Richter, Development Code Administrator SIIBJECT: Certification of Simple Adjustment to the Final Site Plan for Sunshine Terrace Located at 1247 South Greenwood Avenue (PSP 82-31). COPIES: See List Below DATE: August 15, 1989 The last site plan ~_certified (on July 19, 1989) for this site involved the addition of a carport for 18 parking spaces over an existing paved parking area on the south side of the existing southeasterly condo building. That change to the plan was authorized by the Development Review Committee (DRC) on July 13, 1989 following approval of a related variance on June 22, 1989 by the Development Code Adjustment Board (DCAB) as the total required number of spaces for the site was being reduced by 3 in order to construct the carport and another proposed future carport (for 6 spaces). The DCAB has since (on July 27, 1989) approved a setback variance for the other 6 space carport to be constructed 4 ft. 6 in. from the south property line. The applicant is now requesting approval of an adjustment to the site plan for the referenced6 space carport. As the setback variance has been approved by DCAB for this 6 space carport and all DRC members have reviewed the current request andhave found the change to the plan to be acceptable with no objections, I am approving the request as a simple adjustment to the plan. The Planning Official explained the application in detail. Staff recommends approval of Variance ttl and denial of Variance ;2. In response to a question, it was indicated that the reduction in~the number of parking spaces will allow for.~the carport poles: Herbe~`t Wright, representing the condominium board of directors, stated 80% of the tenants are at least 55 years old and drive larger cars. He feels larger parking spaces are needed for maneuverability as well as for the carport poles. The carports were part of the original plan but the developer did not complete them. The residents are now requesting that the 24 carports be completed and have already paid for them. One resident spoke in support stating the carports will be covering existing parking spaces which are located close to the building and elevator. He indicated four handicapped spaces will be provided. Discussion ensued regarding relocating six of the spaces on the property so as not to conflict with future development on the vacant lot to the south. Based upon the information furnished by the applicant,- Mr. Graham moved to rQ ant- Variance ~l as requested because the applicant has substantially met all of the standards for approval as listed in Section 137.012(d) of the Land Development Code, it arises from a condition which is unique to the property and type of use and was not caused by the applicant, and the particular physical surroundings, involved which is the number of parking spaces needed for this type of condominium group which has elderly residents and residents who do not drive, and would create an unnecessary hardship upon the applicant if a strict interpretation of the Code were to be applied, subject to the condition that a building permit be obtained within six (6) months from this date. Mr. Graham indicated he had a conflict of interest regarding Item T3. The Planning Official explained the application in detail. Staff recommends denial of the variance. He outlined the procedures and advised that anyone adversely affected by any decision of the Development Code Adjustment Board may appeal the decision to an Appeal Hearing Officer within two (2) weeks. He noted that Florida law requires any applicant appealing a decision of this Board to have a record of the proceedings to support the appeal. In order to provide continuity, the items will be listed in agenda order although not necessarily discussed in that order. ITEM A~ -'(continued from~6/22/89) Sunshine Terrace Condominium Association for a variance of 7 ft 6 inches to .permit carport structure 4 ft 6 inches from a side property line, at 1247 South Greenwood Ave, Sunshine Terrace Condominiums, zoned RM-28 (multiple family residential). The Planning Official explained the application in detail stating a parking variance was granted in June, but the setback variance was continued to allow the applicant to investigate relocation of parking. Michael O'Malley, secretary of the condominium association, stated, due to problems encountered by the developer, some units were sold without carports. These residents have now paid for carports to cover existing parking spaces and feel inconvenienced because of the delays. Placing the carports near the south property line puts them closer to the elevator than if placed at the north end of the property. The vacant land to the south is owned by Sunshine Mall and they have no objection to the carports. DEVELOPMENT CODE ADJUSTMENT BOARD Chairman . _ ... I.i ~/~} Rick Luccia, of Peterson Engineering, stated the carports would be 290 feet from the elevator if placed at the north end, but only 65 feet away if placed near the south property line as proposed. Two letters in support were submitted for the record. Based upon the information furnished by the applicant, Mr. Graham moved to orant the variance as requested because the applicant has substantially met all of the standards for approval as listed in Section 137.012(d) of the Land Development Code, it arises from a condition which is unique to the property and location of the existing buildings, and it is the minimum necessary to overcome the hardship of the distance to the elevator, subject to the condition that a bui+lding permit be obtained within six (6) months from this date. ITEM ~1~= Andrew and Nicholas Cisek (Texaco) for variances of 1) one business identification sign to permit two such signs, and 2) 24.36 sq ft to permit a total of 39.36 sq ft business identification signage, at 3100 Gulf-to-Bay Blvd, Sec 16-29-16, M&B 24.05, zoned CG (general commercial). The Planning Official explained the application in detail stating the applicant wishes to place signage on both ends of the canopy. Staff recommends approval of the variances. Ron Bingham, representing the applicant, stated visibility of their gas station is blocked since they lost a corner sign due to roadway improvements and the existing pole signs are blocked by foliage and buildings. The signage will have the smallest letters available. One letter in opposition with four signatures citing lowered property values and problems with lights at night was submitted for the record.
