The applicant is requesting approval to resubdivide lots 20 and 21, Glenwood Subdivision, to relocate the
common property line approximately 15 feet to the south. The existing lots are platted in Plat Book 8, Page 14.
The applicant owns both lots and wishes to sell one of the lots. The new lots configuration meets the minimum
lot requirement of 5000 ft2 per lot and minimum setback requirements for the RS 8 zoning district.
The Land Development Code permits a division to be approved administratively by the City Manager provided
certain provisions are met (please refer to attached copy of Section 133.030 for these provisions).
The members of the Development Review Committee have reviewed the request with no objections.

LAND DEVELOPMENT CODE § 133.030
(1) The public acquisition of strips of land for the widening of existing streets.
(2) The reversion, combination or recombination of portions of previously platted lots
where no new parcels or residual parcels are created which are smaller than any of
the original lots or less than the minimum lot area requirements as set forth in
chapter 135, "Zoning District Regulations."
(3) The transference of part of one lot or tract to an adjacent lot or tract provided such
transference neither reduces any lot or tract to an area or a width less than that
specified in chapter 135 nor condescends any other development regulation contained
in this development code. (Ord. No. 4035, § 2, 8-29-85)
Sec. 133.030. Administrative plat approval; condominium plats and lot divisions.
(a) Condominium plats. Before any condominium plat is filed of record in the office of the
clerk of the county court, a copy of the ground level survey drawing shall first be submitted to
the city engineer for determination that all requisite easements are properly delineated on
the plat, all streets are properly named without duplication, and the plat comports with other
engineering practices of the city.
(b) Lot divisions. Minor subdivision plat adjustments may be approved by the city man-
ager without the requirement to replat. It is the objective of this provision to enable a
simplified administrative process whereby owner's of previously platted property may further
divide such property according to the following process without filing an amended plat:
(1) The city manager is hereby authorized to review and approve or disapprove the
further division of platted property.
(2) Action by the city manager to approve or disapprove such division of platted property
shall be limited to the following:
a. Not more than two (2) new or previously platted tracts or lots are affected.
b. No new street or alley is proposed or additional right-of-way is needed.
c. No vacation or elimination of streets, alleys, setback lines, access control or
easements is required or proposed.
d. Such action will not result in significant increases in service requirements or
interfere with maintaining existing service levels.
e. All easement requirements have been or will be satisfied.
f. Such split will not result in a tract or lot without direct access to a street.
g. A nonconforming situation will not be created.
In granting approval, the city manager may impose such conditions and restrictions upon the
property as determined necessary to carry out the intent and purpose of this chapter and the
development code. The city manager may, at his discretion, require any division or combina-
tion of previously platted property to comply with the full platting process where the condi-
tions of the instant case warrant. (Ord. No. 4035, § 2, 8-29-85)
