I~~6 f 4~ On May 20, 1982, the C ty Commission approved a major revision to the site plan for Dan's Island, initially approved on January 8, 1981. The Commission approval of the major site plan revision was subject .to the original five (5) conditions of approval and six (6) additional conditions. Following is a list of all of the conditions of approval.: Original Conditions: •_.. 1. Approval of transfer of allowable density from .45 acre portion of property easterly o,f'Gu1f Boulevard to-the 6.0 acre portion westerly of Gulf Boulevard,. including any appropriate covenant to record same. 2. Establishment of a five (5)-foot public pedestrian easement for access to the 'public beach at either the north or south limits of the property (at the developer's option:).. 3. Exemption from the '°clear space requirement" which states that side yard parking must be three (3) feet below the adjoining pavement for meeting the clear space requirement. 4. Issuance of any building permit be subject to the completion and verification of the beach renourishment plan, or approval of the. City Engineer and Building Director as to the satisfactory state of completion and stabilization of the beach renourishment effort, as such effort pertains. to this site. 5. The requisite initial building permit be issued within six (6) months from the date of City Commission approval of the preliminary site plan and all requisite-certificates of occupancy be issued within four (4) years from the date of plan approval. Additional Conditions: 1. With respect to amendment item 5., the recreation building not exceed. a length of sixty (60) feet as measured parallel to Gulf Blvd. and a total area of 2,900 square feet; 2. Location of entry/exit gates on north and south drives in a manner satisfactory to the Traffic Engineer. Attached are ten (10) copies of the revised site plan for your certification and distribution. Relative to dhasffollows(15) numbered revisions identified on Sheet 1 of 3, please be advise Item 1 a) - The 5-ft. pedestrian easement is consistent with condition number 2 for approval of the original site plan. and, as such, does not constitute an amendment of the certified site plan. This should be shown as you indicate on your revised submission, but will not be considered an_amendment to the'site plan. Ztem 1 b),- Parking in the clear space south of Tower No. 1 at grade is consistent with City Commission action in approving original site plan on January 9, 1981 and, to the extent of the original parking, does not constitute amendment to the certified site plan. Item 2 a) - Increasing the number of parking spaces in the area south of Tower No. 1 from 50 to 61. spaces is an amendment to the plan which will require approval. This. department has no objection'to the change, although we will note that it, in effect, extends the variance authorized by the Commission by allowing additional parking in-the clear space without providing for it to be de- pressed below street grade. I would note in this connection that you propose fo>s (4) spaces over and above the minimum • Code requirements, which based on our experience with similar properties are more than ample, and would suggest the deletion of four (4) spaces - perhaps those at the very southernmost edge of the property to assist both the clear space and per- meable surface features of the plan. .. __. __a ~.~ic.R,otive Action Employer _ Mr. Elli M. A.-Mills - r~- -1~May^ 6,- 1982 ~... ~: Item 2.b) - The addition of a 5-ft. sidewalk along the east and west sides of Gulf Boulevard, approximately 1 ft. off property line on the public right-of-way, is as required and will be in- eluded as a plan amendment recommended to be approved. Item 3 - The enlargement of Tower No. 2 by an additional 28,000 sq. ft. would, by our measurement, extend the length of the building by some 14 ft. The pro}ection of this. additional building dimension perpendicular. to Gulf Boulevard would continue to meet the side yard and building separation distances calculated as the minimum under the. original plan. I would point out that while I will recommend approving this plan amendment, it further reduces the amount of open space on site in a manner inconsistent with the original rationale for variance to building height that was granted. Item 4 - The revised parking around Tower No. 2 does not substantially change the parking arrangement as originally approved and we have no objection to this amendment. Item 5 - The recreation building is proposed to be increased by some 400 sq. ft. More importantlyi its length would increase, by our measurement, from some 60 ft. to 72 ft. This would exceed the required setback and separation distance area requirements by a small amount for the lot as a whole, but more importantly, further reduces the amount of open space and increases the amount of area blocked from view by the project from the road ' to the gulf - by some 12 ft, or 20 percent over that previously approved for this building. I will recommend that no increase: in the length of the building, as measured essentially parallel to Gulf Boulevard, be approved and that any additional floor area that you deem necessary be constricted in an east/west direction perpendicular to the road. Item 6 - The parking spaces proposed on parcel 4 D are not permitted and this item is not eligible for consideration as a plan amendment. It is the position of this department that such use is not provided for under the RM-28 district; that development rights have been previously transferred from this parcel to the main parcel west of Gulf Boulevard; that the parking layout, even were it permitted, does not meet the clear space-requirements_ of the Code. This item should either be removed from the plan or be identified in.a request to the Commission to override the interpretation and application of the Code by staff. Item 7 - The addition of a wall not to exceed 2` 6" at the main entry and exit drives is permitted under the Code and is eligible to be added to the site plan as an amendment, subject to the requirements of Section 131.205 of the Code, with specific reference to landscaping requirements which will require the wall be located a minimum of 3 ft, from the property line in i'ir. This would appear to require elimination or relocation of the portions of the wall extending parallel to the right-of-way north of the main entry drive and south of the exit drive. Item 8 - The addition of the 4-ft. wall south of Tower No. 1, as ap- proved by the Board of Adjustment. and Appeal on Zoning on March 25, 1982, is a legitimate addition to the plan and will be included in the list of amendments to be ratified by the Commission. Item 9 - Refers to the seawall, a~portion which has already been constructed, with the remainder proposed. It is my under- standing, based on information provided by you, that this has been separately approved by the appropriate permitting authorities and is therefore eligible to be identified on the plan as an amendment which will be recognized by the City Commission. Item 10 - The addition of boardwalk cross-ovens behind Tower No. 1 and Tower No. 2, subject to permitting by the appropriate authorizing agencies, is not a change from the certified plan and does not require identification as a plan amendment. Item 11 - The addition of the docks on~the east side of Gulf Boulevard, as approved under a separate procedure by the Board of Ad- justment and Appeal on Zoning, and County and State agencies, is appropriate to identify on the plan so as to be recognized by the City Commission, but will not constitute a plan amendment. Item 12 - The proposal to change the exit drives at the north and south ' limits of property. to entrance and exit openings is a significant change and objectionable to this department. We strongly recom- mend reconsideration of this in order that the principal entry drive and deceleration lane serve the purpose for which they were originally intended and not compound traffic flow by adding two additional points of entry on busy Gulf Boulevard. This change~is eligible to be considered for plan amendment, but is one to which we will object. . Item I3 - The sidewalk adjustment detail,-based on water meter location, will be coordinated with the~Utilities and Building Departments relative to a recommendation for plan amendment approval. Item 14 - Addition of the landscape islands in the parking lot south of Tower No. 1 is a welcome improvement and will be recommended for approval. Item 15 = The revised- shape of the swimming pools presents no problem and is a minor adjustment that will be included with the other amend- .. ments recommended for approval. Mills =~ 4 - ^May 6, 1982 r ~:. , .: to reiterate my initial objection to two swimming pools and the consequent reduction in clear space directly attributable thereto - the validity of which objection has been borne out by the 4-ft, wall north of the pool adjacent to Tower No. 1 subsequently authorized by the Board of Adjustment and Appeal on Zoning. Other changes we have noted on the plan as proposed to be revised but not identified by you include:. (1) concrete walks forward of the coastal construction control line which should be separately identified as subject to permitting by the appropriate State authorities; and (2) the 4-ft. walls proposed south of each Tower No. 1 and Tower No. 2 which are additions to the plan not identified on the certified plan and which will-require amendment and should be identified as such. I would also recommend a minimum 3-ft. separation distance between the 5-ft. pedes- trian easement on the north end of the property and the parking spaces adjacent to the easement to accommodate minimum landscape requirements. Based on and consistent with the above explanation, I will be happy to process your revised plan for major site plan amendment to be considered by the City Commission. Prior to doing so, it will require a deter-~,..ination on your part as to whether to seek such additional variances as are required or to delete same from the site-plan, in that the City. Commission cannot consider the site plan until any required variances have been disposed of. With respect to the parking on the east side of Gulf Boulevard, I understand from our discussions and correspondence that you do not agree with our interpretation of the Code. I believe you should determine whether you propose to challenge such interpretation and position through the courts at this juncture, deleting same from the requested amendments so as to provide for the matter to be adjudicated by the courts; or whether you desire to have the plan, including the parking, presented to the City Commission with the understanding that it will be recommended to be denied on the basis that the parking is outside the provisions of the Code and not only should not, but cannot, be approved by the City Commission. SUBJECT: Site Plan Amendment/Dan's Island on Sand Key•.Phase II` DATE: June 17, 1985 On January 8, 1981, the City Commission approved the site plan for Dan's Island subject to conditions. On May 20, 1982, the City Commission approved a major .revision which included additional conditions of approval. The project is nearing completion and the attached site plan for Phase II has been submitted to reflect the as-built conditions of the site. The differences between the formerly approved plans and the revised plan include the deletion of three dwellings units and the deletion of eight parking spaces. The revised site plan conforms to the regulations in the Code and to all the conditions of approval placed on the project by the City Commission. The Traffic Engineering Department has reviewed the revised plan and has no objection. I recommend we approve the modifications as a minor plan change. If you concur, please initial this memo and forward the eleven attached copies of the revised site plan to the City Clerk for certification and distribution. Note: The attached plan is a supplement to the site plan certified by the City Clerk on November 8, 1983.
