WHEREAS, Peter G. Nichols, owner of real property located in the City of Clearwater, has requested that the City vacate the utility easement depicted in Exhibit A attached hereto; and WHEREAS, the City Council finds that said easement is not necessary for municipal use and it is deemed to be in the best interest of the City and the general public that the same be vacated; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CLEARWATER, FLORIDA: Section 1. The following: The south 10 feet of the 20-foot utility easement described as beginning at a point 10 feet west of the southeast corner of Lot 8, Block B-2, Maryland Subdivision, as recorded in Plat Book 15, Page 25 of the Public Records of Pinellas County, Florida, thence west along the south property line of Lot 8 and Lot 7 in said Block B-2 a distance of 60 feet, thence south for a distance of 20 feet; thence East along and parallel to the South Boundary of Lots 7 and Lot 8 of Block B-2 a distance of 60 feet, thence north 20 feet to the Point of Beginning, is hereby vacated, and the City of Clearwater releases all of its rights in the servitude as described above to the owner of the servient estate thereto. Section 2. The City Clerk shall record this ordinance in the public records of Pinellas County, Florida, following adoption. Section 3. This ordinance shall take effect immediately upon adoption.
