Furthermore, the scale, bulk, coverage, density and character of the proposed pool and deck is in harmony with that of existing adjacent properties: North, South and East: The parcels located north, south and east of the Property, are located in the LMDR District and are occupied as single family residences. West: The Property is bounded on the west by approximately 600-800 feet of sandy beach, and the Gulf of Mexico. The pool will be constructed at grade, and required safety devises will be constructed to reduce or eliminate visual impediments to the extent reasonably possible. 3) The proposed development will not adversely affect the health or safety of persons residing or working in the neighborhood of the proposed use. As stated earlier, pools are common accessory uses for single family homes. The proposed pool and deck will not adversely affect the health or safety of persons residing or working in the neighborhood. The location of the pool mechanical equipment, as shown on the attached site plan, also will not adversely affect the health or safety of persons residing or working in the neighborhood. The mechanical equipment will be buffered by native plants, which will maintain the natural beach character of the Property. The pool will meet or exceed all building and safety codes. 4) The proposed development is designed to minimize traffic congestion. The Applicant is not seeking any additional density or intensity to what is currently in existence on the Property, so this will not negatively impact traffic. 5) The proposed development is consistent with the community character of the immediate vicinity of the parcel proposed for development. The proposed pool and deck are substantially the same as other pools and decks located within the neighborhood. Pools (including hot tubs and saunas) are common accessory uses and are enjoyed by several single family homes in the immediate vicinity. For example, according to the Pinellas County Property Appraiser's web site, the properties located at 970 Eldorado Avenue, 974 Eldorado Avenue, 1090 Eldorado Avenue, 1100 Mandalay Point Road, 1150 Mandalay Point Road, 1170 Mandalay Point Road, 1198 Mandalay Point Road have large swimming pools, with other homes in the area having saunas and hot tubs and several having large decks. The proposed pool will be constructed at grade and will not impede the views of adjacent property owners. Additionally, the pool will be in scale with the size of the home on the Property. The proposed landscaping around the pool will include native plants, which will maintain the natural beach character of the Property. 2 6) The design of the proposed development minimizes adverse effects, including visual, acoustic and olfactory and hours of operation impacts on adjacent properties. The proposed pool does not create any unusual acoustic or olfactory impacts on adjacent properties. The required safety fence will meet the Florida Building Code requirements, and will be constructed so as to not negatively impact the views from adjacent properties. The proposed landscaping around the pool will include native plants, which will maintain the natural beach character of the Property. Flexible Criteria: Section 2-203 of the Code requires a Level One approval for the reduction in rear setback for detached dwellings, with the following requirements: 1. The reduction in rear setback will allow for the preservation of existing vegetation which could not otherwise be preserved. The CCCL and the CCCL setback currently cut through the southwest corner of the Property, which limits developable space, and preserves the existing vegetation. The Applicant is requesting a minimal reduction in the rear setback, rather than the sides, which will preserve the open space on the sides of the property. Current native vegetation exists just west of the proposed pool and deck, and the Applicant's proposed deck will keep foot traffic in designated areas, off of protected native vegetation. 2. The reduction in rear setback will allow the development or redevelopment of a substandard lot which would otherwise not be feasible. Due to the combination of the upland seawall, the CCCL cutting through the southwest corner of the lot and the small lot size, the lot is substandard. The Applicant is requesting minimal rear setback relief to allow for the construction of a well-designed, functional pool. Without the rear setback relief, any pool constructed would not be functional. 3. The reduction results in an efficient house layout. As the adjacent neighbors to the south, such an additional will have a direct and negative affect on the neighborhood and the beach. It will also open Pandora's box for other expansions west of the seawall and onto the beach. This application should be denied for the following reasons: The beauty of this neighborhood is the natural setting in which we live. There is direct access to the beach and the Gulf of Mexico. The neighborhood has made a conscious effort to preserve that setting, and a swimming pool to the west of the seawall would be a violation of that tranquility. 2. The proposed additional will cause further stress on an already distressed beach. It represents a harmful intrusion of overdevelopment into a natural habitat. 3. Such an addition is inconsistent with existing neighboring properties, and can be described as an "attractive nuisance", with all of the negative connotations that represents, not only for the neighborhood, but also the beach environment and native animals which roam the beach. 4. In a neighborhood with small children who constantly explore their environment, adjacent to a beach where uninvited visitors appear unannounced, this pool could represent an accident waiting to happen. This is especially true of a "summer home", where the owners are not • • present for much of the year. This is an inappropriate location for a swimming pool. In summary, we are opposed to any development to the west of the seawall because of the negative impact of the environment and the negative impact on property values if we do not preserve the nature beauty we all share. Because I have lived at 1002 Eldorado Avenue for ten years, and have loved this beach for all of my life, I know how much the residents here strive to maintain the beach's pristine character. None of us cuts down the sea oats; nobody does anything that will disturb the tortoises or the birds that nest in the dunes in front of our houses. I work on the Board of the Clearwater Marine Aquarium, and have advocated that we all turn out our spotlights during Turtle nesting season. We all cherish the beach in its natural state, and furthermore, as our houses are all so close together, we make huge efforts not to encroach on each others' privacy. This prospective swimming pool will jut out onto the beach sufficient to become a display for neighbors as far as four or five houses away. No other resident has attempted to build as far out on the beach as this, and therefore the prospective pool will not be consistent with the neighborhood as we know it now. The way the Costal Construction Line curves, the prospective swimming pool, with its fence, would be visible from my house, which is two houses away. My now unobstructed view of dunes and water would be hindered by the pool and by its fence. A swimming pool poses a threat to the safety of the young children in the neighborhood, who can now play in the dunes without hindrance. As it is, one can hear conversations conducted loudly from several houses away. We all make an effort to keep the noise down. A swimming pool, with a fence around it, would not only interrupt our views (which is the best part of the charm of this place), but would contribute noise to the neighborhood which would be most unpleasant. Once built, there would be nothing anyone could do about it. The character of out neighborhood would be altered. We would have to look at the pool. We would have to listen to the noise that came from it, and the serenity of the neighborhood that we try so hard to protect would be changed forever. Please deny this application. An older home like mine used to sit on that property. Several years ago that home was razed and two multi- story homes were constructed- or shoe-horned- on the land. The subject building now sits very close to ;the south wall of my house and protrudes out to the west (beachside) further than all the earlier homes built. As a consequence, the subject property obstructs and dominates our view to the south, and is out of character and harmony with the earlier siting of houses on this part of the beach. If a pool were added as proposed, it would further obstruct our view, and be even more out of character with the neighborhood. We don't have a pool and neither do any of the neighbors for obvious reasons. Sticking a pool out there would add insult to injury. Building a protruding pool next door would further impair the esthetics and value of our property and that of our neighbors because it would stick out like a proverbial sore thumb and be an attractive nuisance for beach wanderers, raccoons, and such ...unless they added fencing, which would be even worse. We don't need a watering hole next door. Such a pool extended west of the seawall would be an unwelcome "first" in the neighborhood. In a storm tide reaching the seawall, the protruding structure would likely act as a groin to block and trap tidal water and thus destroy sand'dunes in front which act as a natural environmental barrier. If squeezing a pool onto this property is such a high recreational priority, my suggestion would be to move the house itself out of the front yard and back towards the street where it belongs. That's where a builder following the biblical "Golden Rule" would have sited it in the first place. Otherwise, Gulf of Mexico swimming is available and free nearby. Sincerely, Louise R. The beauty of this neighborhood is the natural setting in which we live. There is direct access to the beach and the Gulf of Mexico. The neighborhood has made a conscious effort to preserve that setting, and a swimming pool to the west of the seawall would be a violation of that tranquility. 2. The proposed additional will cause further stress on an already distressed beach. It represents a harmful intrusion of overdevelopment into a natural habitat. 3. Such an addition is inconsistent with existing neighboring properties, and can be described as an "attractive nuisance", with all of the negative connotations that represents, not only for the neighborhood, but also the beach environment and native animals which roam the beach. 4. In a neighborhood with small children who constantly explore their environment, adjacent to a beach where uninvited visitors appear unannounced, this pool could represent an accident waiting to happen. This is especially true of a "summer home", where the owners are not i 0 i present for much of the year. This is an inappropriate location for a swimming pool. In summary, we are opposed to any development to the west of the seawall because of the negative impact of the environment and the negative impact on property values if we do not preserve the nature beauty we all share. Because I have lived at 1002 Eldorado Avenue for ten years, and have loved this beach for all of my life, I know how much the residents here strive to maintain the beach's pristine character. None of us cuts down the sea oats; nobody does anything that will disturb the tortoises or the birds that nest in the dunes in front of our houses. I work on the Board of the Clearwater Marine Aquarium, and have advocated that we all turn out our spotlights during Turtle nesting season. We all cherish the beach in its natural state, and furthermore, as our houses are all so close together, we make huge efforts not to encroach on each others' privacy. This prospective swimming pool will jut out onto the beach sufficient to become a display for neighbors as far as four or five houses away. No other resident has attempted to build as far out on the beach as this, and therefore the prospective pool will not be consistent with the neighborhood as we know it now. The way the Costal Construction Line curves, the prospective swimming pool, with its fence, would be visible from my house, which is two houses away. My now unobstructed view of dunes and water would be hindered by the pool and by its fence. A swimming pool poses a threat to the safety of the young children in the neighborhood, who can now play in the dunes without hindrance. As it is, one can hear conversations conducted loudly from several houses away. We all make an effort to keep the noise down. A swimming pool, with a fence around it, would not only interrupt our views (which is the best part of the charm of this place), but would contribute noise to the neighborhood which would be most unpleasant. Once built, there would be nothing anyone could do about it. The character of out neighborhood would be altered. We would have to look at the pool. We would have to listen to the noise that came from it, and the serenity of the neighborhood that we try so hard to protect would be changed forever. Please deny this application. An older home like mine used to sit on that property. Several years ago that home was razed and two multi- story homes were constructed- or shoe-horned- on the land. The subject building now sits very close to ;the south wall of my house and protrudes out to the west (beachside) further than all the earlier homes built. As a consequence, the subject property obstructs and dominates our view to the south, and is out of character and harmony with the earlier siting of houses on this part of the beach. If a pool were added as proposed, it would further obstruct our view, and be even more out of character with the neighborhood. We don't have a pool and neither do any of the neighbors for obvious reasons. Sticking a pool out there would add insult to injury. Building a protruding pool next door would furthor impair the esthetics and value of our property and that: of our neighbors because it would stick out like a proverbial sore thumb and be an attractive nuisance for beach wanderers; raccoons, and such-unless they added fencing, which would be even worse. We don't need a watering hole next door. Such a pool extended west of the seawall would be an unwelcome "first" in the neighborhood. In a storm tide reaching the seawall, the protruding structure would likely act as a groin to block and trap tidal water and thus destroy sand dunes in front which act as a natural environmental barrier. If squeezing a pool onto this property is such a high recreational priority, my suggestion would be to move the house itself out of the front 'yard and back towards the street where it belongs. That's where a builder following the biblical "Golden Rule" would have sited it in the first place. Otherwise, Gulf of Mexico swimming is available and free nearby. Sincerely' Louise R.
