THIS AGREEMENT entered into this ,10 day of
between the City of Clearwater, Florida (hereinafter
City) and Neighborly Senior Services, Inc.
referred to as Provider) and provides as follows:
WHEREAS, the City has successfully applied for a community Services
Block Grant (CSBG) from the State of Florida, Department of community
Affairs to provide funds, inter alia, for the deLivery of 1,050 meals to
elderly persons meeting poverty level income guidelines through the existing
Meals on Wheels Program, and
WHEREAS, the City finds that this project is meritorious and fulfills
the purposes and policies of the community Services Block Grant program.
NOW THEREFORE, in consideration of the mutual covenants and agreements
hereinafter stated the parties hereto agree as follows:
1. The City shall provide to the Provider solely from its CSBG
funds the maximum sum of Two Thousand Two Hundred Ninety Nine Dollars,
and an additional sum, not to exceed Four Hundred Sixty One Dollars,
solely from the City General Fund, subject to and in accordance with
the provisions of this agreement and in express reliance on the warranty
of the Provider that such funds will be used exclusively for the delivery

roug the eX1st1ng Meals on Wheels Program at a cost of $2.63 per meal
and that all expenditures of said funds will be in accordance with the
provisions of the CSBG program, and all rules and regulations pertaining
thereto.
2. As funds are required by the Provider for the purposes provided
herein, the Provider may present to the City written requests for the
amounts so required. Each such request shall contain the certification
that all applicable laws, regulations, ordinances and guidelines have
been complied with in committing said funds.
3. The Provider hereby assures arrl certifies as a condition of
receipt of CSBG funds, that:
a. It will utilize CSBG funds to provide services and activities
having measurable and potentially major impact on causes of
poverty in the community and those areas of the community
where poverty is a particularly acute problem.
b. Funds will not be used for political activities and will
prohibit any activities to provide voters and prospective
voters with transportation to the polls or provide similiar
assistance in connection with an election or any voter registration
activity.
c. It will provide for coordination among antipoverty programs 1n
the community where appropriate, with emergency energy crisis
intervention programs under Title XXVI of the Low Income Home
Energy Assistance Act conducted in the community.
d. It possesses the sound fiscal control and fund accounting
procedures necessary to assure the proper disbursal of and
accounting for Federal funds received under the community
Services Block Grant.
e. It will permit and cooperate with Federal and State investiga-
tions designed to evaluate compliance with the law.
f. It will, in accordance with Florida statutes and Section
677 of public Law 97-35, comply with non-discrimination provisions.
g. It will comply with Section 680 of Public Law 97-35 which
prohibits use of CSBG funds for purchase or improvement of
land or the purchase, construction, or permanent improvement
(other than low-cost residential weatherization or other energy
related home repairs) of any building or other facility.
h. It will comply with the CSBG Administrative Rule which
provides that CSBG administrative expenses shall not exceed
a maximum of fifteen percent of the total CSBG funding.
4. All records pertaining to this project shall be retained by
the provider for such period as required by applicable laws and regulations
and may thereafter be destroyed only with the prior written approval
of the City. All records shall be available for audit by representatives

of the City, the Florida Department of Community Affairs, the Auditor
General and other agencies responsible for compliance with applicable
laws and regulations.
IN WITNESS WHEREOF, the City and the Provider have executed this
agreement as of the date first above written.
