that the 6 foot high solid buffer fence which you have agreed to erect along the east property line behind the Publix
area of the shopping center be installed as soon as possible.
As you stated in your December 11, 1990 letter that you would comply if immediate installation is necessary, we
would request that this now be done.

Dear Ms. Glatthorn:
Pursuant to our phone conversation and your letter of
December 6, 1990, Publix is in agreement to install a six foot
high solid wood fence. It will run the entire length of our
demised premises along the eastern boundary behind our store.
As we have taken several steps to be better neighbors to
she mobile home community behind our store, we would like to
request some tolerance in timing of installation. We have
changed our truck deliveries from 4:00 a.m. to 7:00 a.m. We
will also be installing a self-contained deodorized compactor
system when the new building area is ready to handle this. Our
relandscaping plans for the back area are scheduled for
February and March of 1991, and we would like to install this
fence at that time. We would appreciate whatever consideration
you could give to this request due to the fact that we are not
under any type of code violation without erecting this fence.
If, in your opinion, immediate installation is required,
please advise and we will be more than happy to comply.

As the property owners within the mobile home park directly adjacent to and on the east side of the above
referenced property are making complaints about the rear view of Publix not being especially aesthetically pleasing
and about other associated matters such as the smell from the trash containers (which we understand you are
currently trying to resolve), we request that a 6 foot high solid fence or wall be erected for buffering along the east
property line behind the Publix area of the shopping center.
As per our telephone conversation yesterday, I am writing this letter in order for you to take the matter to Mr.
Howard Jenkins at Publix for executive action. The City of Clearwater is hoping that you expeditiously respond
to us regarding this matter as these property owners are anxiously waiting for our findings.

Publix Store No. 96 Gulf to Bay and Belcher Revised Parking Plan
Dear Mr. Clarke:
Pursuant to our phone conversation on Friday, September 6, 1991, Boyle has prepared a new
site plan showing the following revised items:
1. A widened driving aisle in front of the Publix entrance.
2. Add a new driveway and revised parking layout at the southwest corner of the parking
lot.
3. Add three parking spaces in the green area to the south of the service station.
4. Add a sidewalk along the Publix storefront.
5. Add a sidewalk from the new driveway to the existing sidewalk along Belcher Road.
The required number of parking spaces of 432 is still met with the new parking layout and the
green area has been reduced to 52,758 sf which is 13.9% of the total site area. As we
discussed, a minimum green area of 13.7% of the site must be maintained since that was the
precentage of green area approved on the original design.
As requested, I have enclosed herewith twelve copies of the revised plan. Please review the
plan at your earliest convenience so that the new site, which is 90% complete, can be finished
in a timely manner. Thank you for your assistance in this matter.

This letter must be attached to and made part of the approved Utilities

the sweet(s) of the underdeveloped parcel(s) decides to Im-
prove his (their) property to the maximum permitted ?y law
at is able to effect as amendment of the Agreement with any
appropriate governmental agency which controlled the initial
development of the land, then in that-event both parties
berets agree that neither party will rotor to, utfllse or In-
clude any portion of the land of the other or the rights
created under this Instrument in connection with the further

the case say be. Insofar as striping, curbing. landscaping.

build or maintain. or permit to be built or maintained, any
structure on Its property that would prevent convenient
vehicular and pedestrian traffic flow solely across the
Easement Area. without first obtaining the written consent of
the other party, which consent shall not be unreasonably withhold.

to prevent the other from developing his respective property
to its highest economic potential; however, both parties recog-
alas the necessity of ertabltshing and maintaining free and easy
access to and from their respective properties across the Easement

to permit convenient vehicular and pedestriso traffic flow.
•S. MAINTENANCE. Capital and Federal. their successors
and assigns. agree to maintain and keep in good repair, so
as to paralt continuous use. both Parcel 01 and Parcel 12
parking and driveway areas. respectively, during the term
of this Agreement and shall keep the ease free and clear of all
trash. debris, rubbish and obstructions of all kind and shall
provide adequate drainage and lighting thereon.
Bach party or their respective successors shall maintain
at all tiaes during the texas hereof, insurance against claims
for personal or property damage. All such policies shall asst
both parties as insureds. Both parties agree to indemnify.
defend and hold the other harmless from and against any and
all loss. claims or liability as a result of not keeping such
a policy in full force and effect.

tlve properties to temporary or perpetual public use.
a. ARBITRATION. Roth parties agree that should any
dispute arise under this Agreement that cannot, after due dill-

solved by binding arbitration. Should any default occur
hereunder that sha11 continue for sore than thirty ()0) days
after receipt of written notice from the other party, then

licensed professional land planner who jointly will. In
turn. select a third professional land planner who shall be

of the three land planners shall prevail and both partied
agree to be bound thereby. The party against whom the dispute
to resolved shall pay all fees, charges. costs and expenses
of such arbitration. Including reasonable attorneys' fels.
9. GOVERNING LAM. The parties hereto a?;tee that the
lava of the State of Florida will govern the interpretation
of this Agreement and shall determlie the rights and obligations

The applicant has submitted a request for a Simple Adjustment for the Gulf-to=Bay Plaza/Publix #96 Site.Plan.
The change to the site plan encompasses internal vehicular circulation patterns. The most recent amendment
occurred on August 8, 1991 and the previous conditions are carried forward to read as follows:
3) Prior to the issuance of a building permit, permits for driveway closures must be obtained by
D.O.T. and the County.
5) Relocation and/or installation of detector checks, water and gas meters must be done by the City
at the owner/developer's expense.
7) Prior to a C. 0., dumpster and/or compactors must be visually screened. Gates must be provided
with a minimum 12 ft. clear opening to the front for access by Sanitation trucks.
4.1) Signs and fencing/walls shall be subject to separate review and permitting processes. If the new
Eckerd attached sign is an illegal sign, it shall be removed prior to certification of the final site
plan.
12) All requisite certificates of occupancy for the expansions/renovations to the shopping center must
be obtained by May 4, 1993.
I recommend that we approve this amendment as a simple adjustment to the Certified Site Plan for Gulf-to-Bay
Plaza/Publix #96.

The Development Review Committee at its meeting of May 23,1991 approved the above described Amendment
to the Certified Site Plan subject to the following conditions:
1) 1 If there is a legally binding agreement for parking/drives with site to the south, a copy must be provided
to the City and this must be indicated on the site plan. Resolution of this is subject to approval by the
Traffic Engineer and City Attorney, prior to certification.
2) 1 If the service station outparcel is owned or controlled by this shopping center property owner, then two

On December 14, 1989, the Development Review Committee approved the above referenced final site plan
subject to the following conditions:
1. If there is a legally binding agreement for parking/drives with site to the south, a copy must be provided
