CITY OF CLEARWATER PROPERTY LOCATED WITHIN SECTION 8
TOWNSHIP 29 SOUTH, RANGE 16 EAST

THIS AGREEMENT, made and entered into this 1'7 day of

, 198~, by and between pinellas County, a political

of the State of Florida, acting by and ,through its Board of
County Commissioners, (hereinafter sometimes referred to as the County)
and the City of Clearwater, Florida, a municipal corporation within
said pinellas County, acting by and through its City Commission
(hereinafter referred to as the City).
WITNESSETH:
WHEREAS the City, to insure an adequate supply of potable

1-') water for diE tribut ion to its citizens, entered into a contract with

the County on the 19th day of March, 1976; and
WHEREAS, the County agreed to furnish the City 10 mgd of
water for its use and for redistribution in the City's water service
area;
WHEREAS, the County and the City mutually agreed to transfer
from the County water service area to the City water service area that
property as described in Exhibit A in the Agreement dated the 19th of
March 1976 at such. time a portion of the said property within the
boundaries as described in said Exhibit A is annexed into the City,
and;
WHEREAS, the prope~ty located in Section 8, Township 29
South, Range 16 East and more specifically described in Exhibit A-A,
a ttached herewith and made a part of this Agreement, was annexed into
the City on

WHEREAS, the City has requested the property described in
Exhibit A-A, which is a portion of the land described 1U Exhibit A of

WHEREAS, the County and the City mutually agree that the
property described in Exhibit B-B not be annexed into the City;
NOW, THEREFORE, for and in consideration of the moneys
hereinafter agreed to be paid and the mutual covenants to be performed
by each of the parties hereto as hereinafter set forth, said parties do
hereby mutually agree as follows:
1. The County agrees to transfer from the County service
area to the City service area the property described in Exhibits A-A
and B-B attached hereto as a part of this Agreement.
2. The County agrees to transfer to the City all water
facilities, except any portion of the 42" concrete main, the 8" tap and
valve on the 42" main arid the meters as shown on Exhibit C-C attached
hereto and made a part thereof, more accurately described as 6" and 8"
mains,
private
firelines,
fittings,
appurtenances,
valves,
fire
hydrants, service lines and meter boxes.
3. For consideration to the City by the County for not
requiring the property where the Highway Maintenance Yard is located
and more specifica lly described in Exhibit B-B to be annexed to the
City, the County will at no cost to the City transfer the property'
described in Paragraph 2 hereinbefore.
In turn to satisfy the
provisions of Paragraph 10 of the Agreement between the County and the
City dated the 19th day of Harch 1976, the County will agree to
transfer from the ~inellas County Highway Maintenance Account to the
pine lias County Water System Account a sum representing the cost of
water facilities which will be transferred from the County to the
City. Any money to be paid by one County Department to another County
Department will be internal transfers and no concern to the City.
4. The City, within three weeks from the execution of this
Agreement, will initiate a program with the County to disconnect the
facility connected to the 8" valve which is installed on the 42" main
and for removal of the 3 meters present ly used by the County to make
service available to the Pinellas County Highway Maintenance Yard as
shown on Exhibit C-C and shall return to the County those meters that
have been removed jointly by City and County work crews.
S. The County as part of this Agreement transfers to the
City the easements described in Exhibits D-D, E-E and F-F attached
hereto as a'part of this Agreement.

6. The Caunty and the City recagnlzes an easement will have
ta be granted by Frank C. Kunnen, awner af the praperty shawn an
Exhibit F-F, in arder that the City can cantinue ta make water service
available ta the area described in Exhibit B-B.
The Caunty will
caaperate with the City in abtaining this easement.
7. This Agreement daes nat replace ar supersede any af the
pravisians in the Agreement between the City and the Caunty entered
intI' an the 19 th day af March, 1976, but is applicable anly ta thase
partians af Paragraph 1 and Paragraph lOaf the Agreement dated an the
19th day af March, 1976, which pravides far the transfer af water
service areas and water facilities fram the Caunty ta the City.
8. This Agreement, which pravides far the transfer af water
service areas, water facilities and payment far said water facilities
fram the Caunty ta the City, shall remain in perpetuity.
