NEW COUNTY COURTHOUSETHIS AGREEMENT, made and entered into this 1p day of „4„, 1960 by and between the CITY OF CLEARWATER, FLORIDA, a municipal corporation hereinafter referred to as "City' and PINELLAS COUNTY, FLORIDA, a political subdivision of the State of Florida, herein- after referred to as "County WIIEREAS, County through its Board of Councy Commissioners con- templates construction of a new County Courthouse or additions and improvements to the present County Courthoue , and in that connec- tion is considering the possibility of erecting such new courthouse at a lice other than the one presently occupied by the present courthouse, and WHEREAS, it is the desire of the City and to the best interest of the City that the site of the County Courthouse be not changed and that 1f a new courthouse be erected It be done on the present courthouse site, and WHEREAS, County has obtained from Rader and Associates, En- gineers and Architects, a prelimina»y study dated December, 1959, from which it appears feasible to retain the present courthouse -rte p-ovided ceeuain road and street improvements be made by City as oucli_ned in Chapter V of said oreliminery study and, in order to induce County to retain the present courthouse site City is will- ing to agree to malce said road and street improvements provided County will agree to retain the present courthouse site for construc- tion of such new courthouse facilities as may be determined ap- propriate by the County NOW, THEREFORE, WITNEbSETH, that for and in consideration of the mutual covenants and agreements herein contained, it Is hereby agreed by each of the parties hereto as follows 1 City agrees that immediately upon determination by County acc'ng by and through is Board of County Commissioners, that the present courthouse site will be retained and that sach new court, - house or additions or tmpeovements as Couni.y may deem appropriate to construct will be placed upon the site of the present county courthouse together with such additions adjacent thereto as County may acquire, City will commence and proceed to completion of as _,00-671(3)) ,OU-6Z1(3) -� •. * - rapid:? y as .possi.ble Jhe following road and stre* improvements with- in the corporate limits of the City of Clearwater: (1). Rebuild and widen Chestnut Street to four lanes from its in•rersention with Court Street west.to Fort Harrison, and extend it the same width across Fort Harrison to Bay Avenue. (2) Widen Bay Avenue to four lanes from Haven Street south to its intersection with Chestnut Street extended. (3) o1i•i'a•en Court Street to ;our lanes from its intersection witZ:? Chestnut Street east to yulf•-to•••Bay 'Boulevard, and also widen Gulf -to - .f: ay Boulevard to six fans from its intersection with Court Street east to U.S. Highway 19, as per specifications now under bid and work order. Each outside large being 12.5 feet and the two 'inside lanes on each side of parkway being 11 feet each. (!a.) Vacate, close and abandon Markley Street from Oak Avenue east to Palm Avenue. Grant a perpetual easement to County of Pinellas covaving that portion of Markley Street between Palm Avenue and Fort Harrison Avenue provided County of Pinellas maintains the same during the continuance of such easement. Widen and pave Haven Street from ?aim Avenue to Bay Avenue. "The County shall donate the right of way on Haven Street from Palm Avenue to Oak Avenue. The City shall be responsible for obtaining the right of way from Oak to Bay, if any is needed. (5) Vacate, close and abandon Palm Avenue from Chestnut Street extended to Haven Street. (6) Ciy agrees that any request for rezoning of property in the area surrounding the\present County Courthouse or such additional lands acquired by the County for expansion of the courthouse, will be placed on the ballot at the next general election thereafter for referendum in accordance with the zoning requirements of the City of Clearwater. It is recognized that the budget of the City of Clearwater will not permit immediate commencement and construction of the preceding improvements, however, the City of Clearwater.does agree that it will place the preceding improvements in its budget in July for completion and construction thereof within a reasonable time. 3.
