The Development Review Committee at its meeting of April 9, 1992, approved the above described revalidation
subject to the previous conditions of approval with the revised condition(s):
1. Signs and fencing/walls are subject to separate review and permitting processes.
2. . 'lni3 s:_ plan shall be revalidated for 24 months from the date of this committee meeting.
3. Prior to certification, the final site plan must be signed and sealed by a professional Engineer registered
in the State of Florida.
4. Prior to revalidation, the applicant shall provide documentation from Florida Power allowing
construction within thee 100 ft. utilities easement.
5. Prior to revalidation, a Landscape Plan in compliance with the Land Development Code requirements
shall be submitted for approval by Environmental Management Group.
As conditions #3, 4 and 5 have been met, please certify the attached plans subject to conditions #1 and 2 listed
above and distribute.

Re: Revalidation of the Certified Site Plan for Waters Edge Townhouse Development/located on the
north side of Montclair Road, east of Keene Road (PSP 83-52)
On April 9, 1992 the Development Review Committee approved the above referenced revalidation of
the site plan subject to the conditions listed on the attached copy of the unofficial DRC minutes.
Please submit twelve 112) copies of a (signed and sealed) final site plan, drawn in accordance with
Development Review Committee conditions of approval, to our office, 10 South Missouri Avenue, within
sixty (60) days from the date of approval. It is recommended that the site plan submittal be limited to
one (1- sheet.
When all conditions required prior to certification have been met, the final site plan will be forwarded
to the City Clerk for certification. Please allow approximately one week for your plan to be certified.
(Note: If no plan revisions are required, a memo of revalidation shall be forwarded to the City Clerk for
Ceritification.)
If you now wish to submit your construction plans for building permit review, please contact the Building
Division, telephone 462-6567 for instructions. Please note that no permit will be issued until the site
plan has been certified and that any necessary changes required as part of site plan certification may
result in changes to your building plan.

The meeting was called to order by Chairman Shuford in the Central Permitting Conference Room.
- In order to provide continuity, the items will be listed in agenda order although. not necessarily
discussed in that order.
ITEM 1 -The minutes of the March 16, 1995 meeting were approved with a correction top 3,
item 3, Pace Tech.
) ITEM 2 -RCS Emergency Housing, PSP (95-02) - 1552 & 1558 S. Myrtle Ave. The applicant
- proposes to construct a 14 dwelling unit apartment complex withal, 100 sq. ft. administrative
office, and a 1,000 sq. ft. future activity building designed for transitional. individuals who are
seeking employment, training and self-sufficiency. The site plan has been designed to meet City
Code off-street parking criteria, storznwater management criteria, and the landscaping requirements.
The applicant or applicant's representative presented the site plan/plat and staff presented their
comments in writing. Staff specifically indicated. the conditions below, and in the ensuing
discussion it was noted that the current plan has been revised to conform with the latest requirements
of the DRC.
The fire hydrant as shown on the plan will be deleted. The applicant will note elevations and
indicate what is located on the properties abutting the site. Retention ponds will be designed for 100

Listed below are suggested conditions for DRC approval:
1.
C The requisite building permits must be procured within one (1) year from the date of
certification of the final site plan and all requisite certificates of occupancy must be obtained
within three (3) years of the date of certification of the site plan.
2. The stormwater detention pond is to have a positive outfall or be designed fora 50-year
storm. There is an existing 15-inch storm pipe adjacent to the site on Jeffords. The site plan
shows a 15-inch RCP draining into an 8 inch PVC.
3. Prior to certification, the total paved vehicular use area and total interior landscape area
calculations shall be expressed in square feet and as a percentage of the overall site in the site
plan data block.
4. Prior to issuance of a building permit, a landscape plan. shall be submitted to Environmental
Management.
5. Prior to certification, a copy of the SWFWMD permit application and calculations shall. be
provided to Environmental Management.
6. Prior to issuance of a building permit, a copy of the approved SWFWMD permit shall be
submitted to Environmental Management.
1 7. The interior landscaping will include four trees and 50 shrubs to be located on the plan.
8. The parking lot is to be striped in accordance with Florida Administrative Code standards.
9. The driveways will be true radiuses, rather than tapered.
10. Sidewalks will be constructed with ADA-compliant ramps with a textured, tactile surface.

type. If the pipe is in good condition, the city will accept an easement over the pipe. The
easement should be a minimum of 10 feet to the west of the storm line.
12. The transformer pad. on lot 4 will have to be moved or an easement provided to Florida

13. The water main extension is to be a 4-inch line minimum. The City will make a 6 x 4 tap
paid by the owner (plan provided at DRC meeting for water line layout).
Mr. Mahan made a motion to approve the preliminary site plan. with the above DRC suggested
conditions, incorporating into the motion the comments made by staff. The motion was duly
seconded and carried unanimously.
At this point, Mr. Baier and Mr. Wilson left the meeting.
ITEM 7 -Water's Edge Townhomes Subdivision Re-plat - (SUB-95-02). The applicant proposes
to create a Tract A and three lots - 4, 5, & 6 - including a portion of the preservation/wetland areas
in the Tract A and each of the lots.
The applicant or applicant's representative presented the site plan plat and staff presented their
comments in writing. Staff specifically indicated the conditions below, and in the ensuing
discussion it was noted. that three single family residences are proposed in an existing subdivision
comprised of three townhomes and a recreation center.

In the ensuing discussion Mr. Hilton questioned whether further analysis would enable the owner
to include a fourth residential property. It was agreed that shading for ingress/egress and buildable
'~ lots will be reversed. The applicant's representative will contact the County to determine the exact
location ofright-of--way and consult the owner relative to the location of the townhomes parking lot.
Listedbelow-are conditions suggested for DRC approval:
1. The requisite building permits must be procured within one (1) year from the date of
certification of the final. site plan and all requisite certificates of occupancy must be obtained
within three (3) years of the date of certification of the site plan.

seconded and upon the vote being taken, Messrs. Shuford, Mal1an, Maran, Goodloe, Meerians, and
Quillen voted "aye"; Mr. Hilton voted "nay". Motion carried.

adjourned at 11:02 a.m.

Dear Val:
As requested at the Development Review Committee (DRC) meeting, enclosed please find
12 prints (24" x 36") of the Revised Preliminary Plat for the above-referenced project. The
Plat has been revised in accordance with the conditions imposed by the DRC and per the
agreement arrived at with Bob Moran of the City of Clearwater Engineering Department.
The following is anitem-by-item analysis of the conditions imposed by the DRC at their
April 6, 1995 meeting:
"The requisite building permits must be procured within one (1) year from the date of
certification of the final site plan and all requisite certificates of occupancy must be
obtained within three (3) years of the date of certification of the site plan."
We agree with this DRC condition.

Based on several discussions with Bob Moran through the City of Clearwater
Engineering Department staff, this Revised Plan/Plat shows a new 24-inch (24")
concrete drainage pipe that will be constructed by the City from Montclair Road,
running in a northwesterly direction. The material costs for this relocated
drainage pipe will be paid for by our client. A note to this agreement has been
placed directly on this Revised Plan.
It is our understanding that the City will remove the existing corrugated metal
pipe since, based on a recent inspection by the City, the pipe is corroded and in
poor working condition.

WHEREAS, FPC is the owner, possessor and user of three
right-of-way easements recorded in D. B. 1616 at Page 559 as Clerk's
Instrument No. 313022A, D. B. 1640 at Page 314 as Clerk's.Instrwnont
No, 329016A, and O. R. Book 2669 at Page 47U as Clerk's Irrstrurnent
No. 67 71923 of the public records of Pinellas County, Florida, said
easements giving FPC Lire right, by appropriate legal mear7s, to restrict
any occupancy or utilization of the ostaLlisned right-of-way easement
strip which would Le or could Lecome i~iconsistont with tiie safe and
efficient operation and maintenance of FPC's existing iiigir voltage
electric transmission lines and related facilities located tlrer~on; anc~
WHEREAS, APPLICANT now has or will have some right, title
or interest in the lands encumbered by the aforementioned right-r~i-wa,_,•
easement and desires to occupy and utilize a portion of said lands
limited to purposes as shown on sketch attached as Exhibit "A" and
as indicated in Specific Requirements attached as Exhibit "13"
(sometimes referred to as "APPLICANT'S utiliz~ati<~n "), and i_nvc~lvin~i
said right-of-way easement strip in only such manner as will insur_-E~
the continued safe and efficient operation and maintenance of r'PC's
existing and future high voltage electric transmission lines arld
related facilities located thereon.
NOW, THEREFORE, for and in consideration of the bone-fits
herein provided and the terms and conditions set forth below, t}~e
Parties hereto mutually agree as follows:
1. That FPC shall interpose no objection to APPLICANT'S
utilization of the designated portion of the aforementioned lands ors
the basis of any other rights or restrictions pursuant to FPC's
easement for so long as APPLICANT'S utilization strictly compliers
with and conforms to the locations and conditions specif.iccl on
Exhibit "A" and Exhibit "B" attached hereto and by this reference
incorporated herein and made a par t, hereof.
2. That APPLICANT'S utilization of FPC's right-of-way
easment strip, and APPLICANT so covenants, shall at all times comely
with and conform to said locations and conditions specified on said
Exhibits "A" and "B".
3. That compliance with said locations and cor~ditioi~s
specified on said Exhibits "A" and "B" is necessary and essenti.a:1
to render APPLICANT'S utilization of FPC's right-of-way easement
strip consistent with the safe-and efficient operation and maintenance
of the existing and future high voltage electric transmission l.in~s
located thereon, and, therefore, APPLICANT'S failure to compl}~ s~ith
any of said locations and conditions shall constitute an infringement
upon the rights and restrictions secured to FPC pursuant to tlic said
easement..
4. That FPC's Transmission Rights-of-Way Inspector,(i.e.,
Mr. Joseph G. Brown, Jr. or his designated alternate, telephone
(813) 866-5109, St. Petersburg) shall be notified by APPLICANT at
least 48 hours prior to APPLICANT'S commencing initial activities
within FPC's right-of-way easement strip.
5. That APPLICAN`i~ shall obtain a legally sufficient
easement or license from the present owner(s) of the fee simple title
to the lands underlying FPC's ric-lit-of.-way easement strip signifyi.nc~
the p2rmis.siori of such owner(s) for APPLICANT'S utilization of said
lands, and APPLICANT shall furnish to FPC's Real Estate Department
a copy of each such easement or license prior to APPLICANT'S
commencing initial activities within FPC's right-of-way easement
strip.
6. That FPC shall not be liable for any damage to
APPLICANT'S utilization howsoever resulting from FPC's continued use
and occupancy of the right-of-way easement strip; FPC, however, shall
not willfully cause undue damage to APPLICANT'S utilization.
7. That the validity of this Agreement is contingent upon
APPLICANT first obtaining letters of no objection from .the adjoining
neighbors at this location. If such letters of no objection are not
secured, this Agreement will be considered null and void.
8. That APPLICANT hereby expressly understands, c~ven~r~t.:~
and agrees (a) that nothing contained in this Agreement or contemplatc.~~l
is intended to or shall increase FPC's liability for personal injury
or death or for any property damage, (b) that FPC does not assume ar~y
such additional liability, (c) that liability arising out of the
utilization and occupancy of FPC's right-of-way easement strip by
APPLICANT and APPLICANT'S employees, agents, contractors, invitees
or any representative, is hereby assumed by APPLICANT and shall be
at the sole and exclusive risk of APPLICANT, (d) that APPLICANT
shall answer and satisfy to FPC's satisfaction any and all complaints
relative to APPLICANT'S utilization of FPC's right-of-way easement
strip, (e), that APPLICANT shall protect, defend, hold harmless
and indemnify FPC from and against any and all actions, claims,
damages and/or loss, including costs and attorney's fees, occasioned
by or growing out of any actual or claimed usage or condition of
FPC's right-of-way easement strip arising in any manner whatsoever,
directly or indirectly, by reason of this Agreement for APPLICANT'S
utilization thereof, and (f) that APPLICANT covenants not to therein
interfere with FPC's existing and future high voltage electric
transmission lines and related facilities in any manner whatsoever
and shall fully indemnify FPC from any and all losses as in Section
"(e)" above resulting from such interference.
9. That FPC does not guarantee that APPLICANT'S
utilization will be completely compatible with the safe and
efficient operation and maintenance of FPC's crxistin~~ and Futurc~
high voltage electric transmission lines within the right-of-way
easement strip and any remedial action required to resolve
subsequent conflict will be at APPLICANT'S sole expense.
10. That the validity of this Agreement is contingent
upon APPLICANT first obtaining proper zoning, authority, approval
and/or permit from the appropriate governmental body or public
agency having jurisdiction over such utilization at this location.
If such zoning, authority, approval and/or permit is not secured,
this Agreement will be considered null and void.

A. That all of APPLICANT'S activities, operations. and equipment
used within FPC's right-of-way easement strip shall at all
times be in strict compliance with the applicable provisions
of the National Electrical Safety Code (NESC) and the applicable-
rules and regulations of the Occupational Safety and Health Act
of 1971 (OSHA).
B. That upon completion of operations, APPLICANT shall notify FPC's
Inspector of Transmission Rights-of-Way heretofore mentioned in
above Paragraph 4 for inspection of the easement strip.
C. That the location of APPLICANT'S utilization be substantially
as shown on Exhibit "A".
D. That the validity of this Agreement is contingent upon its being
properly executed on behalf of APPLICANT to signify APPLICANT'S
acceptance of agreement to abide by the terms and conditions.
Failure to sign this Agreement and return the marked copy to
FPC within 30 days from the date of agreement shall automatically
render the Agreement null and void.
E. APPLICANT is hereby notified and agrees to so notify any repre-
sentatives or persons utilizing said areas with APPLICANT'S
knowledge or under APPLICANT'S control, that extreme caution is
necessary around all guying or related facilities, and in the
event of any damages or injuries, APPLICANT agrees to notify
['PC immediately.
F. That APPLICANT furnish FPC with a set of as built drawings within
thirty days of final construction.
G. That other than FPC facilities, no overhead wires, poles, light
standards, trees, buildings, structures, signs or obstacles
shall be located, constructed or installed within the right-of-way
easement strip without written approval by FPC.
H. That APPLICANT shall assume the sole duty, responsibility and
obligation of mowing and otherwise maintaining the surface of
the portion of FPC's right-of-way easement strip upon and
across APPLICANT's .land in a condition cornpatiLle wit~i L-;i~ sur-
rounding area.
I. That APPLICANT shall answer and satisfy to FPC's satisfaction any
and all complaints relative to APPLICANT's utilization of F'PC
right-of-way easement strip.
J. The entire disturbed area within the right-of-way easement strip
including FPC patrol road shall be restored to a condition at
least as good as that which existed prior to construction.
K:' That a free easily passable twenty foot (20') wide accessway
be retained along the length of the right-of-way easement strip,
across APPLICANT's paving, and to all transmission line struc-
tures for use by FPC for emergency access and for normal i>>aic~te-
nance and patrol purposes.
L. That all excavations for APPLICANT'S utilization be a minimum of
twenty-five feet (25') from the nearest edge of FPC's transmission
structures or guying.
M. That no parking or storage occur under or near FPC facilities.
N. That APPLICANT shall not use a dragline or cable type crane
within FPC's right-of-way easement strip.

O. That any and all piping and/or culverts within FPC's
right-of-way have sufficient earth cover to prevent breakage
due to the operation of FPC's vehicles and heavy equipment
within the right-of-way.
P. That any shrubbery planted within the easement strip shall
be of a variety not exceeding 12' in height.
Q. That FPC shall not be liable for damages to any landscaping
resulting from operations necessary to maintain FPC's facilities.
R. That provision in NESC be adhered to regarding distances between
ground and conductors. Ground elevation must not be increased
more than two feet (2').
S. That all parked vehicles shall be of an operative and transient
nature; mobile homes, office trailers or carriers of explosive
materials are prohibited.
T, That any sprinkling system that maybe installed shall spray
to a maximum distance of twenty-five feet (2~') from the nearest
edge of FPC's structure or guying and to a maximum height of
ten feet (10').
U. That APPLICANT agrees to install permanent markers showing the
location of the underground facilities within the right-of-way.
Said markers shall be APPLICANT'S responsibility at all times.
V. That APPLICANT shall not install cathodic protective devices
without first notifying FPC's Corrosion and Grounding Engineer,
Edward R. Beeman at (813) 866-5727, St. Petersburg.
W. That APPLICANT assume full responsibility for tl~e maintenance
of the pond and portion of FPC's right-of-way involved.
X. That no parking be allowed within twenty five feet (25') of a~iy
transmission structures or guying to allow free access for
maintenance and repair.

On May 17, 1984, the City Commission approved the preliminary
:plat for Waters Edge Townhomes. On December 6,,1984, .the
Commission revalidated their former approval subject to the
following conditions:
1. Letter of agreement be received from Florida Power
Corporation prior to ,recording the final plat agreeing to the
owner's use of the Florida Power easement;
2. The final .plat be recorded no later than June 6, 1985.

In furtherance of our conversation last week, enclosed please
find the following:
1) A copy of a letter hand delivered April 5, 1991, to Ms.
Sandra Glatthorn requesting an extension for the site
plan of Waters Edge Town Homes.
2) A copy of both sides of cancelled check #1795 in the
amount of $50, payable to the City of Clearwater in
consideration for the extension of the site plan of
Waters Edge Town Homes.
3) A copy of a letter hand delivered April 22, 1991 to Mr.
Lewis R. Hilton, enclosing the Clearwater Concurrency
Review Standard Form.
4) A copy of the Clearwater Concurrency Review Standard
Form.
5) A copy of both sides of cancelled check #1800, payable to
the City of Clearwater for review of the Concurrency
Review Standard Form.
It is my understanding from our conversation that you will
place the request for an extension for the site plan of Waters Edge
Town Homes on the agenda as soon as possible the previous approval
can be ratified. It was my further understanding that this would
probably be on April 9, 1992. Please let me know the specific date
and advise me if I should be in attendance. I would appreciate a
copy of the approval granted for this request.

RE: Extension For Site Plan of Waters Edge Townhomes
Dear Ms. Glatthorn:
Reeve, Inc. respectfully requests a two-year extension of the
Site Plan Approval for Phases II and III of Waters Edge Townhomes
located at 1822 Montclair Road, Clearwater, Florida, to April 10,
1993, for the reasons set forth in this letter.
As you are aware, the condominium and townhouse market is
overbuilt at this time. In addition, the overall real estate
market has declined substantially over the past two years. Banks
are not, therefore, willing to commit monies for financing the
construction of townhouses at this particular point in time.
Keene, Inc . , has continued to upgrade and improve the property
and common areas over the past two years. Additional trees have
been planted and the property is kept in exceptionally good
condition.
The project, as proposed on the site plan, remains consistent
with the character of the surrounding area. Pine Brick Apartments
are immediately across the street from this townhome complex and
there are three triplexes immediately adjacent to these townhouses .
Due to the developed character of the neighborhood, there is
no chance that the character of the surrounding area will change
during the requested extension period.
Enclosed herein is Reeve, Inc.'s check no.. 1795, payable to
the City of Clearwater in the amount of $50 for processing the
request of this extension. The present site plan is approved until
April 10, 1991. This request is being made prior to that date.
