" .f Sheet 1 of 9 I :.~ ,', , '\ MEMORANDU M OF AGREEMENT TH1S AGREEMENT, made and entered into this 9th day of March 1965, by and between the STATE ROAD DEPA:rt.TMENT OF FLORIDA, a component agency of the State of Florida, hereinafter called the Department, and the COUNTY OF PINELLAS, FLORIDA, hereinafter called the County. WITNESSETH: " , WHEREAS. Section 9' of the Federal-Aid Highway Act of 1962, by declaration, establishes that it is in the national interest to encourage and promote the development of transportation systems of the United States, embracing among other things the modes of transportation to serve the States and local communities efficiently and effectively; and WHEREAS, by said Highway Act of 1962. it is stated that after July 1, 1965. the Bureau of Public Roads shall not approve any program , or project within any urban area of more than 50. 000 popul~tion unless such program or project is based on a continuing and comprehensive transportation planning process carried on cooperatively by States and , , local communHies; and WHEREAS. the Instructional Memorandum of the United States Department of Commerce. Bureau of Public Roads No. 50~2-63. dated March 27, 1963; indicates that the "St. Petersburg Urban Area." as listed in Table 23, U.S. Census and Population - 1960. General Social and Eco- nomic' Characteristics. United States Summary. United States Bureau of the Census. is one of the areas referred to in the 1962 Act; and WHEREAS. the County, by resolution, adopted December 22, 1964 (a certified copy of which is attached hereto and is made a part hereof u , , "Exhibit "A"). requested the Department to make a continuing and compre. hensive tr..ffic and planning study on the street. and roadilwithin Pinella. " ..... 1''\ T'~ Sheet 2 of 9 County for the purpose of enabling the County to comply with the provi- sions of Section 134 of the Federal-Aid Highway Act of 1962; and WHEREAS, the partieS to this agreement do hereby desire to participate cooperatively in the initiation and maintenance on a continuing basis of a coordinated comprehensive transportation planning process to ensure that highway facilities, parking, mas s transit, bus and truck trans- portation, rail systems, water transportation, air transportation, and other facilities will be properly located and developed in relation to the overall plan of development. NOW, THEREFORE. THIS INDENTURE SHALL WITNESSETH: That the parties hereto, and in consideration of the premises and the mutual benefits to accrue to each party, do mutually covenant and agree as follows: 1. The parties to this agreement shall participate in a joint project, designated as the "St, Petersburg Urban Area Transportation Study." to include the area (established by the U.S. Department of Commerce, Bureau of the Census PC(1)llA Fla.) to establish the comprehensive transportation planning process set forth within Section 9 of the aforesaid act and as further 0, described within the Instructional Memoranda of the United States Department of Commerce, Bureau of Public Roads No. 50-2-63, dated March 27. 1963. and 50-2-63(1) dated .September 13. ~963, Z. The Department h'ereby agrees to conduct all appropriate highway and traffic control studies and to develop plans for / a continuing and comprehensive highway and traffic control system within the St, Petersburg Urban Area in terms of the work assignments as are hereinafter described, or as otherwise agreed to in the development of the study design. and to carry out its responsibilities within the continuing transportation planning process in Cull coordination and 2/19/65 '..~ '.. ..... The County Commission hereby agrees to conduct their, related studies and to carry out their responsibilities within the transportation planning process in full coordina-, tion and cooperation with the Technical Committee. 4. The parties to this agreement do hereby mutually covenant and agree to the (1) study organization. and (Z) work program as follows: A. Study Organization (1) Committees: In order to carry out a continuing and comprehensive transportation planning process for the St. Petersburg Urban Area. 'a Policy Committee. Technical Advisory Committee. and Technical Coordinating Committee shall . ~,. be created. .These committees shall have the following membership, responsibilities and functions: Policy Committee - This committee shall consist of the following members: The State Road Boa:rd Member from District 1. the Chai rman of the Pinellas Board of County Commissioners. and the Division Engineer of the U: 5. Bureau of Public Roads who will serve as advisory and ex-officio member of this committee. , ) The function of the Policy Committee shall be to develop ,'" and coordinate within the St. Petersburg Urban Area all policies in terms of the development of the trans- portationplanning process and its effective implementation. . The Policy Committee shall also be responsible for the development and maintenance of the public information program to explain the transportation planning process. The Policy Committee shall appoint mem- be rs of the Technical Advisory Committee and Technical Coordinating 'Committee and shall meet as requested with these committees during the course of the study to review work progress and to assist in establishing policy and guidance whenever necessary. Technical Advisory Committee ~ ,This Committee shall or may consist of a representative of each of the following agencies and organizations, said representati ves to be appointed by the Policy Committee: U.S, Bureau of Public Roads. Florida State Road Depa rtment, Pinellas Planning Council, Tampa Bay Regional Planning Council, Pinellas County Planning Advisory Board, Upper Pi..ellas Planning Commission. Inc., Municipal Transit System of St. Petersburg. St, Petersburg Exp res sway 'Authority, Atlantic Coast Line . Railway, andthe Seaboard Air Line Railway. Additional < , members to ;represent other' agencies and municipalities , may be appointed by the Policy Committee during the course of the study. ...1 This Committee will serve primarily as a research source , , to assist in the collection and proper evaluation of technical , data. and to properly coordinate the development of specific elements of the transportation plan. Any member of this Committee may designate, in writing to the Com- mittee, a person to act in his behalf. Initial preparation of appropriate portions of a study design draft shall be prepared. The final study design will tr.cn be reviewed and coordinated by the Technical Coordinating Corr.rnittee and will then be submitted to the Policy Committee for its, review and approval. Following this approval, the study design will serve as a basis for all work to be done as part of the Transportation Planning Process. 2. Survey and Analysis U:.der this phase, of the work. research and data collections will be undertaken relating to all aspects of the transportation system. The specific wo rk items will be as set fo rth within the Study Prospectus. 'The basic elements for which study inven- tories and analyses shall be conducted and the agency having the primary responsibility for each element are as set out in the Study Prospectus and as approved by the Technical Coordinating Committee. 3. Development of Codes and Standards Following the survey and analysis phase. the Technical Coo.rdi~ nating Committee, will develop codes and standards of the study. The work will include a thorough review of the St. Petersburg Urban Plan of Development prepared to date by the various Planning Councils arid Commissions and a review of all projec- '--~'~ v , tion proposals made by the Plan for future growth and population within the St. Petersburg urbanized area. Also to be reviewed will be the future 'plans of all other governmental agencies and authorities for future development of individual facilities. Economic, social and physical aspects of future development will also be reviewed and analyzed in terms of their implications 2119/65 ,- '" r-' Sheet 7 of 9 10. upon the future transportation plan. Following the review of all pertinent information, a uniform .....-.' '-J guide of goals and standards will be developed, such guide to serve as a basis for the development of all individual plan elements of the Comprehensive Transportation Plan. This phase of the work will be the responsibility of the Technical Coordinating Committee, drawing upon the resources of the Technical Advisory Committee and the Policy Committee as necessary. 4. Plan Development Following the completion of the development of goals and standards. the adoption of the specific standards and working procedures, and design assumptions, in written form, the plan development will proceed and will be carried on by the appro- priate agencies. Said plans will be developed by the Technical Coordinating Committee and will be based upon population dis-' tribution and projections and land-use projections as prepared by the County. In terms of the highway plan, specific land-use forecasts and growth patterns for each traffic zone will be prepared as necessary by the County. Traffic projections and forecasts will be prepared by the State Road Department in : coordination with the land-use forecast by the County. 5. Design and Evaluation of Alternatives , J' During and following the plan development phase, close coordi- nation will be maintaine'd between the State Road Department and the County. and regular review of the planning progress will be undertaken by the Technical Coordin'ating Committee. The plans will be evaluated in terms of their inter-relationship and general, compatibility in the carrying out of-the goals and objectives pre- .'.:i viously established. AHerna- tives and adjustments will be tested and evaluated by recognized procedures. A plan which best serves the objectives and goals tor tuture development will be devel~ oped and then finalized by the Policy Committee and appropriate agencies. 6. Plan Adoption Following all necessary coordination, plan review and evaluation, the final plans agreed upon by the various com- mittees. will be submitted to the parties hereto. These plans will then be reviewed and modified accordingly. and adopted by each party. / 7. Plan Implementation Following the review and adoption Ot the plan. the final analy- sis shall be made ot various means available ot implem'enting the plan. and a program Ot action will be developed tor sub~ mittal to the several governing bodies and agencies responsible tor plan implementation. Included within this phase ot study will be a recommended comprehensive financial plan and capital improvement program prepared in coordination with the appropriate governing bodies. The plans will then be finally presented to the several governing bodies. together with the comprehensive tinancial plans tor their implementation. 8. Continuing Program Inasmuch as the significance ot the entire transportation study is the establishment of a continuing process of organized and compr,ehensive transportation planning. properly coordinated with other aspect~ of a long-range plan of development for 2/19/65 ~. , . ~ ,- . ,~ In, I ., . . - Sheet 9 of 9 ~" St. Petersburg Urbanize,; Area, the means for procedures for establishing a workable continuing process will be pre- pared as part of thi s study, Included within this phase will be an analysis of the means for continually updating significant planning research data so that periodic re-evaluations of all aspects of the transportation plan may be conducted in an expedient and efficient manner. The means for the establish- ment of continuing the relationships of the various agencies will be developed. The general procedures to be followed for evaluation and plan updating will be established. The County agrees to indemnify, defend, save and hold harmless the Department from any claims, demands Or liabilities of any nature whatso- ever arising out of or because of their actions under this agreement.
