INTERLOCAL AGREEMENT RE DISCRETIONARY SALES SURTAX OF ONE PERCENT t PINELLAS COUNTY FLI' INST . 90-291035. *** OFFICIAL RECORDS *** BOOK 7413 PAGE 574 INTERLOCAL AGREEMENT THIS AGREEMENT made and entered into this 19th day of September 1989. by and between Pinellas County. a political sUbdivision of the State of Florida. hereinafter referred to as the "COUNTY" . and the Cities. municipal corporat _ons within Pinellas County under the laws of the State of Florida. hereinafter referred to as the "CITIES". as follows: WIT N E SSE T H : WHEREAS. Section 212.055(2). Florida Statutes. authorizes the COUNTY to impose. and the COUNTY proposes to impose. a discretionary sales surtax of one percent (1\) referred to in the title of said Section as the "Local Government Infrastructure Surtax" ("Surtax"); and WHEREAS. the Surtax is subject to a referendum scheduled for November 7. 1989. in Pinellas County. Florida; and WHEREAS. pursuant to the p~visions of Section 212.054(4). Florida Statutes (1988 Supp.). tne Florida Department of Revenue 1--. shall collect the Surtax and d~tribute the net proceeds thereof (after deducting the Department's administrative costs up to three percent [3\] of the Surtax collections) to the COUNTY monthly; and WHEREAS. all parties desire to provide for a distribution of the Surtax; and WHEREAS. the proceeds of the Surtax may be distributed pursuant to an Inter local Agreement entered into between the COUNTY and the CITIES; and WHEREAS. all parties recognize that jail and court facilities are countywide in nature. and benefit all of the citizens of Pinellas County; and WHEREAS. this Inter local Agreement is authorized by the provisions of Section 163.01. Florida Statutes. which authorizes the cooperative exercise by agreement of two or more pUblic agencies of any power common to them. NOW. THEREFORE. in consideration of the covenants herein ,-. .. This Interlocal Agreement may be amended. in writing. upon the express formal consent of the governing bodies of all the parties.
