THIS AGREEMENT, made and entered into this

1960, by and between the CITY OJ' CLEARWATER, FLORIDA, a municipal
corporation hereinafter referred to as "City' and PINELLAS COUNTY,
FLORIDA, a political subdivision of the State of Florida, herein-
after referred to as "County".
WHEREAS, County through its Board of County Commissioners con-
templates construction of a new County Courthouse or additions and
improvements to the present County Courthollll , and in that connec-
tion is considering the possibility or erecting such new courthouse
at a site other than the one presently Occupied by the present

courthouse; and
WHEH&A.S, it is the desire ot the City and to the best interest
of the City that the site of the County Courthouse be not changed
and that if a new courthouse be erected it be done on the present
courthouse 8ite; and
WHBRBAS, County has obtained from Rader and Associates, En-
gineers and ArChitects, a preliminary study dated December, 1959,
from which it appears feasible to retain the present courthouse
site provided certain road and street improvements be made by City
as outlined in Chapter V of said prel1minary study and, in order to
induce County to retain the present courthouse site City is will-
ing to agree to make said road and street improvements provided
County will agree to retain the present oourthouse site for construc-
tion of such new courthOUse facilities as may be determined ap-
propriate by the County,
NOW, 'l'H.IREFCRIi:, WI'l'HlWSB'l'H, that for and in consideration of
the mutual covenants and agreements herein contained, it is hereby
agreed by each of the parties hereto as follows:
1. City agrees that :IJIIID4KU,&Yly upon determination by County
acting by and through its Board of County COmmissioners, that the
present courthouse site will be retain~ and that such new court-
house or additions or improvements as COl.\ll.y may deem a.ppropriate
to construct will be placed upon the siilt of the present county
courthouse together with BUch additions adjacent thereto as County
may acquire, City will commence and prooeed to completion of as

(.5) VaGate, close and abandon Palm Avenue from Ch~st!:ut Street
extended to Haven Street.
(6) Ciyy agrees that any request .for rezoning of property in ths
area surrounding the,present County Courthouse or such additional Ja.nds
a.~quired by the County for expansion of the courthouse, will be pla,ced
on the ballot at the next general election thereafter f0r referendum in
accordance with the zoning requirements of the City of Clearwater.
It is recognized that the budget of the City of Clearwater win
not permit immediate commencement and construction of the preceding
improvements, however, the City of Clea!'\'fater does agree that it will
pla.ce the preceding improvements in its budget in .July for completion
and construction thereof within a reasonable time.
3. Notwithstanding any of the proviKions, covenents and
agreements herein contained, it is agreed that the City of

Clearwater shall retain and continue to be entitled to any and
all County, State and Federal assistance in and about its road
program, including all of the projects contemplated in this
agreement; and the County of Pinellas agrees that nothing herein
contaued shall relieve the County of its Obligations to maintain
or improve any of the foregoing improvements or streets within
the City limits of the City of Clearwater, which are either now
County or State roads. or which may hereafter be so designated.
4. In consideration of the foregOing, County, acting by
and through its Board of COUnty CODIIII:I.sBioners, agrees that the
present site of the Pinellas County Courthouse will be retained
and. together with such additional adjacent real property as
COUnty may need to acqUire hereafter, w11l be utilized as the
site for the erection and construction of such new County
Courthouse faCilities as may be hereafter erected and constructed
by County, inclUding additions and improvements to the present
courthouse faCilities, and County's Board of County Commissioners
will proceed without undue delay to the dete1'll1:l.nation of the type
of facilities to be constructed, the preparation and approval of
plans and specifications for same and the actual oonstruction
thereof.
IN WITNESS WHEREOF, City and County each have caused this
agreement to be exeouted in its name by its proper OffiCials,
being thereunto preViously authorized by the respective govern:l.ng
bOdies, and its Beal to be affixed and properly attested, all
as of the day and year first above written.
