the CITY OF
CLEARWATER, FLORIDA, a municipal corporation, located in Pinellas
County Florida hereinafter called the City;
WITNESSETH
WHEREAS, the City does not have facilities for the incarceration
of certain persons charged with violation of its municipal ordinances or
certain persons sentenced to imprisonment for violation of its municipal
ordinances, and the County has such facilities and is willing to permit the
use of its facilities by the City

NOW, THEREFORE, it is hereby agreed that the County will permit
the use of its County Jail facilities for the incarceration of lawful prisoners
of the City under the following conditions
1 The County shall have complete control of all prisoners of the
City while they are in the custody of the County
2 The City shall have the right to deliver its lawful prisoners to
the County Jail where they shall be received and incarcerated by the County
subject to the further orders of the Municipal Judge iof the City
3 For prisoners of the City received and incarcerated by the
County by virtue of a judgment and sentence of the Municipal Judge of the
City the City shall pay to the County a booking fee oir $2 00 for each such
prisoner and in addition thereto the sum of $2 25 for each day such person
is incarcerated which sum shall include the cost of meals usually and
customarily served by the County to all prisoners in the County Jail
4 The county shall not be responsible for the cost of any
hospitalization medical attention or medical supplies that may be required

by prisoners of the City and the City agrees to pay the cost of any such
hospitalization medical attention or medical supplies
5 The City agrees and guarantees to save the County harmless from
any liability which might accrue to the County because of this contract or the
accepting and incarcerating 04 prisoners under this contract but this shall
not relieve the County or its officers or employees from any liability which
might accrue to the County or any of its officers or employees because
of any mistreatment of any prisoner by any such officer or employee of
the County

6 The payments due the County shall be made monthly by the City
such payment to be made within ten (10) days after the end of each calendar
month and shall be made at the office of the Sheriff of the County

7 This agreement shall remain in full force and effect for a period
of one (1) year from the date hereof and thereafter until either party shall
terminate the same by giving to the other party thirty (30) days notice in
writing of its intention to terminate this agreement and thirty (30) days
after receipt of such written notice this agreement shall cease and

terminate
8 If either party shall willfully violate any of the agreements
herein contained, such willful violation shall entitle the other party to
terminate this agreement, provided that the party desiring to terminate
this agreement for such cause shall give to the offending party ten (10)
days written notice specifying the cause of such termination
IN WITNESS WHEREOF, the County has caused this agreement to
be signed by the Chairman of its Board of Commissioners attested by the
Clerk of the Circuit Court and the City has caused this agreement to be
