Signs and fencing/walls shall be subject to separate review and permitting processes. 2. Curbing and pavement of existing driveways to be deleted shall be removed and landscaping, sidewalks and curbing parallel along the streets shall be installed in accordance with City standards. 3. Afire department connection north of the hydrant shall be provided by the Fire Marshal and shown as such on the site plan prior to certification. 4. The note "by the City of Clearwater" for the landscaped plaza shall be removed from the site plan prior to certification. 5. The existing gas service and meter must be relocated by the City's Gas Division. 6. The requisite initial building permits must be procured within six (6) months from the date of certification of the final site plan and all requisite certificates of occupancy must be obtained within three (3) years of date of certification of the final plan. Based on the information contained in the application and other information obtained from you during the review of the development proposal, we enter the following Findings of Fact, Conclusions of Law, and Order. FINDINGS OF FACT 1. The applicant is Dennis Dean of Sunbelt Development Services, Inc., who is the authorized representative of the owner/developer, MAS ONE LIMITED. 2. The applicant is seeking a vested rights determination pursuant to Subsection 380.06(20), Florida Statl.ztes (F.S.), to establish whether the Clearwater Tower development (Figure 1) is required to undergo DRI review. In addition, the applicant is seeking a determination of DRI status on the proposed and existing nonvested development. 3. The Clearwater Tower project will consist of two office buildings (one existing and one proposed) containing a total of 256,379 gross square feet (GSF) with an existing 51-space parking area. The existing 11-story building contains 146,335 GSF on 0.90 acre. The proposed 12-story building is proposed to contain 110,044 GSF on 0.98 acre. The existing parking lot contains 51 spaces and is located on 0.55 acre across the street from the 11- story building. The existing and proposed office buildings are to be located together on a 1.88-acre site (this number does not include the 0.55-acre parking lot). The Clearwater Tower project is located on Lots~1- 7, of Block 8, of Gould & Ewing first and second Addition, Clearwater Harbor in Section 16, Township 29 South, Range 15 East, in the City of Clearwater, Pinellas County. 4. A history of the project is as follows: On December 30, 1970, the City of Clearwater and the Bank of Clearwater entered into an agreement for the leasing of land for a new office building at 600 Cleveland Street. The agreement specified that construction of the multi-story office building had to begin within three years of the date of the agreement (commencement of construction to be deemed the pouring of the facility's foundation), or the City could terminate the agreement. The lease was executed on July 1, 1970. On June 8, 1972, a demolition permit was issued by the City to allow the demolishment of a previously existing building at the northeast corner of Cleveland and Garden Streets. A boundary and topographical survey was prepared for the Bank of Clearwater on September 20, 1972. The demolition of the previous building and capping of the existing sewer line commenced on October 26, 1972. On January 22, 1973, a permit was issued by the City of Clearwater to construct the $300,000 foundation on Lots 1 - 7, Block 8 in the Gould & Ewing Subdivision. Drawings submitted with the permit request indicated that a 15-story building would be built on the requested site. The City of Clearwater did not begin requiring site plan approval until the late 1970's. In December of 7986, the applicant acquired the 11-story office building and the 51-space parking lot (located north of Cleveland Street and west of Garden Avenue, across from the existing 11-story building). According to the applicant, this 11-story office building has been continuously occupied since its construction. On June 15, 1989, the Clearwater City Commission approved the preliminary site plan for the proposed 12-story office building on the site. 5. The applicant is seeking a vested rights determination for the existing 11-story building and has provided the following information in support of his claim of vested rights: } Mr. Dennis Dean November 3, 1989 Page Three December 30, 1970 - Agreement between City and Clearwater Bank to lease land on which to build a multi-story office/bank building. The Bank of Clearwater invested $36,000 in this property and agreed to invest an additional $2,500 for landscaping. June 8, 1972 - Permit issued to demolish an existing building located on the site of the 11-story office building. September 20, 1972 - A Boundary and Topographical Survey prepared for the Bank of Clearwater. October 26, 1972 - Inspection certificate of sewer cap. January 22, 1972 - Permit issued to erect a foundation on the site. August 17, 1973 - Inspection certificate of seven pile caps. August 20, 1973 - Inspection certificate of construction activities including foundation, footings, lintels, and walls. August 22, 1973 - Inspection certificate of three pile caps. August 24, 1973 - Inspection certificate of six pile caps. August 28, 1973 - Inspection certificate of five pile caps. August 31, 1973 - Issuance of electrical permit to approve rough ceilings and five pile caps. 6. As further evidence of reliance and change of position on the foundation permit issued on January 22, 1973, the following information was submitted: Mr. Victor Chodora, A.I.A., Building Director for the City of Clearwater, provided a letter to the Department dated October 30, 1989, stating, in part, that, "based on the plans submitted for [the] foundation permit, which show a fifteen story building on a pile foundation, I would estimate it taking two to three months to drive the piles. Depending on weather and site conditions it could have taken even longer." Mr. Joseph F. Cornelius, former Chairman of the Board of the Bank of Clearwater during the construction of the Bank of Clearwater building, provided a copy of a news article, dated January 22, 1973, which reported the ground breaking for the new Bank of Clearwater building and an affidavit which states, ~ . Mr. Dennis Dean November 3, 1989 Page Four in part, that "to the best of his knowledge and belief, construction in the form of digging for the foundation was started within a very few days of the ground breaking, well in advance of July 1, 1973." King Engineering, on behalf of their client Sunbelt Development Services, submitted a letter from Mr. Stephen G. Helfer, P.E. (Florida Registration No. 35186), Vice President of Construction for Opus South Corporation, which explained the requirements of the Standard Building Code for pile foundations. He stated that, ". the test pile procedure required approximately 4 weeks, and the installation of the piling shown on the drawings required approximately 16 weeks ." 7. The governing statute on vested rights determination is Subsection 380.06(20), F.S. This section provides that nothing in Section 380.06, F.S., shall: ..limit or modify the rights of any person to complete any development that has been authorized by registration of a subdivision pursuant to Chapter 498, F.S., or by recordation pursuant to local subdivision law, or by a building permit or other authorization to commence development on which there has been reliance and change of position, and which registration or recordation was accomplished, or which permits or authorization was issued prior to July 1, 1973. 8. Any project which was constructed or which received authorization to commence development on which there was reliance and change of position prior to July 1, 1973, is vested for purposes of DRI review pursuant to Section 380.06, F.S. The applicant has provided the Department with information and evidence to document that the Clearwater Bank Building had received authorization to commence development on which there was reliance and change of position prior to July 1, 1973. The City issued a foundation permit for the proposed building, with the knowledge that a 15-story building would be erected on the site, on January 22, 1973. In reliance on that authorization, the developer broke ground on January 22, 1973, and began construction of the foundation prior to July 1, 1973. 9. No documentation or claim was presented by the applicant that the proposed 12-story building or the existing 51-space parking lot received authorization to commence development prior to July 1, 1973. In December 1986, the applicant received local government authorization to construct, and subsequently constructed a 51-space parking lot that currently serves the 11- story office building and will also serve the proposed 12-story .~ . ~` Mr. Dennis Dean November 3, 1989 Page Five office building. On June 15, 1989, the applicant received preliminary site plan approval from the local government for the proposed 12-story, 110,044 GSF office building. . 10. Paragraph 380.06(2)(d), F.S., provides that a development which is at or below 80 percent of all numerical thresholds in the applicable guidelines and standards shall not be required to undergo DRI review; a development that is between 80-100 percent of a numerical threshold is presumed not to be required to undergo DRI review; a development at 100-120 percent of any numerical threshold is presumed to be required to undergo DRI review; and a project which is at or above 120 percent of any numerical threshold in the applicable guidelines and standards is required to undergo DRI review. Ruie 28-24.020, F.A.C., (Office Development), provides, in part, that the DRI threshold for any proposed office building or park operated under common ownership, development plan, or management is 300,000 square feet of gross floor area or 30 acres. The proposed 12-story office building with 110,044 GSF of proposed floor area on 0.98 acre, and the existing 51-space parking lot of 0.55 acre is less than 80 percent of the DRI office threshold. 11. All commitments made by the applicant, all materials submitted by the applicant in the application, and all other relevant written materials are incorporated herein by reference and made a part hereof. 12. On August 4, 1989, notice of this request for a Binding Letter of Interpretation was published in the Florida Administrative Weekly. In addition, the Tampa Bay Regional Planning Council and the City of Clearwater were notified. CONCLUSIONS OF LAW 1. Based on the information supplied by Sunbelt Development Services, Inc., on the behalf of the owner/developer, MAS ONE LIMITED, which indicates that construction of the foundation was authorized and begun prior to July 1, 1973, the Department concludes that the 11-story, 146,335 GSF office building is vested pursuant to Subsection 380.06(20), F.S. 2. The existing 51-space parking lot and the proposed 12- story, 110,044 GSF office building is not vested. However, this existing parking lot and proposed office development is below 80 percent of the DRI office threshold. Therefore, pursuant to ~~ .. r_ . .. Mr. Dennis Dean November 3, 1989 Page Six Paragraph 380.06(2)(d), F.S., the Department concludes that the existing 51-space parking lot and the proposed 12-story, 110,044 GSF office building is not required to undergo DRI review. ORDER 1. The Clearwater Tower development, consisting of an existing 11-story, 146,335 GSF office building, a proposed 12- story, 110,044 GSF office building and a 51-space parking lot, as described above, is not required to comply with the review requirements of Section 380.06, Florida Statutes. 2. Any proposed changes to the vested portion of this project may require further review pursuant to Paragraphs 380.06 (4)(e) and (f), Florida Statutes. 3. The proposed, nonvested 12-story building and 51-space parking lot development evaluated in this binding letter shall be considered cumulatively with any future additional development in terms of the guidelines and standards contained in Chapter 28-24, F.A.C., Section 380.0651, F.S., and its associated regional impacts. Should any of the above representations made by the applicant be substantially changed, further review of the project may be required. 4. The determination in this binding letter specifically regarding the development of regional impact status for the nonvested development shall expire and become void as of November 3, 1992, unless the plan of development has been substantially commenced by this date. This date may be extended by mutual agreement of the Department, the local government of jurisdiction and the developer. 5. This binding letter of interpretation of vested rights has been issued pursuant to the procedural requirements of Subsection 120.57(2), F.S., and constitutes final agency action appealable within 30 days to a District Court of Appeals pursuant to Section 120.68, F.S. If you wish to present oral or written evidence, or a written statement in opposition to this agency action, you must file with the Department a written request for an opportunity to do so within 30 days from this date.
