the original building height of 38 floors is requested with the alley vacation granted by the City

This letter is sent pursuant to our telephone conversation of last week and
my meetings with Scott Shuford, Pam Akin, and Leslie Dougall-Sides. Our client,
Haag Land & Building Development, Inc. ("the Developer") is requesting to appear
before the City's Development Review Committee ("DRC'~ at the Apri124, 1997
DRC meeting to discuss a necessary adjustment in the time frames for obtaining a
building permit and ultimately a certificate of occupancy for the approved site plan
for the Rome Tower project. We understand that the meeting begins at 9:00 a.m. in
the conference room at your offices.
Enclosed with this letter is a check for $150.00 made payable to The City of
Clearwater and 12 copies of the Rome Tower site plan which has been revised to
reflect the now approved alley vacation. We are requesting that the time for
obtaining a building permit be modified to reflect a deadline of November 1, 1998.
The reasons for our request are as follows:
When the Rome Tower site plan was certified by the City in 1996, all parties
were acting under the belief that the alley vacation would be completed quickly,
clearing the path ~r the design of the project. As reflected by the conditions on the
site plan, the alley vacation was a critical step in the site design process. Despite
efforts by both the City and the Developer, the alley vacation was not completed
quickly, but, in fact, took over eleven months from the date that the site plan was
certified by the City. The mutual mistake in the timing of the alley vacation has
frustrated the original design time frame and the actual timing should be reflected
in a modification to the time frame to obtain a building permit, indicated on the site
plan. Until the Developer knew that the alley vacation was to be accomplished, it

was not reasonable for the Developer to begin the very ez~ensive process of actually
designing the building.
Additionally, while Section 43.03 of the City of Clearwater Code provides
that site plans be approved with an identified time frame, no specific time frames
are established by the Code. Without such specific time frames in the Code, the
time frame applied should be a reasonable one, based on the type of development
and the complexity of the issues. The time frame applied to the Rome Tower site
plan should have been longer than the typical time frame, given the size of the
building and the number and complexity of the design and site concerns.
Therefore, we are requesting that the time frame be modified to reflect a more
reasonable and realistic design and permitting time frame.
As you are probably aware, to date the Developer has spent a great deal of
time and money on this project, based on information from the City on what needed
to be done to develop the project. The Developer has been proceeding in good faith
on this project for over two years and has made substantial progress. We will show
in detail at the DRC meeting the substantial progress made on this project to date.
The modification of the permitting time frame is needed to complete these
requirements.
Please let me know as soon as possible if any additional information will be
required prior to the meeting. Thank you for your assistance.
