W I T N E S S E T H:
WHEREAS, the Owner now owns the following described real
property, located outside the municipal boundaries of the City of Clearwater
but within the City of Clearwater service area:
L?2 Block C, Kapok Terrace, according to map or plot thereof as
recorded in Plat Book 36, Pages 14 and 15 of the Public Records of
Pinellas County, Florida.

WHEREAS, the Owner desires to connect to the City sewer and/or
water main and is agreeable to signing an Agreement with the City for
municipal sewer and/or water 'services; and

WHEREAS, the City is agreeable to _'Furnishing said services upon
certain conditions and considerations;
NOW, THEREFORE, the parties hereto hereby covenant and agree
as follows:

1p The City does hereby agree to provide sewer and/or water
services, subject to the terms of this Agreement, and to permit the Owner
to connect to its sanitary sewer and/or water main at the Ownerts expense.

The City shall not be liable for any damage resulting from any unavoidable
cessation of service caused by Act of God, necessary maintenance work,
or any cause beyond the control of the City.
2. In consideration of the covenants contained in Paragraph 1, im-
mediately above, on the part of the City, the Owner agrees:
(a) to pay normal sewer and/or water connection charges and
monthly sewer service and/or water charges to the City on the same basis
as sewer service and/or water users outside the municipal boundaries are
charged, as set out in the Code of Ordinances of the City of Clearwater,
Florida, 1962;
(b) that at such time as it becomes possible for the City to
annex said real property, this Agreement will constitute an application to
annex at that time, and the City will have the right, $p sixth(^60) d y
wrtten-:notice to the property owner, to initiate action to annex the property
to the City, Applicable fees for annexation request shall be due and pay-
able upon receipt of this Agreement for processing.
(c) The Owner agrees that it is to the mutual benefit of the Owner
and the City, in recognition of the eventual incorporation of the property with-
in the City, to have site and building plans reviewed and accepted by the City
in advance of obtaining any requisite permit from Pinellas County, Acceptance
of such plans shall precede the execution of this Agreement by the City.
(d) All property proposed to be subdivided or otherwise differenti-
ated from the original parcel described in this Agreement shall be treated as
a single parcel for the purposes of the subsequent annexation procedure,
individual ownership notwithstanding.
(e) The Owner agrees that the`terms and provisions. of this
Agreement shall be binding upon its successors and assigns, and the City
shall record this document.
(f) The Owner agrees that the terms and provisions of this
Agreement shall be a commitment and obligation which shall not only bind
the present owner of said described real property, but shall be a covenant

which shall run with the land and shall bind and be enforceable against
all subsequent owners of said described real property whether or not it
is mentioned in the Deed to said owners.
(g) If the Owner or its successors, or assigns, or any
subsequent owner, shall default in the performance of the terms and

provisions of this Agreement, and the City shall institute legal proceedings
to enforce the terms and provisions hereof, the Owner, its successors and
assigns, covenant and agree to pay all costs of such proceedings including
the payment of a reasonable attorney's fee in connection therewith.
3. All notices to be furnished hereunder shall be furnished to the
City of Clearwater, to the City Manager, P. O. Box 4748, Clearwater,
Florida, 33518.

APPROXIMATELY 225 FEET EAST OF BAYVIEW AVENUE, U,
CONSISTING OF LOT 22, BLOCK C, KAPOK TERRACE ,
SUBDIVISION, WHOSE POST OFFICE ADDRESS IS 3018 GLEN
S OAK AVENUE NORTH, TOGETHER WITH THE ABUTTING
RIGHT-OF-WAY OF GLEN OAK AVENUE NORTH, INTO THE
CORPORATE LIMITS OF THE CITY, AND REDEFINING THE
BOUNDARY LINES OF THE CITY TO INCLUDE SAID ADDITION;
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the owner of the real property described herein and depicted on the map
attached-hereto as Exhibit A has petitioned the City of Clearwater to annex the property into the
City pursuant to Section 171.044, Florida Statutes, and the City has complied with all applicable'
requirements of Florida law in connection with this ordinance; now,_therefore;
-L? BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CLEARWATER, FLORIDA:
`" DAN ?n Section 1. The following-described property is hereby annexed into the City of Clearwater
0'?pt and the boundary lines of the City are redefined accordingly:
Lot 22, Block C, Kapok Terrace as recorded in Plat Book 36, Page 14, Public Records of Pinellas
County, Florida, together with the abutting right-of-way of Glen Oak Avenue North (ATA2009-
06003)
Section 2. The provisions of this ordinance are found and determined to be consistent
with the City of Clearwater Comprehensive Plan. The City Council hereby accepts the dedication
of all easements, parks, rights-of-way and other dedications to the public, which have heretofore
been made by plat, deed or user within the annexed property. The City Engineer, the City Clerk
and the Planning Director are directed to include and show the property described herein upon the
official maps and records of the City.
Section 3. This ordinance shall take effect immediately upon adoption. The City Clerk shall
file certified copies of this ordinance, including the map attached hereto, with the Clerk of the Circuit
Court and with the County Administrator of Pinellas County, Florida, within 7 days after adoption,
and shall file a certified copy with the Florida Department of State within 30 days after adoption.

Please be advised that the City of Clearwater has decided not to initiate action to officially bring
your property, located at 3018 Glen Oak Avenue North (Parcel No. 09-29-16-45126-003-0220),
into its jurisdiction. This decision is based on the 1980 agreement to annex for your property
that was for "water only".
You may have noticed that the City of Clearwater is currently constructing a sanitary sewer line
in Glen Oaks Avenue near your property. If you would like to pursue annexation of your

ANNEXING CERTAIN REAL PROPERTY LOCATED ON THE
NORTH SIDE OF GLEN OAK AVENUE NORTH,
APPROXIMATELY 225 FEET EAST OF BAYVIEW AVENUE,
CONSISTING OF LOT 22, BLOCK C, KAPOK TERRACE
SUBDIVISION, WHOSE POST OFFICE ADDRESS IS 3018 GLEN
OAK AVENUE NORTH, TOGETHER WITH THE ABUTTING
RIGHT-OF-WAY OF GLEN OAK AVENUE NORTH, INTO THE
CORPORATE LIMITS OF THE CITY, AND REDEFINING THE
BOUNDARY LINES OF THE CITY TO INCLUDE SAID ADDITION;
PROVIDING AN EFFECTIVE DATE.
WHEREAS, the owner of the real property described herein and depicted on the map
attached hereto as Exhibit A has petitioned the City of Clearwater to annex the property into the
City pursuant to Section 171.044, Florida Statutes, and the City has complied with all applicable
requirements of Florida law in connection with this ordinance; now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. The following-described property is hereby annexed into the City of Clearwater
and the boundary lines of the City are redefined accordingly:
Lot 22, Block C, Kapok Terrace as recorded in Plat Book 36, Page 14, Public Records of Pinellas
County; Florida, together with the abutting right-of-way of Glen Oak Avenue North (ATA2009-
06003)
Section 2. The provisions of this ordinance are found and determined to be consistent
with the City of Clearwater Comprehensive Plan. The City Council hereby accepts the dedication
of all easements, parks, rights-of-way and other dedications to the public, which have heretofore
been made by plat, deed or user within the annexed property. The City Engineer, the City Clerk
and the Planning Director are directed to include and show the property described herein upon the
official maps and records of the City.
Section 3. This ordinance shall take effect immediately upon adoption. The City Clerk shall
file certified copies of this ordinance, including the map attached hereto, with the Clerk of the Circuit
Court and with the County Administrator of Pinellas County, Florida, within 7 days after adoption,
and shall file a certified copy with the Florida Department of State within 30 days after adoption.

In the Allen's Creek case, which involved sewer, the Second DCA discussed a 1987 case involving water as follows:
542 Allen's Creek also cites City of Clearwater v. Metco Development Corp., 519 So.2d 23 (Fla. 2d DCA 1987),
review denied, 525 So. 2d 876 (Fla. 19881, for the proposition that the City's annexation policy is invalid. In that
case, the court struck down the City's requirement of annexation in return for water services in unincorporated
areas. The decision, however, turns on the fact that the City and Pinellas County had entered into a contractual
relationship whereby the City agreed to provide water services to certain unincorporated areas. This court
affirmed the trial court's holding that the City could not alter this contractual duty by adding a condition of
annexation. Thus, it provides no authority for this case wherein the City has no corresponding contract in regard
to sewer services.
The Metco opinion indicated that the agreement between the City and County, whereby the City agreed to
provide water service without a condition of annexation to properties within the water service area, was
entered into in 1976. Based on that the Court held that the City could not require annexation as a
condition for providing water service.
Thus, assuming this property was also within the water service area and thus the agreement, arguably the
City could not have legally required the annexation as a condition of water service in 1980, when the ATA
was entered into.
Apparently the City has had a policy since 1987 of not pursuing water-only required annexations.
There is an argument that because the 1980 ATA was entered into between the 1976 City-County
agreement and the 1987 Court ruling it is executable; however, this would not be the strongest of
arguments if the County challenged the annexation, as it did in Metco.
It seems that the Glen Oaks area is contiguous to areas of McMullen-Booth Road and to 918 Moss
Avenue. I am assuming that the City is requiring ATAs as a condition of obtaining sewer service as is
legally allowed.

purchase agreement with Pinellas County, we do not (cannot) require annexation in exchange for
providing water service. We can for other city services but not just for providing water. If you want

I am getting ready to prepare the report for the MUNI agenda for this case.
I had sent a letter to the current owner of this property notifying him of the City's intent to annex his property 60 days
prior to starting the annexation process (city-initiated). The 60-days prior notice was as per the previous agreement to
annex for this property. Following the 60 day period we notified the owner, the PPC and Pinellas County of the tentative
schedule of meetings. We have heard nothing from the current owner of the property.
The subject agreement to annex that was signed by the previous property owners on November 19, 1980 (it was
recorded on December 9, 1980) was for "WATER ONLY". I recall hearing about a court case back in the 1980's that
resulted in "water only" annexations not being pursued by the City. Please advise if you feel we should still proceed
with this case.

The City of Clearwater is hereby notifying the Pinellas Planning Council of its intent to annex
property located at 3018 Glen Oak Avenue North (ATA2009-06003) into its jurisdiction in
compliance with the Agreement to annex (ATA), signed by Allen Wellbrock and Rosemarie

The City shall not be liable for any damage resulting from any unavoidable
cessation of service " caused by Act of God, necessary maintenance work,
or any cause beyond the control of the City.
2. In consideration of the covenants contained in Paragraph 1, im-
mediately above, on the part of the City, the Owner agrees:
(a) to pay normal sewer and/or water connection charges and
monthly sewer service and/or water charges to the City, on the same basis
as sewer service and/or water users outside the munic Ipal boundaries are
charged, as set out in the Code of Ordinances of the City of Clearwater,
Florida, 1962;
(b) that at such time as it becomes possible for the City to
annex said real property, this Agreement will constitut6 an application to

in advance of obtaining any requisite permit from Pinellas County, Acceptance
of such plans shall precede the execution of this Agreement by the City.

ated from the original parcel described in this Agrecmelnt shall be treated as
a single parcel for the purposes of the subsequent annexation procedure,
individual ownership notwithstanding.
(e) The Owner agrees that the terms and provisions of this
Agreement shall be binding upon its successors and ass:

As you may be aware, previous owners of this property, Allen Wellbrock and Rosemarie
Wellbrock, entered into an Agreement to Annex (ATA) with the City of Clearwater on November
19, 1980. In accordance with the provisions of this agreement, the City of Clearwater will be
initiating an action to officially bring your property., located at 3018 Glen Oak Avenue North
(Parcel No. 09-29-16-45126-003-0220), into its jurisdiction. This letter shall serve as 60 days
written notice of the City's intent to annex this property in accordance with the terms and
conditions established in that ATA. The City will then. proceed with the action to annex this
property. A copy of the ATA Agreement under reference is enclosed for your convenience. The
ATA is considered an application to annex and no further application is needed from you to start
the annexation process.
The benefits of annexation are many, including improved police and fire response, reduced rates
for utilities, city recreation programs, and garbage collection. An information sheet is also

2. In consideration of the covenants contained in Paragraph 1, im-
mediately above, on the part of the City, the Owner agrees:
(a) to pay normal sewer and/or water connection charges and
monthly sewer service and/or water charges to the City on the same basis
as sewer service and/or water users outside the municipal boundaries are
charged, as set out in the Code of Ordinances of the City of Clearwater,
Florida, 1962;
(b) that at such time as it becomes possible for the City to
annex said real property, this Agreement will constitute an application to

What You Need to Know
What is annexation?
Annexation is the process set forth in the Florida
Statutes that allows properties outside the current
city limits to become part of the city. Annexation
allows businesses and residents to join the City of
Clearwater and receive municipal services that are
available to properties located within city limits:
What is an agreement to annex?
When a property owner wants to receive city
services such as sanitary sewer or solid waste pick-
up but does not qualify for annexation because
the property is not contiguous to city boundaries,
the owner and city can enter into an Agreement
to Annex. This legally binding document allows
the property owner to receive available services in
advance of annexation. It specifies that once the
property becomes contiguous, the city will notify
the property owner and initiate the annexation to
complete the process.
Why is the city initiating my
a,ureement to annex?
Staff routinely studies areas in the city with
Agreements to Annex to identify the properties that
have become eligible for annexation and then moves
forward with the provisions of the agreements for
these properties.
How will this affect my taxes?
The City Council establishes the annual tax millage
rate for city residents, as Pinellas County does for
unincorporated areas. The city has some franchise
fees that the county does not have. These fees may
be offset by the elimination of any city surcharges
for city services already received. In addition, when a
property is annexed, the county's Municipal Services
Taxing Unit (MSTU) is removed from the tax bill.
How will my services change?
Utilities
Sanitary Sewer: City code requires that
residences connect to the city's sanitary sewer
system if it is "reasonably available." If the system is
available and you are not already connected, you will
be provided notice and given 90 days to connect.
If you are alread receiving sanitary sewer service,
any surcharges for previous sanitary sewer service
outside the city limits - upon annexation - will be
eliminated.
Solid Waste: In addition to twice-weekly garbage
collection, Clearwater provides once-weekly trash
and, yard waste collection. You will be allowed to
conclude your current contract with your private
solid waste provider before receiving solid waste
services. Clearwater Customer Service will work
with you to determine when your contract ends and
when the city will deliver a black barrel and a yellow
recycling bin to you to begin collection. You may opt
to cancel your private service sooner and initiate city
Solid Waste services upon annexation. Please contact
Solid Waste/General Services for current rates at
(727)562-4920.
The city also provides a full-service, citywide
residential curbside recycling program. Please call
(727) 562-4920 or learn more about the City of
Clearwater's recycling guidelines by going to
www.myclearwater.com or www.pinelloscounty.org/utilities/
municipal/clearwater. pd f.
Water: If you are receiving city water, surcharges
for out-of-city use will be eliminated. Annexation
will allow you to connect to the city's public water
system if your property is currently on a private well
and you choose to connect. If you are already in
an existing Pinellas County water service area, your
water provider will remain the same.

Utilities (cont'd)
Stormwater Utility- Stormwater utility fees
are used for engineering services, operation and
maintenance of the stormwater infrastructure,
and capital improvements to control flooding and
improve water quality. The stormwater management
system collects, treats, and conveys stormwater.
These utility fees are also used to pay for drainage
system maintenance and to plan for future collection
systems. Upon annexation, your utility bill will reflect
the addition of this fee. It is currently $11.13 per
month per residential unit.

Public Safety
Police Department: City of Clearwater Police
provide patrol, law enforcement, crime prevention
and other related services to the residents of
Clearwater. The department reaches out to
Clearwater's residents through community meetings
and a monthly interactive television show, B/ue/ine

I spoke with Cathy on this today and she asked me to send you a summary of our discussion (below).

ATA2009-06003: The annexation agreement for this property was signed by previous property owners Mr. & Mrs.
Wellbrock on November 19, 1980 (it was subsequently recorded on Dec. 9, 1980). According to the PIN.CO. Property
Appraiser, the property is now owned by Mr. William S. Nye. Following the example of the "Tracker" ATA, we prepared
a petition to annex signed by the City Manager, in order to execute this ATA. The required notification letter was sent to
Mr. Nye and we received the return certified mail slip signed by Mr. Nye.
Gwen Hollander sent me the proposed ordinances for this case to review. I asked Leslie about a part of Legal's proposed
ord. 8107-09 (annexation ordinance for the case) as follows:
WHEREAS, the owner of the real property described herein and depicted on the map attached hereto as Exhibit
A has petitioned the City of Clearwater to annex the property into the City pursuant to Section 171.044, Florida
Statutes, and the City has complied with all applicable requirements of Florida law in connection with this
ordinance; now, therefore,...

Ord. 8107-09 (above) is correct as the annexation agreement makes it a "petition to annex" so to speak. She said the
petition to annex signed by the City Manager is also ok for this case as far as she is concerned because she says it will
show a paper trail of what was done if someone is to look at the file later.
Note: Leslie emphasized that it is always a possibility that the current property owner (Mr. Nye) might attend one of the
meetings (CDB, CC) and object to the annexation. Leslie says, if this should occur, the current property owner won't
really have legal grounds to stop it, and that it would be up to the CC to decide whether to proceed or not as they
usually don't like to annex a property if the property owner objects.

I am working on a City-Initiated case to annex the property at 3018 Glen Oak Avenue North. There was a Nov. 19, 1980
Agreement to annex signed by the property owners at that time: Allen Wellbrock and Rosemarie Wellbrock, his wife.
According to the current Property Appraiser records it is owned now by: William S. Nye.
We sent the notification letter to Mr. Nye on June 5, 2009 (60 day notice per the agreement). The petition to annex was
signed by City Manager Bill Hornle on August 7, 2009. Letters have been sent to PPC and Mr. Nye - notifying them of the
schedule of meetings for this case.
