OF COUNTY COMMISSIONERS AND CITY OF CLEARWATER - APPROVED FOR
EXECUTION
Interim County Administrator D. Gay Lancaster recommended approval of
a Memorandum of Understanding For Data Sharing between Pinellas County Board of
County Commissioners and the City of Clearwater for the purpose of facilitating the sharing
of geographic information system data and improving access to computerized geographic
data.
Commissioner Latvala moved, seconded by Commissioner Welch and carried,
that the recommendation of the Interim County Administrator be approved.

Purpose
Computerized geographic data that is created, collected, processed, disseminated,
and stored by public agencies is a valuable information resource. This agreement will
facilitate the sharing of Geographic Information System (GIS) data and improve
access to computerized geographic data across the City of Clearwater and the
Pinellas County Board of County Commissioners (hereinafter, "Parties").
Overview
This agreement encourages both parties to share in the creation, use, and
maintenance of GIS datasets at the least possible cost. It is designed to:
· Reduce costs and duplication of effort;
· Increase awareness of the availability of existing datasets;
· Ensure the completeness and accuracy of information describing the data sets
(metadata) ;
· Encourage adherence to data standards;
. Improve the quality of data;
. Ensure consistent and enhanced access to data; and
· Facilitate coordination of GIS data gathering, maintenance, and sharing
among parties.
Agreement
The City and County governments should share GIS data in a consistent and
appropriate manner with each other at little or no cost. To accomplish this, the
following provisions shall apply:
Desianation of the "Primary Custodians" (Owners) of GIS Data - The party
that creates, develops or own GIS datasets will be considered the primary custodians
of those datasets. Secondary custodians, are those parties that are in possession of
a GIS dataset acquired from the primary custodian.
Makina GIS Data Available - Both parties shall make their GIS computerized data
available in digital format to one another. Furthermore, both parties are expected to
develop efficient methods for the distribution of this data using electronic
dissemination to the extent possible. The collection, validation, and construction of
spatial data can be a protracted or incremental process. In some cases, incomplete
datasets may lead to confusion and/or misinterpretation. Other datasets may have
certain privacy and/or public safety issues that may constrain distribution. In these
cases, the Primary Custodian will work with the Secondary Custodian, to determine

when and whether data is to be shared. In all cases, the Primary Custodian will
make the final decision on the suitability of all data distribution.
Maintenance of GIS Data - Primary custodians have the responsibility for ensuring
sound management of GIS data as to its form, content, and integrity. Secondary
custodians are required to report any errors to the primary custodian. In the event
that a secondary custodian updates the data contained in the data set, it must
provide that information to the primary custodian who may choose to include it in its
original dataset.
ImDroved Data and New Data
Improved Data are the corrections and revisions to existing categories of
information, such as error corrections, improvement in positional accuracy, updating
of existing categories, and other similar actions that do not create new categories of
information. The Secondary Custodian forwards improved data to the Primary
Custodian, who may then evaluate the improved data and determine whether or not
to incorporate it into the existing data.
For New Data, that is, new categories of information that may be built on the
foundation of existing data, the Primary Custodian of the New Data is the creating
party, unless some other agreement is reached to designate a different Primary
Custodian. The Primary Custodian of existing data is not altered by the creation of
New Data.
ResDonsibilitv
Upon acquisition and incorporation of data, the Secondary Custodian assumes
responsibility for the accuracy of the data provided by the Primary Custodian. As the
Primary Custodian has no ability to monitor how the data is represented and/or used,
the Primary Custodian cannot assume responsibility for the same. The secondary
custodian may add qualifying language to the functional use of the data, if the
secondary custodian is uncomfortable with the quality of the data. The Primary and
Secondary Custodians will agree on the language of such a qualifying disclaimer prior
to the data's release for use.
Pricina of Shared GIS Data - Both parties are encouraged to make GIS data
available to at no cost.
Requests Which Involve Proarammina - This agreement does not require a
party to create a record, therefore, when a party requests services which require
programming of the primary custodian's data, fulfilling these requests is at the
discretion of the primary custodian.
