On September 16, 1982, the City Commission approved the revalidation of
the site plan for Clear Bay Terrace subject to the following conditions:
1. Prior to issuance of the initial building permit, granting of
access and utility easements as shown on the plan and granting.
of drainage easements and utility easements over water mains and
hydrants as required;
Z. Dedication of right-of-way for Pineland Drive prior to the issu-
ance of the initial building permit;
3. Payment of parkland dedication fee prior to the issuance of the
initial building permit;
4. Construction of Betty Lane by VOA and acceptance by the City
prior to the issuance of certificates of occupancy;
5. A transfer of density of 1.84 units from the 0.23 acre parcel
west of Pineland Drive to the larger tract east of Pineland Drive
and covenants be executed to run with the land reflecting the,
transfer of density;
6. A water main be installed and tied from Mary L. Road to Sunset
Point Road per City standards prior to issuance of Certificates
of Occupancy; and
7. The requisite initial building permit(s) be issued no later than
March 4, 1983 and all requisite certificate(s) of occupancy be
issued within two (2) years from the date of issuance of the ini-
tial building permit..
On September 23, 1983, the Board of Adjustment and'Appeal on Zoning approved
variances to allow for a 3-story building height, individual unit size of
637 square feet and a permeabie area for parking 39 vehicles in lieu of
providing 39 of the required parking spaces in paved area. These are the
same variances approved by the BAA on February 11, 1982 and which have been
incorporated into the revalidated site plan.
Please attach this memo to the site plan certified by the City Clerk on
August 4, 1982 to serve as notice of the extended time period to March 4,
1983 for issuing an initial building permit.

Commissioner Calderbank moved to approve the proposed text changes
and Lo dir~et the City Attorney to include in an ordinance. Motion was
duly seconded. There were no citizen cocments. Motion carried
unaniaously.

The Junior League wishes to purchase the site at Lhe end of a proposed
one-year lease. The City has no present need for the property and the
recommendation is to declare the property surplus.
Commissioner Garvey moved to declare as surplus to City needs, the
property and to lease the property, preparatory to sale to the proposed
lessee; .to approve a one-year lease with a one dollar per year rental
fee with the J~ior League of Clearwater, Inc.; and that the appropriate
of°icials be authorized to execute same. There were no citizen comments.

The present lessee has leased the property since 1972. Commissioner
uGarvey moved to declare the property surplus to City needs at this time
and approve a txo-year lease with ?eerless Florida Company, Inc. at.a
rental of $110 a month plus tax, and that the appropriate officials be
authorized to execute same. Motion was duly seconded. There were no
citizen comments. Motion carried unanimously.

Commissioner Calderbank moved to pass and adopt Resolution 482-69
and that the appropriate officials be authorized to execute same. Motion

"TEM 410 - Site Plan Amendment - Clear Bav Terrace, a portion o:` Mir 12
in the SE_ of Section 3-29-15; located on the W side of Betty Lane at
the 'l41 intersection of Sandy Lane and S of Sunset ?pint Road (Clearwater
Volunteers of America Elderly 'ousing, Inc.) PSP-82-9.
The site plan was approved in March 1982 subject to seven conditions.
Condition No. L states, "Construction of Betty Lane by HUD and accepted
by the City prior to the issuance of building permits." The condition
is erroneous on two counts: first, the construction of Betty Lane will be
accomplished by the Volunteers of America, Inc. (VOA) with financial
assistance from the City; and second, the witholding of building permits
peed =ng road construction is punitive and unusual.
Commissioner Calderbank moved to amend Condition No. %~ as follows:
"Construction of 3etty Lane by VOA and acceptance 5y the City prior
to the issuance of certificates of occupancy." Motion was duly seconded
and carried unanimously.

~ane and south of Sunset Point Road.
The Commissior, had approved an allocation of E81,000 to provide
support for VOA ir. the developaent of assisted housing for the elderly
in the form of off-site street, sexer, and water improvements. The
Clearwater 9ousirg Authority is also developing an assisted family housing
developzent project directly Lo the north of the VOA project. The
City and the duthority have entered into an agreement for the design and
construction of the eight-inch water line at a cost not to exceed $17,000.
