the existing K-Mart structure, the related change in the parking requirement
is clarified in the attached letter from the owner's architect. Please note
the requirement is decreasing for the new use. As the existing on site
parking is not being physically altered and there are no other- proposed site
changes external to the structure, a revised site plan. is not required.
Please attach this copy of the letter to your certified-final site plan for
this development.

Pursuant to your request for clarification and certification that the parking
facilities will comply with the City of Clearwater Code Section 136.022, find
the pertinent and required information listed below.
A) The total gross floor area of the above referenced K mart is
approximately 95,900 square feet. The TBA area was
previously used as an automobile service facility. Area.
contained within this TBA was in the amount of 9,250 square
feet.
B) The TBA was designed to accommodate (12) service bays and had
an average of (10) persons employed and working daily. In
accordance with your parking requirements, this would
necessitate a minimum-of (6B) spaces to be allotted for this
.. area.
C> Upon converting this 9,250 square feet to retail sales floor
space, the parking requirements would change and dictate that
a minimum of (50> spaces be made available.
D) Although the TBA is being converted to retail sales area, the
basic requirements for parking have already been exceeded,
and we would therefore be in compliance with the code.
Dur recommendation is to approve the existing parking allotments.- This form
should be attached to the permit drawings as certification of the parking
requirements. If we can be of further service, please contact us.

The site plan for K-mart Shopping Center on the north side of
Gulf-to-Bay Boulevard was approved by the City Commission on
December 20, 1979. The City Clerk subsequently certified the
plan on January 7, 1980.
The Rax Roast Beef Restaurant at the intersection of Gulf-to-Bay
Boulevard and Gunn Avenue is incorporated within K-mart Shopping
Center plan. The president of Rax is requesting that the
certified plan be amended to allow an addition to the building on
the south side, to angle the parking which is adjacent to Gunn
Avenue, and to remove three parking spaces in front of the store.
The Traffic Engineering Department has reviewed the parking
modifications and has determined them to be unobjectionable. Our
Department's review of the revised plan reveals that it will
continue to comport with all Zoning Code requirements.
I recommend we approve the plan amendment as a minor plan chanae.

attached ,copies of the revised plan to the City Clerk so that she
may certify them as a valid record of change and distribute them
to the appropriate departments. Each department receiving the
plan should attach -their copy of the amended plan to the
original certified plan for the overall shopping center.

The Development Review Committee at its meeting of January 23, 1992 approved the above described
amendment subject to the following conditions:
1. Developers to provide calculations to show if any additional stormwater storage is to be provided.
2. Interior landscapuxg plan shall be provided in accordance with the City's Land Development Code to
Environmental Management and Planning for their review. A ten foot (10) average buffer along Gulf-To-
Bay Boulevard will be included in the landscaping plan.
3. Screen all dumpsters located on site and landscape accordingly.
4. Landscape the entire periphery of the parcel with screening on the north side facing Rainbow Drive with
a combination of fence and vegetative materials.
5. If desired by the applicant, consider abandonment/ vacation of adjacent streets.
As conditions numbers 1, 2, 4 & 5 have been met, please certify the attached plans subject to condition number
3 listed above and distribute.

1.3 Parking requirement for Kmart is 1 space per 200 s.f. of
building area. The building area does not need to include
the Garden Center, as it was not included in the center's
original site plan.
1.4 Planner advised that the existing parking and landscape will
need to be upgraded to comply with current codes if more
than 250 of additional building area is added to the center
or if there is more than a 30o increase of the center's
current market value.
1.5 The City has no requirements for screening of roof top
equipment.
1.6 City requires Site Plan Review process to amend existing
site plan. Process for Site Plan Amendment would include:

b. Completed Application for Site Plan Review.
c. Payment of $50.00 site plan review fee.

Dear Mr. Polatty:
Mr. Michael Lynch, Cuhaci & Peterson Architects, has provided us
with a copy of the January 23, 1992, Development Review Committee
minutes regarding conditional approval of the above-referenced
project. Please be advised that we have revised the site
development plans in accordance with the five (5) stipulated
conditions and have provided a written response to each condition
in the order received as follows:
1. Pursuant to our telephone conversation with Mr. Bob Maran on
February 12, 1992 we have reviewed development plans with
respect to the City's stormwater detention criteria for
property undergoing redevelopment to determine if additional
stormwater detention facilities were required. KMart
proposes to replace existing building and pavement areas
with a KMart building expansion area. Additionally,
existing paved parking areas along State Road 60 are being
removed and replaced with landscaping in order to enhance
the project's buffer area along its frontage. The net
result of these improvements is a decrease of 10,003 SF of
impervious surface on the project site. We performed an
analysis of "Pre" and "Post" Development Runoff Coefficients
using the City's methodology for areas undergoing
redevelopment and found a negligible "DELTA C" differential
between the two conditions. Therefore, pursuant to our
conversation with Mr. Maran, no stormwater detention
modifications will be required. Two sealed copies of our
calculations are attached herewith.

2. Landscape Plan detailing proposed landscape improvements,
both interior and within the peripheral buffer areas, is
provided herewith as Sheet C-4. The buffer along State Road
60 averages a width in excess of 10'.
3. Dumpster pads will be constructed with screen fence
enclosures (Sheet C-1). Landscape plantings provide
additional screening for KMart's facilities facing Rainbow
Drive (Sheet C-4).
4. See response to Item 2. It is our understanding that the
architect, Michael Lynch, was subsequently advised that
fencing would not be required along Rainbow Drive.
5. Not applicable, no abandonment/vacation is proposed.
We hope the revisions to the plans and responses contained herein
adequately address all conditions received. Should you have any

Dear Mr. Clarke:
We are in receipt of Mr. Michael Quillen's letter dated March 12,
1992 regarding the above-referenced project. We have reviewed
his suggestions for increasing interior landscape areas and have
found three areas where they can be accommodated. It is agreed
to expand the endrow island nearest Payless Shoes and to provide
two endrow islands at the rear of KMart. We are not able to
provide landscaping at KMart's northwest corner since that
pavement provides access to the existing truck dock facility.
Also, we prefer not to lose the three parking spaces in front of
KMart as we just had a variance approved for a reduced number of
spaces and the relocation areas he suggested are not suitable for
parking. One area is the Garden Center's loading zone and the
other is part of an existing retention area.
On March 26, 1992, after not being able to reach Mr. Quillen, we
discussed these items with Mr. Allen Mayberry and he appeared
agreeable to our proposal. Pursuant to his request, we have
revised the interior landscape area square footage and percentage
within the site data on Sheet C-1.
Attached herewith please find twelve (12) sets of revised Site
Plans. We hope the revisions made adequately address all
comments received to date. Should you have any questions, please
do not hesitate to advise.

Attached is our application for site plan review, 15 copies of signed and sealed
site drawings and a check in the amount of 550.00 for the application fee.
Per our meeting of March 20, 1991 you indicated that this could be handled as a
minor site plan amendment and could be reviewed and approved at staff level not
requiring the full site plan review process.
In reviewing our application you will notice that the existing Rax's restaurant
which we propose to remodel is 3145 square feet plus an outdoor freezer of 195
square feet. The square footage after our proposed remodel will be 3081 square
feet. As you can see, this remodel will result in a reduction in the total square
footage of the building. With regard to parking, the existing number of parking
stalls and configuration will remain unchanged.
Please contact me if you need any additional information or have any questions.
Your assistance in expediting the approval of this minor site plan amendment
will be greatly appreciated.

p. The location, size and height of all existing and proposed buildings and structures on the site.
q. The location of existing public utilities.
r. Total paved vehicular use area (including but not limited to all paved parking spaces and driveways),
expressed in squaze feet.
s. Depiction (by shading or cross hatching) of required parking lot interior landscape areas.
t. Total land area devoted to parking lot interior landscaping, expressed in square feet and as a percentage
of the paved vehicular area.
u. The definition and location of all refuse collection facilities including screening to be provided.
2. Final site plan (i2 copies, signed and sealed by engineer/architect). All information included on or
submitted so as to accompany the preliminary site plan, as it may have been adjusted and finalized, plus
the following: ~. - - - _
a. The surveyed location, diameter at breast height, and general type of all existing trees with a diameter
at breast height of four (4) inches or more, identifying those trees proposed to be removed and those
to remain.
b. Sufficient dimensions to enable a determination that all required landscape areas are provided. (Details
regarding the location, size and species of plant materials shall be provided on the landscape plan to
be submitted at a later date with construction plans}. '
c. Provisions for both on- and off-site stormwater drainage and detention related to the proposed
development.
d. Existing and proposed utilities, including size and location of all water lines, fire hydrants, sewer lines,
manholes and lift stations.
e. .Existing (including official records book and page numbers) and proposed utilities easements.
f. Existing one-foot contours or key spot elevations on the site, and such off-site elevations as may be
specifically required and not otherwise available which may affect the drainage or retention on the
site.
g. The proposed general use and development of internal spaces, including all recreational and open
space areas, plazas and major landscaped area by function, and the general location and description
of all proposed outdoor furniture (such as seating, lighting and telephones).
h. The location of all earth or water retaining walls, earth berms, and public and private sidewalks. -
i. Phase lines, if development is to be constructed in phases.
j. Dimensions of lot lines, streets, drives, building lines, building setbacks, building height, structural
overhangs and building separations.
k. Shadow cast information if the proposed building is higher than any immediately adjacent building or
if the height of the building is greater than the distance of the building to any lot line.
