MUNICIPAL CODE ENFORCEMENT BOARD MEETING MINUTES

The Chair called the meeting to order at 3:00 p.m. at City Hall, followed by the Pledge of
Allegiance.
To provide continuity for research, items are in agenda order although not
necessarily discussed in that order.
The Chair outlined the procedures and stated any aggrieved party may appeal a final
administrative order of the Municipal Code Enforcement Board to the Circuit Court of Pinellas
County within thirty days of the execution of the order. Florida Statute 286.0109 requires any
party appealing a decision of this Board to have a record of the proceedings.
2. PUBLIC HEARINGS
2.1 Case 37-10
James & Kristi Hazel

Public Health, Safety or Welfare Nuisance - Sullivan
James Hazel did not admit to the violation.
Inspector Scott Sullivan provided a PowerPoint presentation. A notice of violation was
issued on July 1, 2010, following the first inspection. Violations at 2024 Druid Road relate to a
hazardous tree on the southeast fence line. Falling branches from the tree could pose a
danger. Property photographs on September 21, 2010 showed that the tree had been removed
but debris from the tree remained in the yard.
James Hazel said the property was in foreclosure for almost two years. He has been
living out of town for the previous six months and only recently received the notice of violation.
He said he had the tree cut down on Monday and is almost done cleaning the property. He did
the work because he was the last owner of record. The foreclosure was finalized about one
month ago. He said he had been contacted by the Realtor who is listing the house for the bank
that now owns the property.

Discussion ensued regarding the property’s ownership with concerns expressed that Mr.
Hazel had acted in good faith but no longer owns the property nor has the power to cure the
violation.
Assistant City Attorney Camilo Soto recommended the item be continued for staff to
determine property ownership.
Member Van Weezel moved to continue Case 37-10 to October 27, 2010. The motion
was duly seconded and carried unanimously.

Member Avichouser moved to accept the Affidavits of Compliance for Cases 03-10, 07-
10, and 09-10 and to accept the Affidavits of Non-Compliance and issue the Orders imposing
fines for Cases 29-10 and 31-10. The motion was duly seconded and carried unanimously.

6. APPROVAL OF MINUTES -August 25, 2010
Member Cole moved to approve the minutes of the regular Municipal Code Enforcement
Board meeting of August 25, 2010, as corrected regarding the Chair and Vice Chair
designations. The motion was duly seconded and carried unanimously.
