"My staff has further researched the Cabana Club site plan approval. It has again been verified that the restaurant and surrounding area was planned and developed as part of the Cabana Club site plan which included the condominiums to the north. ~ As parking and other similar improvements are existing in the southerly side waterfront setback area, it is now determined that this area is not considered to be the designated clear space area for the property and that rather the other side waterfront setback area on the north side of the site is the clear space. This means that grade level parking and other grade level amenities may still be permitted within the southerly side setback area, but no structures may be constructed in this area without variance approval. While the CG and RM 28 zoned portions of the site will still be combined and reviewed under one site plan approval, the CG zoning restrictions should be used for determining the maximum density and floor area ratio for any new (re)development on the CG zoned portion of the site. Our research reveals that the restaurant and surrounding area was planned and developed as part of the Cabana Club site plan which included the condominiums to the north. The existing space on the south side of the restaurant, approximately 100 feet in width, was provided to satisfy minimum setback and clear space requirements of the code for the Cabana Club Condominium and adjoining restaurant. This affects the use of this portion of the site for additional development regarding the construction of units on the property designated as clear space and setback. At this early stage of evaluating design options, it is my recommendation that the open space on the south side of the restaurant be preserved. The City will entertain review of design options that continue to respect the code-required features of the original site plan (including density, setbacks, clear space, and open space) such as construction on the property now used by the restaurant building or parking toward the road, but not affecting the designated clear space. Minimum width per unit: Eighteen (18) feet (d) Statement of approval: Statement approval shall be obtained from the planning and zoning board, city engineering department, and any other jurisdiction. (a) Notwithstanding the zone classiFcation there shall be established on the following streets a minimum building setback of ten (10) feet from the existing right-of-way or forty (40) feet from the center line of the right-of-way, whichever is the greater. Such setback shall also be established and required on all properties hereafter annexed and which are abutting U.S. Highway 19 right-of-way from the city limits on the north to the city limits on the south. Waterfront~~i~operty setbac~: (a) Waterfront property setbacks are established in all zoning districts, other than RS-200, RS-100, RS-7b, IiS-b0, RM-8, and RM-12 (required of RM-8 and RM-12 when built as apartments). ~~ (b) Open space requirements on waterfront property: (1) Definitions: a. Note: In some cases property may have frontage on the water but may not also abut a public right-of-way parallel to the waterfront; thus it does not afford the public an opportunity to be in a position to see the waterfront through the subject property and is not eligible for the bonus provisions of added height. b. Narrow parcel: That upland property which is two hundred ninety-five (29b) feet wide or less (mean width) measured parallel to the roadway (which public roadway is generally parallel to waterfront). See drawing. c. Wide parcel: That upland property which is greater than three hundred thirty (330) feet wide.(mean width) measured parallel to the roadway (which public roadway is generally parallel to waterfront). See drawing. d. Overlap of structures: Any dimension of one building which is visually blocked by another building, when viewed from a public street looking in a perpendicular direction toward the waterfront (all on one parcel of ownership). e. Transition dimension: That mean width dimension which is two hundred ninety-siz (296) feet to three hundred twenty-nine (329) feet inclusive within which transitional standards between the wide and the narrow parcel shall prevail. See drawing. (2) General criteria: a. Any parcel of waterfront property shall conform to the waterfront setback requirements for the total parcel if the parcel has fifty (b0) per cent or more street frontage generally parallel to the waterfront; waterfront properties with less than fifty (b0) .per cent street frontage generally parallel to the waterfront shall meet partial application requirement fos that portion of the property which has such parallel street frontage, i.e., one-fourth of tract street frontage, one-fourth of total application of total tract requirement. See drawing. b. Mazimum length of building: Two hundred fifty (2b0) feet. This includes all deck areas and enclosed and covered walks. c. Minimum distance between buildings (interior of lot): (1) Measured parallel to street (as described above). (2) No overlap permitted which would obstruct beyond a two hundred fifty (260) buildable length. For low rise: (defined as one (1), two (2) and three (3) story structures): One-half of total heights but nq.less than twenty (20) feet. Transitional standards: On property that is between two hundred ninety-six \,:~ ~ (296) feet and three hundred twenty-nine (329) feet in mean width, the side yard setbacks shall be as per the mean or mid-dimensions between the lesser and the greater setbacks as per this section under narrow and wide parcels. (3) Specific setback criteria a. Narrow parcel: 1. Front yard: Street side, per zone classification. 2. Side yard*: Twenty (20) per cent or thirty (30) feet, whichever is the lesser (no less than ten (10) feet). i. At one hundred fifty (150) foot width or greater a variation would allow twenty (20) feet on one side and forty (40) feet on the other. ii. At sixty (60) foot height of structure, RM-28 setback would prevail. b. Wide parcel: 1. Front yard: Per zone classification. 2. Side yarn*: i. Street sector: Thirty (30) per cent depth**; thirty (30) per cent of mean width or RM-28 per side, whichever is greater: ii. Interior sector: -Forty (40) per cent depth; twenty (20) per cent of` ~t ineanwdtli`or-RM-28 per side, whichever is greater: iii. Waterfront sector: Thirty (30) per cent depth; same as street sectof (see fold-out sheet). c. Waterfront: ' 1. Fifty (50) feet Gulf of Mexico and Tampa Bay, from mean high tide; except where the coastal construction control line (CCCL) established pursuant to § 161.053, F.S., applies to the property in question, in which case the minimum required setback shall be as set forth in paragraph g. below. 2. Twenty-five (25) feet Clearwater Harbor and Cooper's Bayou, from mean high tide. d. Affected waterfront property exceptions: 1. On defined narrow parcels, exceptions: Twenty (20) per cent increase in height but not density in residential or floor area in nonresidential usage as permitted. (Only half of the above bonus is applicable when the parcel has only one side lot (boundary) line extending, approximately at right angles, from public street to water's edge.) (A corner lot shall be considered to have only one side; therefore, it shall only be eligible for ( .j half bonus.) v 2. On defined transitional parcels, ezceptions: Fifteen (15) pes cent increase ~ in height but not density in residential or floor area in nonresidential usage as permitted. (Only half of the above bonus is applicable when the parcel has only one aide lot (boundary) line extending approximately at right angles, from public street to water's edge.) (A corner lot shall be considered to have only one side; therefore, it shall only be eligible for half bonus.) 4. No additional building height will be permitted under this section where the zoning district has already provided for an adjustment of increased building height based on the grade level being devoted in part to off-street parking. e. Clear space requirement: Only one side yard setback can be used for parking; the other side yard setback to be clear apace from street to water, such clear space may be used for driveways or parking below street grade. For wide parcel aide yard setback requirements, a variation would allow meeting narrow parcel aide yard standards, provided the additional setback differential is placed in spacing between buildings on site and parallel to street. However, the clear apace, as one continuous apace must be twenty (20) per cent of the width of the property. If a aide yard has parking in plan of which the finished elevation (grade) is a minimum of three (3) feet below the lowest point of the gutter or edge of pavement adjoining and such drainage is approved by the city engineer, then such parking area (open space) may be considered for meeting the clear space requirement. Shrubs and berme within the clear space area (cone of vision) shall not exceed thirty (30) inches in height. f. Property which is fronting on the water but does not abut a public right-of-way road (approzimately parallel to the waterfront) thus not affording the public an opportunity for public view, shall not be eligible for any height bonus provisions. g. Coastal construction control line: 1. Purpose. It is the purpose of this requirement to establish the coastal construction control line (CCCL), established pursuant to ~ 161.053, F.S., within the city as the point of reference from which all structural and building setbacks will be measured for those properties adjacent to the Gulf of Mexico which are traversed by said CCCL. The objective of determining required structural and building setback from this point of reference is consistent with the purposes of the state requirements $upp. Na 12 1164 ~'. BUILDING AND ZONING REGULATIONS 4 131.200 t- ~ pertaining to the establishment and jurisdiction of such coastal con- struction control line and, in addition, is designed to protect the safety, ~ economic; environmental, recreational and community appearance ob- ~: ~ .• • jectives of the city. 2. Interpretation. Nothing herein contained shall be construed to conflict with, supersede, or otherwise obviate the authority of the state relative to establishing the location or relocation of the coastal construction control line or any waiver or variance to the requirements relative thereto pursuant to ch. 61, F.S., or the requirements and authority of the city pursuant to chapter 39 of the Standard Building Code, chapter 133, section 133.01 of the City Code of Ordinances. In particular this section shall be applied in the following manner: i. No authority or action by the state under ch. 161, F.S., shall waive the requirement to comply with the city setback requirements as set forth hereunder without corresponding city authorization in accord with the process therefor. ii. Nothing .contained herein shall waive the required construction setback as set forth under section 3906.2(a)2 and (b)3 of chapter 39 of the Standard Building Code where said requirements are appli- cable and have not otherwise been waived or varied pursuant to the ~``~ applicable process therefor. `~_' ' iii. Any appeal from the setback requirements relative to the coastal construction control line provided for in xhis section shall be in ac- cord with that process and based upon the criteria elsewhere set forth in the zoning ordinance for appeal under the variance process to the board of adjustment and appeal on zoning and, subsequently, the hearing officer if appealed from a decision of the board. iv. The setback provisions contained in this amendment shall not pre- clude the initiation and completion of buildings authorized under a certified site plan as long as the certification remains valid and in force pursuant to the time constraints contained in the conditions of • certification. This shall not however exempt such buildings, once completed, from the applicable nonconforming structure provisions of the zoning ordinance. Should any dispute arise relating to the application of this paragraph, then such disputes shall be resolved pursuant to the procedure set out in section 131.416(c) of the Code of Ordinances. 3. Reservation. The city reserves the right, upon any comprehensive ad- justment, relocation or amendment of the coastal construction control ~ line or provisions applicable thereto by the state, to amend these set- back requirements as may be appropriate in accordance with the appli- cable requirements of law. 4. Required setback. The minimum structural and building setback from ' the coastal construction control line as said line exists on the effective • .~r Sapp. Na 12 1164.1 ~ v r'Ji § 131.200 CLEARWATER CODE date of this section, or as the location of said CCCL is subsequently amended, shall be as follows: i. For structures or buildings the height of which does not exceed thirty-two (32) feet, a minimum five-foot setback landward of the CCCL shall be required; - ii. For structures or buildings in excess of thirty-two (32) feet in height, the minimum required setback shall be five (5) feet plus one foot for each four (4) feet of total structure or building height, such setback to be measured landward of the CCCL. iii. The required setback set forth in i. and ii., above, shall not apply to an open, unenclosed wood, concrete or similar deck, patio or board- walk which may be constructed to, but not seaward of, the CCCL. Such deck, patio or boardwalk shall not be elevated more than eighteen (18) inches above normal ground level and shall not be enclosed or roofed. Any request for relief from this provision for extension seaward of the CCCL shall be according to the otherwise applicable. variance process. (Code 1962, App. A, § 30.07; Ord. No. 2360, § 2, 5-7-81; Ord. No. 3075, § 2, 6-16-83) Sec. 151.201. Model Dome. An occupied residence or an unoccupied dwelling unit may be used as a model home, condominium or apartment by any person in any RS-200, RS-100, RS-?b, RS-60, 13.5-50, RM-8, RM-12, RM-16, RM-20, RM-24 and RM-28 district, provided that: o~~~~.aQ~ (1) Such dwelling unit occupies a lot in a subdivision plat or is part of an approved site plan which was recorded orycertified not more than three (3) years prior to the date of application for use as a model dwelling unit. (2) The use of such structure as a model or demonstration home shall be limited to a period of twelve (12) consecutive months from the date. of certificate of occupancy; except that such use may be extended for one additional consecutive period of twelve (12) months upon due cause being shown, at the discretion of the building director. (3) The use of such model as a sales office shall be terminated when the phase of the project to which the sales office relates is seventy-five (75) per cent sold or at the expiration of twelve (12) months from the date of certificate of occupancy or such extension as may have been authorized, whichever occurs first.
