The two proposed parcels are in accordance with the RS-8 district regulations and the existing house is not being made nonconforming by the lot division. The departments of Public Works, Traffic Engineering and Parks and Recreation have reviewed the request and have no objection on condition that the 5' drain- age and utility easement along the west side of the lot be increased to 101. According to Section 133.030 (b) (2) of the City's Land Development Code, action by the City Manager to approve or disapprove such division of platted property shall be limited to the following: a. Not more than two (2) new or previously platted tracts or lots are affected. b. No new street or alley is proposed or additional right-of-way is needed. c. No vacation or elimination of streets, alleys, setback lines, access control or easements is required or proposed. d. Such action will not result in significant increases in service requirements or interfere with maintaining existing service levels. e. All easement requirements have been or will be satisfied. f. Such split will not result in a tract or lot without direct access to a street. g. A nonconforming situation will not be created. As this request is in compliance with the seven limitations listed above, I recommend you approve i subject to the following condition: The 5' drainage and utility easement along the west side of the site be increased to 10-'.
