IMMEDIATE VICINITY: The property is located across the street from the Beach. The
immediate vicinity is devoted to tourist uses.

ANALYSIS
The applicant is proposing to redevelop three parcels of land in order to establish a Red Roof Inn. The
northernmost parcel contains a 52-unit hotel with a manager's apartment. The southernmost parcel contains a 16-
unit motel. The middle parcel contains a laundromat but has the development potential to have 5 hotel units. The
applicant is entitled to 40 hotel rooms per acre. The maximum number of rooms that may be developed on the entire
site, pursuant to Section 2-801.1 of the Community Development Code, is 48 rooms. Therefore, the site is
nonconforming regarding density. The applicant proposes to demolish the southernmost hotel and the laundromat
and construct nineteen new hotel rooms on top of the remaining hotel. The applicant is requesting to terminate the
status of nonconformity and to be recognized as a conforming use with a density of 73 hotel rooms and one
manager's apartment.
The termination of the status of nonconformity entitles the property owner to continue and to expand as a lawfully
existing use subsequent to Level 2 Community Development Board approval. In order to obtain approval, the
property owner must improve the property according to the following requirements:
1. Perimeter buffers conforming to the requirements of Section 3-1202(C) shall be installed.
2. Off-street parking lots shall be improved to meet the landscaping standards established in Section 3-
1202(-).
3. Any nonconforming sign, outdoor lighting or other accessory structure or accessory use located on the lot
shall be terminated, removed or brought into conformity with this Development Code.
Following is an analysis of the applicant's compliance with the requirements:
1. Perimeter buffers conforming to the requirements of Section 3-1202(C) shall be installed.
Pursuant to Section 3-1202 C. of the Community Development Code, perimeter buffers are not required of
developments located in the Tourist District. The applicant, however, has submitted a landscape plan
showing extensive perimeter buffering along Gulfview Boulevard. The landscaping exceeds the
requirements for perimeter buffering and provides palms and flowering trees, shrubs and groundcovers.
It is a creative and colorful landscape plan including lilies, irises and oleanders. Staff recommends that
the applicant substitute sabal palms for. the proposed Washingtonian palms to compliment the other
recently approved landscapings along Gulfview Boulevard.
2. Off-street parking lots shall be improved to meet the landscaping standards established in Section 3-
1202(-).
Section 3-1202 D. requires that the applicant devote areas equal to 10% of the gross vehicular use areas
to landscaping. The applicant is proposing to exceed the requirements by devoting 11.9% of the vehicular
use area to landscaping. Thirteen live oaks and twelve crape myrtles will be planted in the landscaped
islands and surrounding the parking lot. The code requires that the live oaks be 12 feet high with a four
inch caliper. The landscape plan proposed only ten foot high oaks with 3 inch calipers. The applicant
must amend the site plan to reflect this requirement prior to submitting plans for the Community Devel-
opment Board Meeting.
3. Any nonconforming sign, outdoor lighting or other accessory structure or accessory use located on
the lot shall be terminated, removed or brought into conformity with this Development Code.

The applicant has submitted a statement on the application form stating that all signage, lighting and ac-
cessories will be terminated, removed or brought into conformity with the regulations. The applicant has
not proposed any new lighting or signage at this time but is aware of the requirements governing these
two items.
When the applicant submits building permit applications for signage and/or lighting, the application will
have to be in compliance with the current regulations.
SUMMARY AND RECOMMENDATIONS:
The application and supporting materials were reviewed by the Development Review Committee on July 15, 1999.
Based on the on the application, the proposal is in compliance with the criteria for termination of the status of
nonconformity. Therefore, the staff and the Development Review Committee recommend a roval of the
application for the Aegean Sands Hotel located at 421 S. Gulfview Blvd.

CRITERIA FOR TERMINATION OF STATUS AS A NONCONFORMITY:
1. A nonconforming use or structure may be deemed to be in conformity with this Development
Code, and may thereafter be allowed to continue and to expand as a lawfully existing use or
structure, if such use or structure is granted Level Two Approval in accordance with the
provisions of this Section.
2. A Level Two Approval shall not be granted to terminate status as a nonconforming use or
structure unless the nonconformity is improved according to the following requirements:
a. Perimeter buffers conforming to the requirements of Section 3-1202(C) shall be
installed.

ANALYSIS
The applicant is proposing to redevelop three parcels of land in order to establish a Red Roof Inn. The northernmost
parcel contains a 52-unit hotel with a manager's apartment. The southernmost parcel contains a 16-unit motel. The
middle parcel contains a laundromat and has the development potential to have 5 hotel units. At the present time,
much of the parking for the three existing businesses is located on the rights-of-way of both Gulfview and Coronado
streets.
The applicant is entitled to 40 hotel rooms per acre in accordance with the Resort Facilities High plan category and
the Tourist zoning district. The maximum number of rooms that may be developed on the entire site, pursuant to
Section 2-801.1 of the Community Development Code, is 48 rooms. Therefore, the existing site, with 68 hotel
rooms, a manager's apartment and a laundromat, is nonconforming regarding density/floor area. The applicant
proposes to demolish the southernmost hotel and the laundromat and construct twenty-one new hotel rooms on top
of the remaining hotel and to construct a parking lot to the south of the building. The applicant is requesting to
terminate the status of nonconformity and to be recognized as a conforming use with a density of 73 hotel rooms
and one manager's apartment.
The termination of the status of nonconformity entitles the property owner to continue and to expand as a lawfully
existing use subsequent to Level 2 Community Development Board approval. In order to obtain approval, the
property owner must improve the property according to the following requirements:
Perimeter buffers conforming to the requirements of Section 3-1202(C) shall be installed.
2. Off-street parking lots shall be improved to meet the landscaping standards established in Section 3-

Any nonconforming sign, outdoor lighting or other accessory structure or accessory use located on the lot
shall be terminated, removed or brought into conformity with this Development Code.
Following is an analysis of the applicant's compliance with the requirements:
1. Perimeter buffers conforming to the requirements of Section 3-1202(C) shall be installed.
Pursuant to Section 3-1202 C. of the Community Development Code, perimeter buffers are not required of
developments located in the Tourist District. The applicant, however, has submitted a landscape plan
showing extensive perimeter buffering along Gulfview Boulevard. The landscaping exceeds the
requirements for perimeter buffering and provides palms and flowering trees, shrubs and groundcovers.
It is a creative and colorful landscape plan that includes lilies, irises and oleanders. The landscaping will
enhance the look of Gulfview Boulevard. Staff recommends that the applicant substitute sabal palms for
the proposed Washingtonian palms to compliment the other recently approved landscaping along
Gulfview Boulevard.
2. Off-street parking lots shall be improved to meet the landscaping standards established in Section 3-
1202(-).
Section 3-1202 D. requires that the applicant landscape areas equal to 10% of the gross vehicular use ar-
eas. The applicant is proposing to exceed the requirements by devoting 11.9% of the vehicular use area to
landscaping. Thirteen live oaks and twelve crape myrtles will be planted in the landscaped islands and
surrounding the parking lot. The code requires that the live oaks be 12 feet high with a four inch caliper.
The landscape plan proposed only ten foot high oaks with 3 inch calipers. The site plan will require

amendment to reflect this requirement prior to the issuance of a building permit.
3. Any nonconforming sign, outdoor lighting or other accessory structure or accessory use located on

The applicant has submitted a statement on the application form noting that all signage, lighting and ac-
cessories will be terminated, removed or brought into conformity with the regulations. The applicant has
not proposed any new lighting or signage at this time but is aware of the requirements governing these
two items.
When the applicant submits building permit applications for signage and/or lighting, the application will
be in compliance with the current regulations.
SUMMARY AND RECOMMENDATIONS:
The redevelopment of this site will significantly enhance this portion of Clearwater Beach and will result in the
upgrading of both the facilities and the physical environment. The reuse of the existing units in another location
and the conversion of the laundromat to allow five additional units can be supported on site.
The application and supporting materials were reviewed by the Development Review Committee on July 15, 1999.
Based on the on the application, the proposal is in compliance with the criteria for termination of the status of
nonconformity. Therefore, the staff and the Development Review Committee recommend approval of the
application for the Aegean Sands Hotel located at 421 S. Gulfview Blvd. with the following conditions:
• The applicant shall substitute cabal palms for the proposed Washingtonian palms to compliment other recently
approved landscaping along Gulfview Boulevard.
• The applicant shall amend the site plan to reflect plant materials and sizes required by the Code prior to the
issuance of a building permit.

This letter constitutes a Development Order pursuant to Section 4-206 D.7 of the
Community Development Code.
On August 17, 1999 the Community Development Board reviewed the application for
Level 2 flexible development approval to terminate the status as a nonconformity on Lots
76, 77,124, 125, 126, 128, 129 and a part of lots 75, 123, 127 of Lloyd-White-Skinner
subdivision located at 421 S. Gulfview Blvd.
Based on the application and the staff report, the Board found that the proposal is in
compliance with the standards and criteria for Flexible Development approval, the
maximum development potential standards and all other applicable standards of the
Community Development Code. The Community Development Board granted approval of
the application to terminate the status as a nonconformity in order to allow the renovation
of the Aegean Sands Hotel at 421 S. Gulfview Blvd. with the following two conditions:
The applicant shall substitute sabal palms for the proposed Washingtonian palms to
compliment other recently approved landscaping along Gulfview Boulevard.

year of August 17, 1999 and all required certificates of occupancy shall be obtained within

ANALYSIS
•
The applicant is proposing to redevelop three parcels of land in order to establish a Red Roof Inn. The northernmost
parcel contains a 52-unit hotel with a manager's apartment. The southernmost parcel contains a 16-unit motel. The
middle parcel contains a laundromat and has the development potential to have 5 hotel units. At the present time,
much of the parking for the three existing businesses is located on the rights-of-way of both Gulfview and Coronado
streets.
The applicant is entitled to 40 hotel rooms per acre in accordance with the Resort Facilities High plan category and
the Tourist zoning district. The maximum number of rooms that may be developed on the entire site, pursuant to
Section 2-801.1 of the Community Development Code, is 48 rooms. Therefore, the existing site, with 68 hotel
rooms, a manager's apartment and a laundromat, is nonconforming regarding density/floor area. The applicant
proposes to demolish the southernmost hotel and the laundromat and construct twenty-one new hotel rooms on top
of the remaining hotel and to construct a parking lot to the south of the building. The applicant is requesting to
terminate the status of nonconformity and to be recognized as a conforming use with a density of 73 hotel rooms
and one manager's apartment.
The termination of the status of nonconformity entitles the property owner to continue and to expand as a lawfully
existing use subsequent to Level 2 Community Development Board approval. In order to obtain approval, the
property owner must improve the property according to the following requirements:
Perimeter buffers conforming to the requirements of Section 3-1202(C) shall be installed.
Off-street parking lots shall be improved to meet the landscaping standards established in Section 3-
1202(D).
Any nonconforming sign, outdoor lighting or other accessory structure or accessory use located on the lot
shall be terminated, removed or brought into conformity with this Development Code.
Following is an analysis of the applicant's compliance with the requirements:
Perimeter buffers conforming to the requirements of Section 3-1202(C) shall be installed.
Pursuant to Section 3-1202 C. of the Community Development Code, perimeter buffers are not required of
developments located in the Tourist District. The applicant, however, has submitted a landscape plan
showing extensive perimeter buffering along Gulfview Boulevard. The landscaping exceeds the
requirements for perimeter buffering and provides palms and flowering trees, shrubs and groundcovers.
It is a creative and colorful landscape plan that includes lilies, irises and oleanders. The landscaping will
enhance the look of Gulfview Boulevard. Staff recommends that the applicant substitute sabal palms for
the proposed Washingtonian palms to compliment the other recently approved landscaping along
Gulfview Boulevard.
2. Off-street parking lots shall be improved to meet the landscaping standards established in Section 3-
1202(-).
Section 3-1202 D. requires that the applicant landscape areas equal to 10% of the gross vehicular use ar-
eas. The applicant is proposing to exceed the requirements by devoting 11.9% of the vehicular use area to
landscaping. Thirteen live oaks and twelve crape myrtles will be planted in the landscaped islands and
surrounding the parking lot. The code requires that the live oaks be 12 feet high with a four inch caliper.
The landscape plan proposed only ten foot high oaks with 3 inch calipers. The site plan will require

amendment to reflect this requirement prior to the issuance of a building permit.
3. Any nonconforming sign, outdoor lighting or other accessory structure or accessory use located on
the lot shall be terminated, removed or brought into conformity with this Development Code.
The applicant has submitted a statement on the application form noting that all signage, lighting and ac-
cessories will be terminated, removed or brought into conformity with the regulations. The applicant has
not proposed any new lighting or signage at this time but is aware of the requirements governing these
two items.
When the applicant submits building permit applications for signage and/or lighting, the application will
be in compliance with the current regulations.
SUMMARY AND RECOMMENDATIONS:
The redevelopment of this site will significantly enhance this portion of Clearwater Beach and will result in the
upgrading of both the facilities and the physical environment. The reuse of the existing units in another location
and the conversion of the Laundromat to allow five additional units can be supported on site.
The application and supporting materials were reviewed by the Development Review Corrunittee on July 15, 1999.
Based on the on the application, the proposal is in compliance with the criteria for termination of the status of
nonconformity. Therefore, the staff and the Development Review Committee recommend approval of the
application for the Aegean Sands Hotel located at 421 S. Gulfview Blvd. with the following conditions:
• The applicant shall substitute sabal palms for the proposed Washingtonian palms to compliment other recently .
approved landscaping along Gulfview Boulevard.
• The applicant shall amend the site plan to reflect plant materials and sizes required by the Code prior to the
issuance of a building permit.

First, I want to thank you very much for you, Y:ke and 3:b
taking your time to meet with us on the 15th reaative t: the above-
referenced proposal. I like to think maybe there is a solution
under the code. I am reminded of Ci ndi Hardin' s corsnent at the
Community Development Board meeting on Tuesday afternoon -- the
code is intended to provide compliance for almost any redevelop-
ment. I know you, and the code, are trying to encourage things to
be done, and when I went back and read the code, I think I have
found some support. In the first instance, let me set the problem
as I understood it:
1. We generally have a non-conforming property. In essence,
the starting point is that we have three (3) separate
developed properties, all acquired at separate times by
the present owner. We have a motel property, with
approximately 52 units if I recall; a small 16-unit motel
parcel, and a laun.dromat parcel. The combined total of
density, if you put all of these properties together as
they have been operated over the past several years, is
approximately 72 units.
2. Mr. Martin Cole has contracted to purchase these three
(3) properties, and proposes placing al-:1

landscaping, and would allow the property owner to remcve
all back-out parking along Gulfview and replace it with
significant landscaping.
3. In our meeting on the morning of June 15th, I under-
stood that there were three (3) problems presented under
§6-109(b). Initially, we did not think we could meet the
requirements of subparagraphs 1 and 2. Section 6-109 is
a provision that allows one to terminate status a nor..-
conformity if you seek and obtain Level 2 approval, but
Level 2 approval cannot be granted unless the non-
conformity is improved according to subparagraphs 1, 2
and 3. Since we are zoned Tourist, as we discussed at
the meeting, eubparagraph 1 expressly does not apply. If
this is the case, I believe.we can substantially comply
with subparagraph 2; and we can comply with subparagraph
3.
We should know by June 22nd if we can now comply with Section
6-109(b). If for any reason we cannot, I will let you know and see
if there is yet another way.
As always, thank you for your assistance and I shall look
forward to your prompt reply, reiterating that we have a very short
time frame to make this project work, if indeed it is going-to.

Dear Antonia:
First, I want to thank you very much for you, Yike and Bcb
taking your time to meet with us on the 15th relative t= tre above-
referenced proposal. I like to think maybe there is a solut:.c.n
under the code. I am reminded of Cind;. Hardin' s zo=. ent at
Community Development Board meeting on Tuesday afterrocn -- the
code is intended to provide compliance for almost any redevelop-
ment. I know you, and the code, are trying to encouracre things to
be done, and when I went back and read the code, I think I have
found some support. In the first instance, let me set the problem
as I understood it:
1. We generally have a non-conformir).g property. In essence,
the starting point is that we have three (3) separate
developed properties, all acquired at separate times by
the present owner. We have a motel property, with
approximately 52 units if I recall; a small 16-unit motel
parcel, and a laundromat parcel. The combined total of
density, if you put all of these properties together as
they have been operated over the past several years, is
approximately 72 units.
2. Mr. Martin Cole has contracted to purchase these three
(3; properties, and proposes placing al tee. 7

landscaping, and would allsw the property owner to remcve
all back-out parking along Gulfview and replace it with
significant landscaping.
3. In, our meeting on the morning of June 15th, I under-
stood that there were three (3) problems presented under
§6-109(b). Initially, we did not think we could meet the
requirements of subparagraphs 1 and 2. Section 6-109 is
a provision that allows one to terminate status a non-
conformity if you seek and obtain Level 2 approval, but
level 2 approval cannot be granted unless the non-
conformity is improved according to subparagraphs 1, 2
and 3. Since we are zoned Tourist, as we discussed at
the meeting, subparagraph 1 expressly does not apply. If
this is the case, I believe we can substantially comply
with subparagraph 2; and we can comply with subparagraph
3.
We should know by June 22nd if we can now comply with Section
6-109(b) . If for any reason we cannot, I will let you know and see
if there is yet another way.
As always, thank you for your assistance and I shall look
forward to your prompt reply, reiterating that we have a very short
time frame to make this project work, if indeed it is going to.
