The City Commission approved the subdivision plat and RPD-2
zoning for Spottis Woode on November 1, 1979.
The owner of the lot addressed at 307 Spottis Woode Court is
requesting that the development plan be amended to reflect a six
foot high brick wall along the lot's southwesterly (rear)
boundary line. The wail, as proposed is consistent with all
otherwise applicable development regulations.
I recommend that the wall be approved as a minor n e If you
concur, please ini memoran um and forward the ten
attached copies of the plan to the City Clerk so that she may
certify it as a valid record of change and distribute it to the
appropriate departments.

As you may recall, in June of 1995, the brick wall of Spottis
Woodes was damaged as a result of a solid waste vehicular exiting
the subdivision. The attorney representing the Spottis Woodes
Homeowners Association is in the process of providing the City
with costs for repair or replacement of the brick wall. This
repair/replacement will be expensive.
The attorney has expressed concern also whether the City will
require revamping of the entrance to Spottis Woodes.
Although Risk Management does not have any direct involvement in
reconstruction of the entrance to Spottis Woodes, we do have a
concern about the City having to pay for damage to the brick wall
or security box located in the middle of the driveway should a
City truck hit the wall or the security box in the future.
The City is in the process of scheduling a claims committee
meeting to discuss payment of the claim. This memo is for the
purpose of making you aware of the problem with this brick wall
and entrance way and City trucks so that you will be in a
position to take whatever action you deem appropriate to avoid
future damage to the property of this Homeowner Association.
We have additional photos in our office should you wish to review
them.

FIRE PREVENTION
National Fire Protection Association and listed in
Annex A of the NFPA Fire Prevention Code and
being particularly the 1988 edition thereof, includ-
ing Appendix C of NFPA 30, referred to in this
article as the National Fire Codes. Such codes and
standards are hereby incorporated by reference
as fully as if set out at length in this section, and
the provisions thereof as they may be amended by
ordinance from time to time shall be controlling
within the fire control district. 1b the extent that
the county construction licensing board adopts any
subsequent editions of NFPA 101, Life Safety Code,
or any amendments thereto, then the edition so
adopted and any amendments thereto adopted by
the board shall be enforced in the city fire control
district.
(2) It shall be unlawful for any person to vio-
late the National Fire Codes, to permit or main-
tain such a violation, to refuse to obey any provi-
sion thereof, and to fail or refuse to comply with
any such provision or regulation except as varia-
tion may be allowed by the action of the fire mar-
shal in writing. Proof of such unlawful act or fail-
ure shall be deemed prima facie evidence that s.zch
act is that of the owner or other person in control
of the premises.
(3) The fire prevention division shall be respon-
sible for the enforcement of the National Fire
Codes. The city manager, after considering the
recommendation of the fire chief, shall designate
a fire official as fire marshal. The fire marshal
shall be the administrator of the fire prevention
division. The fire marshal shall inspect or cause to
be inspected on a periodic basis all buildings or
structures, and shall make such orders as may be
necessary for the enforcement of the National Fire
Codes and for safeguarding life and-property from
fire.

Sec. 17.33. Amendments.
The National Fire Codes, as published by the
National Fire Protection Association, 1988 edi-
tion, is amended as follows:
Section 1-7.2 of NFPA 1, concerning the permit-
ting of bonfires and outdoor rubbish fires, is
amended to include:
(1) Location restricted. No person shall kindle
or maintain any bonfire or outdoor rubbish

fire or authorize any such fire to be kindled
or maintained on any privately owned land
unless the location is not less than 50 feet
or some other distance approved by the fire
department from any structure, and ade-
quate provision is made to prevent fire from
spreading to any structure.
(2) Attendance of open fires. A bonfire or out-
door rubbish fire shall be constantly attend-
ed by a competent person until the fire is
extinguished. This person shall have a gar-
den hose connected to a water supply, or
other fire extinguishing equipment readily
available for use.
(3) Chief may prohibit. The chief of the fire de-
partment may prohibit any or all bonfires
and outdoor rubbish fires when atmospher-
ic conditions or local circumstances make
such fires hazardous or constitute a public
nuisance.
Section 3-1.1.10 of NFPA 1, concerning the re-
quired access for fire apparatus is amended to
read:
All nrem? ides that the fire department may be
called upon to protect in case of fire shall be
provided with suitable gates, access roads, and
fire lanes.
Fire lanes shall be at least 20 feet (6.1 meters)
in width with the road edge closest to the build-
ing at least ten feet (3.05 meters) from the build-
ing. Any dead-end road more than 600 feet (183
meters) long shall be provided with a turn-
around at the closed end at least 60 feet (18.3
meters) in diameter.
The designation, use, and maintenance of fire
lanes on private property shall be accomplished
as specified by the fire chief or fire marshal. It
shall be unlawful for any person to park motor
vehicles on or otherwise obstruct any fire lane.
Section 4-2.1 of NFPA 24, concerning the num-
ber and location of fire hydrants, is amended to
read:
Hydrants shall be provided in sufficient num-
ber and be located in a manner that will enable
the fire flow needed to be delivered through hose
lines about any important structure. The fire
flow needed and the hydrant location shall be

SUBJECT: REPAIR OF SPOTTIS WOOD ENTRANCE GATE AND WALL
DATE: June 23, 1995
Risk Management is currently working with the Homeowner's Association of Spottis
Wood for the repair of their entrance gate and wall. Risk Management has requested
that the Homeowner's Association take immediate action to remove the heavy steel
gate from the damaged wall and then proceed to get estimates, etc. for repair. As of
10:00 am this date, the gate had not been removed.
The wall was struck by a Solid Waste vehicle while the driver was trying to exit the
property through the outbound lane. The lane was so narrow and so dangerous that
the driver, in an effort to miss the access key pad, failed to see that he was striking the
gate post with the right rear portion of his vehicle. In the process of inquiring into the
accident, I discovered that, of necessity, it is standard procedure for Solid Waste
vehicles to exit the property through the entrance lane because the exit lane is too
narrow and too dangerous. Since that is the case, I have raised a question as to
whether or not Fire Department vehicles and other pieces of City equipment larger than
a standard Solid Waste rear end-loader could access the property safely in an
emergency.
Based upon the above circumstances I am requesting that, if the wall cannot be
repaired, and must be replaced or extensively rebuilt, that as part of the permitting
process, the gate and entrance way be widened and brought up to code so that both
service vehicles and emergency vehicle can enter and exit the property safely. The
situation now is such that entry and departure from the property is dangerous.
Please take the action necessary to require code compliance as part of the permitting
process if extensive rebuild or wall replacement is necessary. If I can discuss this
further or provide additional information, please let me know. I may be contacted at
