Relocate the Sunset Point Road driveway 40' to the west (center line of driveway to center line of driveway) to avoid the overlap of an existing driveway to the east. .2. The proposed reverse curve concrete separator on Hercules Avenue must have a 500' radius instead of the 300' radius shown. McDonald's at Hercules and Sunset Pt Rd (PSP 96-06) 2. Morton Plant Witt Parking Lot - Jeffords & Druid Rd (PSP 96-04) Results of the discussions were: I. McDonald's At Hercules and Sunset Pt RD (PSP 96-06): The DRC requested that the site plan be returned for further review with the following comments/ conditions applicable: A. Before the Site Plan can be certified, the applicant must complete the following action(s): 1. Show the following on the site plan: a. The property owner's name, address and telephone number; and the designated project applicant or representative and authorization for such representation if other than the property owner. b. Direction and coverage of luminaries and other side-lighting. c. Minimum turning radii for designated drives and fire lanes as 42 feet on the plan. d. All striping, pavement markings, signage and traffic control devices on the site plan conforming to F.D.O.T. Standard Indices-1995 edition and F.A.C. 14-110 (no 4" striping is to be shown). e. MAIL RE: City of Clearwater Open Space Impact Fee, Code of Ordinances Sections 54.51-54.55 Dear Ms. Murphy, After receiving your letter of April 23, I have reviewed the City's Open Space Impact Fee Ordinance as well as supporting materials and revenue/expenditure logs, and have met with Ream Wilson, Parks and Recreation Director and Scott Shuford, Central Permitting Director, regarding the issues you raise. It is the City's position that its Ordinance was properly and legally enacted and has been applied in an appropriate manner. Therefore, the City intends to continue to impose open space impact fees upon development falling within the scope of the Ordinance. In response to specific points urged in your letter, City staff is of the opinion that imposition of the fee meets the "rational nexus" and "rough proportionality" tests enumerated in Dolan v. City of Tigard. Contrary to your assertion, moneys received from the open space assessment are used only for the acquisition of real property to be preserved as open space, and are not used to provide recreational facilities. A separate recreational impact fee is used for that purpose. The imposition of impact fees and similar assessments upon both residential and commercial properties is common in Florida and has a valid legal basis in that the impacts created by new development are not limited to residential development. The objective referred to in the Ordinance of implementation- of the City's comprehensive plan, recreation and open space element, is not precluded simply because the plan also contemplates commercial development. In addition, as to the particular development application for a McDonald's restaurant at the intersection of to • "Equal Employment and Affirmative Action Employer' b intersection of Hercules Avenue and Sunset Point Road, it appears that the applicant has already paid the assessed open space impact fees without protest. Before the Site Plan can be certified, the applicant must ` complete the following action(s): 1. Provide a draft cross-access easement/ agreement linking the MC Donald's site to the northern portion of lot 1 including wording only one access to the Northern portion of lot 1 will have only one access to Hercules Avenue. 2.
