Dear Mr. Santos: This letter constitutes a Development Order pursuant to Section 4-206 D.7 of the Community Development Code. On July 20'h, 1999 the Community Development Board reviewed the application for Level 2 flexible development approval of a commercial infill project for a reconstruction of a McDonald's with front yard setbacks of 5.1' on Turner Street, 10' on Rogers Street and approval of a Comprehensive Landscape Program at 539 S. Missouri Avenue. Based on the application and the staff report, the Board finds that the proposal is in compliance with the standards and criteria for Flexible Development approval, the maximum development potential standards and all other applicable standards of the Community Development Code. The Community Development Board grants approval of the application for a commercial infill project at 539 S. Missouri Avenue. Pursuant to Section 4-407, an application for a building permit shall be made within one year of July 20'h, 1999 and all required certificates of occupancy shall be obtained within one year of the date of issuance of the date of the building permit. Time frames do not change with successive owners and the Community Development Board shall grant an extension of time for a period not to exceed one year and only within the original period of validity. Please remember that a building permit and impact fees will be required prior to the construction of the project.
