The applicant is requesting approval to divide Lot 9, a previously platted lot, into two lots in order
to sell the north four (41 feet of the lot to the owner of adjacent Lot 8, who also owns Lots 1 thru
7 to the north. Lots 1 thru 8 and the north four (41 feet of Lot 9 are developed with a commercial
building, most recently housing the Merrill Lynch business office. Upon survey of the property, it was
found that the building encroaches a little less than four (4) feet onto Lot 9. Therefore, it is
requested that the lot be so divided in order to unencumber the property for title purposes for the two
separate owners. The owner of the southerly portion of Lot 9 also owns Lot 10 directly adjacent to
the south of Lot 9.
The property is zoned UC(C1, Urban Center Core, which has no minimum dimensional or numerical
requirements.
The members of the Development Review Committee have reviewed the request with no objections.
The code permits a lot division to be approved administratively by the City Manager provided certain
provisions are met (please refer to attached copy of Section 133.030 for these provisions).
Please forward this memo and attachments to the City Clerk for certification and distribution.
