SWORN STATEMENT OF PROJECT FINANCING
Pursuant to Section 6.02 of that certain Agreement for the Development of Property in
the City of Clearwater (Surf Style Condominium Project) between the City of Clearwater,
Florida (the "City") and L.O.M., Inc., a Florida corporation (the "Developer") dated as of
February 18, 2010 recorded February 22, 2010 in Official Records Book 16836, Page 1817 of
the Public Records of Pinellas County, Florida, as amended by First Amendment Agreement for
the Development of Property dated October 25, 2010 (the "Development Agreement"), Doron
Malinasky, as Vice President of the Developer hereby certifies to the City the following:
1. On the date hereof, the Developer has obtained from Branch Banking and Trust
Company, a North Carolina banking corporation (the "Project Lender") a construction loan in
the amount of $14,500,000.00 (the "Project Financing") secured, by among things, a first
mortgage on the Property, as defined in the Development Agreement.
2. The name and address of the Project Lender for purposes of any notices to
provided to the Project Lender by the City pursuant to Section 6.04 of the Development
Agreement is as follows:
