Both sewer and water lines are available in front of the property rights-of-way to provide the needed services. Assessed value of the property is $3,095,800 .00. Yearly taxes paid amount to $68,661.13. • The applicant is proposing to construct 644 apartment units. The applicant also proposes to change the existing land use plan classifications of Residential Low Medium, Commercial General and Residential and Office General to Residential Medium in order to bring the proposed development under one category of use and to meet the required density. The subject site is currently zoned for mixture of uses under the County Zoning District including residential, commercial and residential/office general. • The MPD district is to provide an alternative method of land development in this neighborhood for the purpose of accommodating a comprehensively planned and phased project which the proposed development will entail. All land assigned the proposed zoning district requires a Concept Plan to be approved by the City Commission. The Concept Plan is attached. It includes the conceptual layout for the apartment buildings, perimeter landscaping buffers for the entire site. • Twenty-five (25) acres or more are required to establish a new Master Planned Development district. This requirement is met by the application. Because this site exceeds 25 acres in area, the City Commission will approve the Concept Plan and refer the associated site plan simultaneously with this request. We had a telephone discussion regarding this matter on January 23, 1998. You indicated to me at the time that this is a valid interpretation of"'The Rules". By G.G. RIGSBY Times Stall Writer CLEARWATER -Ina $55-million project, an Odessa developer is planning to build 644 luxury apartments on 62 vacant acres where Bellea~r Road ends at Tampa Bay. Interphase Engineering has been talking with Clearwater about the project for several months, said Stephen L. Doh- erty, the city's central permitting supervi- sor. The estimated market value of the land and buildings would be $5Smillion, said Chris Scherer, president of Allen's Creek Properties, which owns the. land. Scherer, whohas offwned the land for'15 or the company more years. He said his brother, Kevin Scherer, runs Interphase Engineering, which is handling the design, engineering and con- struction ofthe project. Chris Scherer said his family has built houses and office buildings in Pasco County. The plans call for the apartment com- plex to have 23 buildings with 28 units each and four floors of living space over garages, Scherer said. The apartments do not ':yet have a formal name, Scherer said. They are be- ing called Allen's Creek Apartments on city documents. ~ ' ; He said the property already has a 60-slip marina. Each umt v~nll have sunken living rooms and a view of the bay. Scherer said the one- to three-bed- room apartments will rent for about $900 to $1,600 per month. ' Doherty estimated the annexation and zoning would take about nine months. The developers must submit plans for a master planned development and do traf- fic studies to determine the project's im- pact. Doherty said he sees no reason why the complex could not be built. Acceptance of such plans shall precede the execution of this Agreement by the City and any / , / -- construction on this property shall comply with the Fire District - requirements as set forth in Chapter Three (3), Standard Building Code, as duly adopted by the City of Clearwater; ~`- (e) all property proposed to be subdivided or otherwise differentiated from the original parcel described in this Agreement shall be treated as a single parcel for the `~ purposes of the subsequent annexation procedure, individual ownership notwithstanding; (f) that the terms and provisions of this Agreement shall be binding upon its successors and assigns, and the City shall record this document; (g) that the terms and provisions of this Agreement shall be a commitment and obligation which shall not only bind the present owner of said described real property, but shall be a covenant which shall run with the land and shall bind and be enforceable against all subsequent owners of said described real property whether or not it is mentioned in the Deed to said owners; and (h) if the Owner or its successors, or assigns, or any subsequent owner, shall default in the performance of the terms and provisions of this Agreement, and the City shall institute legal proceedings to enforce the terms and provisions hereof, the Owner, its successors and assigns, covenant and agree to pay all costs of such proceedings including the payment of a reasonable attorney's fee in connection therewith. 3.
