Akin City Attorney SUBJECT: Using TIF funds for Community Policing Innovation Our File Number: A04-09311 DATE: May 28, 2008 The CRA is considering using CRA funds, specifically TIF funds, to pay for police officers in the East Gateway portion of the CRA, pursuant to the Five Year Plan for increased police presence in that area. Chapter 163 allows for the use of TIF funds for community policing innovations in Community Redevelopment Areas. Community policing innovation is defined as "a policing technique or strategy designed to reduce crime by reducing opportunities for, and increasing the perceived risks of engaging in, criminal activity through visible presence of police in the community, including, but not limited to, community mobilization, neighborhood block watch, citizen patrol, citizen contact patrol, foot patrol, neighborhood storefront police stations, field interrogation, or intensified motorized patrol." In order for TIF funds to be used, the police services must be new or additional, not currently funded by the City. There are three options for implementing such a program. The first option is to amend the community redevelopment plan, the second is to create a "community redevelopment neighborhood improvement district" within the CRA, and the third is to create a "safe neighborhood improvement district." Each option has its own statutory requirements for creation and funding. Section 163.361, Florida Statutes, allows a community redevelopment plan to be amended to include the development and implementation of community policing innovations. In order to utilize this option, the usual procedures for amending the plan must be followed, including the following: 1. The governing body must provide public notice of such proposed action pursuant to s. 166.041(3)(a) and, at least 15 days before such proposed action, mail by registered mail a notice to each taxing authority which levies ad valorem taxes on taxable real property contained within the geographic boundaries of the redevelopment area; 2. The ager~ shall report such proposed m~ication to each taxing authority in writing or by an oral presentation, or both, regarding such proposed modification; and 3. If a community redevelopment plan is modified by the county or municipality after the lease or sale of real property in the community redevelopment area, such modification may be conditioned upon such approval of the owner, lessee, or successor in interest as the county or municipality may deem advisable and, in any event, shall be subject to such rights at law or in equity as a lessee or purchaser, or his or her successor or successors in interest, may be entitled to assert. If this method is used, the CRA would be able to fund the innovations from the TIF fund. The second option is to create a "community redevelopment neighborhood improvement district" under Section 163.512, Florida Statutes. This is a complex procedure that would require the establishment of an advisory counsel made up of property owners or residents of the district. It requires that the safe neighborhood improvement plan be consistent with the community redevelopment plan created pursuant to § 163.360, and permits the safe neighborhood improvement plan to be included in the community redevelopment plan as an optional element. Such districts are created by individual ordinance for each district, after recommendation of the community redevelopment agency and after a local planning ordinance has been adopted by the city authorizing the creation of such. districts. This option also requires that the boundaries of the community redevelopment district be contained in whole within the community redevelopment area established pursuant to §§ 163.355 and 163.356., requires the district to notify the Department of Legal Affairs and the Department of Community Affairs in writing of its establishment within 30 days thereof pursuant to § 163.5055., and provides that the advisory council shall perform such duties as may be prescribed by the community redevelopment board established pursuant to § 163.356 and shall submit within the time period specified by the board of directors a report on the district's activities and a proposed budget to accomplish its objectives. In formulating a plan for services or improvements, the advisory council shall consult in public session with the appropriate staff Or consultants of the community redevelopment board responsible for the district's plan. This option would allow for several funding sources. The community policing innovations could be funded from the TIF fund. In addition, § 163.506 authorizes the use of special assessments, upon referendum approval, to support planning and implementation of district improvements pursuant to the provisions of §163.514(16), F.S. (Subject to referendum approval, make and collect special assessments pursuant to §§ 197.3632 and 197.3635 to pay for improvements to the district and for reasonable expenses of operating the district, including the payment of expenses included in the district's budget, subject to an affirmative vote by a majority of the registered voters residing in the district. Such assessments shall not exceed $500 for each individual parcel of land per year. Notwithstanding the provisions of § 101.6102, the referendum to approve the special assessment shall be by mail ballot.) This option also provides for the ability to apply for grant funding to the Department of Legal Affairs. The final option is to cr a one or more "special neighbor improvement districts" under § 163.511. This ion is similar to the creation of amunity redevelopment neighborhood improvement district," but does not require the boundaries of the district to be contained within the CRA. There are other restrictions and requirements, and this option does not allow for the use of TIF funds. The procedure for creating such districts is complex, so, unless you wish otherwise, I would only do a complete analysis of the requirements if interest is expressed in utilizing this option for other areas of the city. /g and Statutes & Constitution :View ,Statutes :Online Sunshine • • Select Year: ', 2008 ~ Go Page 1 of 2 The 2008 Florida Statutes Title XI Chapter 163 View Entire COUNTY ORGANIZATION AND INTERGOVERNMENTAL Chapter INTERGOVERNMENTAL RELATIONS PROGRAMS 163.361 Modification of community redevelopment plans.-- (1) If at any time after the approval of a community redevelopment plan by the governing body it becomes necessary or desirable to amend or modify such plan, the governing body may amend such plan upon the recommendation of the agency. The agency recommendation to amend or modify a redevelopment plan may include a change in the boundaries of the redevelopment area to add land to or exclude land from the redevelopment area, or may include the development and implementation of community policing innovations. (2) The governing body shall hold a public hearing on a proposed modification of any community redevelopment plan after public notice thereof by publication in a newspaper having a general circulation in the area of operation of the agency. (3)(a) In addition to the requirements of s. 163.346, and prior to the adoption of any modification to a community redevelopment plan that expands the boundaries of the community redevelopment area or extends the time certain set forth in the redevelopment plan as required by s. 163.362(10), the agency shall report such proposed modification to each taxing authority in writing or by an oral presentation, or both, regarding such proposed modification. (b) For any community redevelopment agency that was not created pursuant to a delegation of authority under s. 163.410 by a county that has adopted a home rule charter and that modifies its adopted community redevelopment plan in a manner that expands the boundaries of the redevelopment area after October 1, 2006, the following additional procedures are required prior to adoption by the governing body of a modified community redevelopment plan: 1. Within 30 days after receipt of any report of a proposed modification that expands the boundaries of the redevelopment area, the county may provide notice by registered mail to the governing body of the municipality and the community redevelopment agency that the county has competing policy goals and plans for the public funds the county would be required to deposit to the community redevelopment trust fund under the proposed modification to the community redevelopment plan. 2. For those community redevelopment agencies for which the board of commissioners of the community redevelopment agency are comprised as specified in s. 163.356(2), a designee of the community redevelopment agency shall participate in the joint meeting as a nonvoting member. Any such hearing shall be held within 90 days after receipt by the county of the recommended modification of the adopted community redevelopment plan. Prior to the joint public hearing, the county may propose an alternative modified community redevelopment plan that meets the requirements of s. 163.360 to address the conditions identified in the resolution making a finding of necessity required under s. 163.355. If such an alternative modified redevelopment plan is proposed by the county, such plan shall be delivered to the governing body of the municipality that created the community redevelopment agency and the executive director or other officer of the community redevelopment agency by registered mail at least 30 days prior to holding the joint meeting. 3. If the notice required in subparagraph 1. is timely provided, the municipality may not proceed with the adoption of a modified plan until 30 days after the joint hearing unless the governing body of the county has failed to schedule or a majority of the members of the governing body of the county have failed to attend the joint hearing within the required 90-day period. 4. Notwithstanding the time requirements established in subparagraphs 2. and 3., the county and the municipality may at any time voluntarily use the dispute resolution process established in chapter 164 to attempt to resolve any competing policy goals between the county and municipality related to the community redevelopment agency. Nothing in this subparagraph grants the county or the municipality the authority to require the other local government to participate in the dispute resolution process. (4) A modification to a community redevelopment plan that includes a change in the boundaries of the redevelopment area to add land must be supported by a resolution as provided in s. 1.63.355._ (5) If a community redevelopment plan is modified by the county or municipality after the lease or sate of real property in the community redevelopment area, such modification may be conditioned upon such approval of the owner, lessee, or successor in interest as the county or municipality may deem advisable and, in any event, shall be subject to such rights at law or in equity as a lessee or purchaser, or his or her successor or successors in interest, may be entitled to assert. No.: 8014-09 Agenda Item: D 1 CITY OF CLEARWATER PLANNING DEPARTMENT CLEARWATER DOWNTOWNREDEVELOPMENT PLAN AMENDMENTS STAFF REPORT REQUEST: Amendments to the Clearwater Dow~ztow~z Redevelopment Plait INITIATED BY: City of Clearwater Planning Department BACKGROUND INFORMATION: On May 13, 2008 the Community Redevelopment Agency (CRA) approved the East Gateway District Five-Year Action Program. The Action Program responded to public input on the issues of drug dealing, prostitution and street crime by including an action item for an increased police presence in the East Gateway. As Florida Statutes allow for the use of tax increment financing (TIF) funds for community policing innovations, the CRA entered into an Interlocal Agreement with the Police Department on August 27, 2008 to provide for additional police presence beyond current activity levels. The Tax Increment Financing Section of the Clearwater Downtown Redevelopment Plan needs to be revised to recognize that TIF is ~ source of funding for additional community policing innovations. The Planning Department is also recommending that minor amendments be made to the Plan to support the location of a performing arts theater in Downtown. The Community Development Board is reviewing the proposed amendments in its capacity as the Local Planning Agency -and is requested to make a recommendation regarding the amendments to the City Council. The CRA is requested to make a recommendation to the City Council regarding the amendments to the Plan. Once the City Council approves these amendments, they will be submitted to the Board of County Commissioners for approval as amendments to the Redevelopment Plan. They will also be submitted to the Pinellas Planning Council and the Countywide Planning Authority for approval as amendments to the Special Area Plan governing Downtown. Community Development Board -November 18, 2008 4th Downtown Plan Amendments -Page 1 of 4 • • ANALYSIS: Five amendments are proposed to the Plan and are contained in Exhibit A attached to Ordinance No. 8014-09. One amendment revises the land use/redevelopment plan while four amendments relate to downtown strategies and tax increment financing. Below is a summary of each amendment. 1. Amendment 1 -Insert new policy in Chapter 3 Land Use/Redevelopment Plan, Goals, Objectives and Policies Section on page 54 of the Plan (page one of Exhibit A of proposed ordinance). A new policy supporting the continuation of community policing innovations in the Downtown is proposed. The proposed policy notes that the program should continue to focus on a variety of strategies that increase police visibility and reduce opportunities for crime. Strategies outlined in the policy are consistent with those outlined in Florida Statutes Chapter 163 and are currently employed by the Downtown Bike and C.H.I.P Teams. 2. Amendment 2 -Amend Strategy 20 in Chapter 4 Plan Implementation and add new Strategy 21 on page 218 of the Plan (page one of Exhibit A of proposed ordinance). Strategy 20, located in the Plan Implementation section of Chapter 4, supports city efforts to attract a movie theater to Downtown. The proposed amendment would expand this strategy to also market Downtown as a prime location for a performing arts theater. Due to the benefits such a facility would have on Downtown revitalization efforts, the proposed strategy also supports the City providing development assistance for a performing arts theater. Proposed amendment two also provides for a new Strategy 21 which supports community policing innovations in the CRA. 3. Amendment 3 -Amend Table 7 Summary of Public Strategies in Chapter 4 Plan Implementation on pages 222-233 of the Plan (page two of Exhibit A of proposed ordinance). This proposed amendment revises Table 7 which summarizes the public strategies to be employed within the Downtown. Existing Strategy 20 is proposed to be expanded to include a performing arts theater as discussed above and a new Strategy 21 is proposed ~ regarding community policing innovations as discussed above. The remaining strategies will be renumbered. 4. Amendment 4 -Amend the third paragraph of the Tax Increment Revenue Projections Section and the corresponding summary table in Chapter 4 Plan Implementation on page 255 of the Plan (pages two -three of Exhibit A of proposed ordinance). Community Development Board -November 18, 2008 4th Downtown Plan Amendments -Page 2 of 4 • ~ Amendment four adds community policing as a program within the CRA that will be funded through tax increment financing. The summary table of the CRA programs and initiatives is also proposed to be amended to include community policing innovations. A total of $1 million dollars is estimated to be the cost of this program over the next five -seven years. This amendment also clarifies that community policing innovations can only be funded through City TIF revenues. 5. Amendment 5 -Amend the Tax Increment Revenue Projections Section in Chapter 4 Plan Implementation on page 259 of the Plan (pages three -four of Exhibit A of proposed ordinance). The City has provided a community policing presence in Downtown since 1998. Proposed Ordinance No. 8014-09 outlines the history of those efforts and a summary of the unique issues the City faces in the CRA. The amendment sets forth the intent community policing innovations and notes the importance of reducing crime in the CRA to improve the quality of life in the CRA. The amendment is written broadly to apply to the entire CRA in the event City Council and CRA want to provide a higher level of community policing service beyond the East Gateway Character District. The program is proposed to be on-going with a cost over the next five -seven years at a maximum of $1 million dollars. CONSISTENCY WITH COMPREHENSIVE PLAN Please find below a selected list of objectives and policies from the Clearwater Comprehensive Plan that is furthered by the proposed amendments to the Clearwater Downtown Redevelopment Plan. • Objective 2.1 -The redevelopment of blighted, substandard, inefficient and/or obsolete areas shall be a high priority and promoted through the implementation of redevelopment and special area plans, the construction of catalytic private projects, city investment, and continued emphasis on property maintenance standards. • Policy 2.1.8 -The City shall continue to support and implement approved community redevelopment area plans, such as the Downtown Redevelopment Plan adopted in 2004. • Policy 2.1.10 -Clearwater will continue to support the tax increment financing program and redevelopment efforts of the downtown area through activities of the economic development office and actions of the City Commission as the Community Redevelopment Agency. The proposed amendments to the Clearwater Downtown Redevelopment Plan primarily focus on community policing innovations as a public strategy in the CRA. A higher level of community policing innovations is an investment in the future health of the CRA and will assist in reducing blighting influencing within the area. The use of TIF to fund a higher level of community policing presence in the CRA is an appropriate use of such Community Development Board -November 18, 2008 4th Downtown Plan Amendments -Page 3 of 4 • • funds. The proposed amendments therefore support existing objectives and policies of the Clearwater Comprehensive Plan. SUMMARY AND RECOMMENDATION: The proposed amendments to the Clearwater Downtown Redevelopment Plan are consistent with the Comprehensive Plan. Proposed Ordinance No. 8014-09 makes minor amendments regarding the City's desire to attract theaters to Downtown and provides for policies and strategies supporting community policing innovations in the CRA, as well as using tax increment financing as a funding source for increased levels of community policing activities. SUMMARY: The CRA approved the East Gateway District Five-Year Action Program on May 13, 2008. The Action Program responded to public input on the issues of drug dealing, prostitution and street crime by including an action item for increased police presence within the East Gateway District. A potential funding strategy for this action item is the use of Tax Increment Financing (TIF) funds. Florida Statutes allows for the use of TIF funds for "community policing innovations" in Community Redevelopment Areas. CRA and Police Department staffs have drafted a scope of services and terms within an Interlocal Agreement between the parties. Generally, the Interlocal Agreement provides for the following elements: ^ Two experienced, equipped officers providing the following law enforcement services within the East Gateway District: - Eight hours per day (minimum) - Five days per week (minimum) ^ New officer assignment (2 officers) to Community Policing Team will ensure continuous coverage by at least two officers. ^ Predominately during evening hours ^ Patrol by both vehicles and bicycles ^ Reporting on police activities and statistical information for the East Gateway The Police Department East Gateway District law enforcement strategy includes the following goal and objectives: GOAL: Reduce drug dealing, prostitution, and street crimes in the target area. Objective 1: Remove identified dealers and career criminals from the target area. Objective 2: Reduce incidence of prostitution and solicitations by "Johns" in the target area. Objective 3: Reduce crimes committed by and against homeless individuals in the target area. INTERLOCAL AGREEMENT This Interlocal, Agreement is made and entered into this a ~~ day of ,c.42`- 2008, by and between the Community Redevelopment Agency of th City of Clearwater, Florida (CRA), a redevelopment agency established pursuant to law, and the City of Clearwater (CITY), a municipal corporation of the State of Florida. WHEREAS, this Agreement is made and entered between the parties pursuant to Section 163.01, Florida Statutes, the "Florida Interlocal Cooperation Act of 1969"; and WHEREAS, Section 163.361(1) of the Florida Statutes allows for the use of Tax Increment Funding (TIF) funds for community policing innovations in Community Redevelopment Areas; and WHEREAS, the CRA has established a Five Year Plan which contains an East Gateway Character District Strategy, which includes the element to "provide a more visible community policing presence within the East Gateway ~` neighborhood"; and WHEREAS, the CRA has ascertained that the East Gateway area is in critical need of community policing presence in order to specifically reduce drug dealing, prostitution, and street crimes in the target area; and WHEREAS, the CRA desires, through the use of TIF funds, to enhance the community policing presence, specifically in the East Gateway area; and WHEREAS, the CRA and the CITY wish to enter into an Interlocal Agreement in order to provide for the CRA's financial contribution to provide additional community policing presence by the CITY in the East Gateway area above and beyond the current activity levels; and WHEREAS, the CRA and the CITY desire to enter into an Interlocal Agreement outlining the scope of services and responsibilities of the parties. NOW THEREFORE, in consideration of the covenants made by each party to the other and of the mutual advantages to be realized by the parties hereto, the CRA and the CITY agree as follows: Section 1. Term. The term of this Interlocal Agreement will be October 1, 2008 through September 30, 2009. Section 2. Intent. It is the intent of the parties that the TIF funds paid to the CITY by the CRA pursuant to Section 163.361(1), Florida Statutes, be used LJ to provide a more visible community policing presence within the East Gateway neighborhood. Section 3. Responsibilities of the CRA 1. Function: a. Provide TIF funding in the total amount of $134,023.86 for the contract year, said funds to be utilized by the Clearwater Police Department (CPD) to provide the community policing presence, to be allocated in the following manner: b. $127,444.04 to pay for the salaries, benefits and equipment for two (2) police officers for the contract year. Exhibit "A," Position Enhancement Fact Sheet, attached hereto and incorporated by reference, contains detailed specifications on salary, benefits and equipment. c. $2,829.82 to purchase two (2) fully equipped police bicycles as a cost of $1,414.91 each. d. $3,750.00, the estimated fuel cost for the contract year for a police vehicle used by the two (2) police officers within the East Gateway Area. Section 4. Responsibilities of the CITY 1. Scope of Duties. The services that the CITY will provide will be carried out the CPD. These services are: A) Implementation of a Law Enforcement Strategy in the East Gateway area as follows: Goal: Reduce drug dealing, prostitution, and street crimes. 1. Objective 1: Remove identified dealers and career criminals from the area. Tasks: a) Identify the drug dealers in the area. b) Gather intelligence information utilizing undercover techniques and surveillance equipment. c) Develop confidential informants to assist in furthering criminal investigations of the "worst of the worst." Outcome Measures: a) Develop two (2) confidential informants in the target area. 2 u b) Increase by 25% the number of criminal charges filed against drug dealers in the target area. 2. Objective 2: Reduce incidence of prostitution and solicitations by "Johns" in the target area. Tasks: a) Conduct reverse prostitution "stings" utilizing police officers as decoys. b) Utilize directed patrol to discourage prostitutes and "Johns" from frequenting the area. c) Impound vehicles of "Johns) who are arrested for soliciting prostitutes or police decoys in the area. d) Coordinate with the City's Community Response Team to enhance code enforcement in the target area relative to hotels that are know to be utilized by prostitutes. Outcome measures: a) Conduct minimum of three (3) reverse sting operations annually. b) Conduct minimum of two (2) inspections annually in conjunction with Community Response Team of hotels used by prostitutes. 3. Objective 3: Reduce crimes committed by and against homeless individuals in the target area. Tasks: a) Utilize directed patrol in areas known to be frequented by homeless individuals. b) .Enforce "Rules of Conduct" as set forth by the Clearwater Homeless Intervention Project (including prohibitions against panhandling, public drinking, public urination, loitering, etc.) Outcome Measures: a) Increase arrests and citations for violations of criminal law or ordinances by 25% over afive-year period. B) In order to carry out the Law Enforcement Strategy referenced above, the CPD will provide the following: 1. Two (2) fully equipped police officers to provide law enforcement services to the target area defined as the East Gateway for a minimum of eight (8) hours per day, five (5) days per week. 2. Specific duties, activities, and responsibilities: 3 • • a) The officers will be assigned to a Community Policing Team with geographical responsibility for the East Gateway. b) The Team assignment will always ensure coverage by two (2) officers. c) Schedules of the officers will vary, but coverage will be predominately during evening hours. d) Officers will patrol by both vehicles and bicycles. e) A report of police activities and statistical information will be provided to the CRA on a scheduled basis. f) The officers selected will be experienced, current member of the CPD. 3. An existing, fully-equipped Crown Victoria Police Car. C) All CRA funds pursuant to this agreement will be kept in the CPD's departmental account and will be segregated for accounting purposes in the City records. D) No charges to the CRA account will be made for activities or hours worked by the two (2) officers outside the CRA area, or for equipment used outside the CRA area. Nothing herein is intended to nor shall it be construed as a waiver of any immunity from or limitation from liability that the CRA and the CITY are entitled to under the doctrine of sovereign immunity (Section 768.28, Florida Statutes). Nothing herein shall be construed as consent by the CRA or the CITY to be sued by third parties in any manner arising out of this Agreement. Section 8. Maintenance of Effort. The expenditures authorized by this Agreement are solely and exclusively to increase community policing activity and resources. The City agrees that no diminishment of existing police efforts in the East Gateway will occur as a result of this agreement. Section 8. Filing Effective Date. As required by Section 163.01(11), Florida Statutes, the Interlocal Agreement shall be filed with the Clerk of the Circuit Court of Pinellas County after execution by the parties, and shall take effect upon the date of filing. The Clearwater Police Department (CPD) will provide two (2) fully equipped officers to provide law enforcement services to that area defined as the "East Gateway", for a minimum of eight (8) hours per day, five days per week. The CRA funded positions will be assigned to a Community Policing Team with geographical responsibility for the East Gateway. The Team assignment will always ensure coverage by two (2) officers. It is anticipated that the contract will be renewable on an annual basis, and that if terminated for any reason by the CRA, the officer positions will be eliminated through normal attrition. WHEREAS, the City of Cleawater has the authority pursuant to the Rules Governing the Administration of the Countywide Future Land Use Plan, as amended, Section 2.3.3.9.5, to adopt and enforce a specific plan for redevelopment in an urban center in accordance with the Central Business District plan category, and said Section requires that a special area plan therefore be approved by the local government; and WHEREAS, the City Council approved the updated 2003 Clearwater Downtown Redevelopment Plan on September 18, 2003 by adopting Ordinance No. 7153-03 and has subsequently amended it; and WHEREAS, the Pinellas County Board of County Commissioners approved the CRA Plan adopted by Ordinance No. 7231-03 on December 16, 2003 and has subsequently amended it; and WHEREAS, the City Council approved the creation of a Redevelopment Trust Fund for the expanded CRA by adopting Ordinance No. 7214-03; and WHEREAS, the Pinellas County Board of County Commissioners approved the creation of a Redevelopment Tn.tst Fund for the expanded CRA adopted by Ordinance No. 7214-03 on February 3, 2004; and WHEREAS, the Countywide Planning Authority approved the updated 2003 Clearwater Downtown Redevelopment Plan as the Special Area Plan for Downtown Clearwater on February 3, 2004 and subsequently approved amendments thereto; and Ordinance No. 8014-09 • • WHEREAS, the requirements of Florida Statutes Section 163.360 regarding the adoption of community redevelopment plans have been met regarding that portion of the amendments proposed hereby which affect the Downtown Community Redevelopment Area, and the requirements of Florida Statutes Section 163.346 regarding notice to taxirig authorities and other required notice, as well as all other requirements of Florida Statutes Chapter 163, have been met; and WHEREAS, it is advisable to revise certain provisions of the Plan regarding the types of theaters eligible for development assistance; and WHEREAS, the City and the CRA has ascertained that the Downtown is in critical need of a focused community policing presence in the CRA in order to reduce drug dealing, prostitution and street crimes; and WHEREAS, Section 163.361(1) of the Florida Statutes allows for the use of Tax Increment Financing (TIF) funds for community policing innovations in Community Redevelopment Areas; and WHEREAS, it is advisable to revise certain provisions of the Plan adding policies and strategies regarding community policing innovations; and WHEREAS, it is advisable to allow tax increment financing (TIF) funds to support community policing innovations within the CRA; and WHEREAS, the proposed amendments were reviewed by the Community Development Board, which is the land planning agency for the City of Clearwater for purposes of the Local Government Comprehensive Planning and Land Development Regulation Act, and the Community Development Board found the proposed amendments to be consistent with the Comprehensive Plan of the City of Clearwater; and WHEREAS, the Community Redevelopment Agency has reviewed the proposed amendments and recommends them to the City Council, and the amended Plan shalt serve as the Community Redevelopment Plan for the downtown Community Redevelopment Area of the City of Clearwater; and WHEREAS, the proposed amendments conform to the general plan of the City of Clearwater; and WHEREAS, the proposed amendments will afford maximum opportunity, consistent with the sound needs of the City, for the rehabilitation or redevelopment of the Plan area by private enterprise; now, therefore, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CLEARWATER, FLORIDA: Section 1. In November 1995 (Case #CW 95-42), the CPA approved the Clearwater Downtown Redevelopment Plan. In 1998, two minor plan changes were received and accepted, changing land use designations within the plan area. In February 2004, the CPA approved the revised Clearwater Downtown Redevelopment Plan, which was consolidated with the Clearwater Downtown Periphery Plan. The approval of the revised plan included two conditions: one condition required submission by the City of any future amendment to the Downtown Redevelopment Plan, for receipt and acceptance, or for consideration as an amendment, as is determined necessary, under the Countywide Plan amendment process; the second condition required the submission by the City of a monitoring and evaluation report for the CBD designation assessing the status of plan implementation progress and measurable impacts to date, within five (5) years of the February 3, 2004 approval date. In December 2004, a minor plan change, including the addition of design guidelines, was received and accepted. The proposed changes are consistent with the overall objectives of the Clearwater Downtown Redevelopment Plan (also referred to by the Countywide Rules as a Special Area Plan) and are minor in nature. In November 1995 (Case #CW 95-42), the CPA approved the Clearwater Downtown Redevelopment Plan. In 1998, two minor plan changes were received and accepted, changing land use designations within the plan area. In February 2004, the CPA approved the revised Clearwater Downtown Redevelopment Plan, which was consolidated with the Clearwater Downtown Periphery Plan. The approval of the revised plan included two conditions: one condition required submission by the City of any future amendment to the Downtown Redevelopment Plan, for receipt and acceptance, or for consideration as an amendment, as is determined necessary, under the Countywide Plan amendment process; the second condition required the submission by the City of a monitoring and evaluation report for the CBD designation assessing the status of plan implementation progress and measurable impacts to date, within five (5) years of the February 3, 2004 approval date. In December 2004, a minor plan change, including the addition of design guidelines, was received and accepted. Summary Explanation/Background: The Board of County Commissioners (Board) has received a recommendation from the Pinellas Planning Council (PPC or Council) regarding proposed minor changes to the Clearwater Downtown Redevelopment Plan. The City is amending the Plan to encourage the development of a performing arts theater downtown and to support community policing efforts downtown. In addition to serving as the special area plan to meet the requirements of the Countywide Rules, the Clearwater Downtown Redevelopment Plan was also approved by the Clearwater City Commission and the Board of County Commissioners as the Community Redevelopment Plan for downtown Clearwater under the authority of the Community Redevelopment Act (CRA) in Chapter 163, Part III, of the Florida Statutes. The usual procedure is for any proposed amendments to a CRA Redevelopment Plan to be reviewed and approved by the Board of County Commissioners under the Chapter 163 process prior to the proposals being considered by the PPC under the countywide process. Board action to approve the CRA Redevelopment Plan amendments under the Chapter 163 process was completed on February 17th. Subsequent to this approval, the PPC considered the proposed Redevelopment Plan amendments on February 18th. Under the countywide process, the proposed amendments are considered to be minor and require only receipt and acceptance by the Countywide Planning Authority (CPA). County staff concurs with the PPC recommendation that the CPA receive and accept the proposed minor change to the Clearwater Downtown Redevelopment Plan. TIF is identified as one of the funding sources for several capital and infrastructure improvement projects outlined in the Capital Improvement Projects (CIP) section of this plan. These projects include the Cleveland Street, Fort Harrison, and Gulf to Bay Streetscapes and the Gulf to Bay Boulevard and Highland Avenue Gateway Intersection. Its first focused efforts in the Downtown area came in 1998 when a police substation was co-located in the Clearwater Homeless Intervention Prog am (CHIP) shelter in the East Gateway Character District in response to resident concerns about the crime potential associated with the shelter. Another community policing team, the Downtown Bicycle Team, was established for the Downtown Core of the CRA in 2005 in anticipation of additional demands on the Police Department as a result of redevelopment. Additionally AmeriCorps Clearwater members have supplemented the activities of the Downtown Bicycle Team by acting as ambassadors of the City by assisting_visitors and businesses. The intent of the community policing innovations in Downtown is for police officers to be a visible deterrent of crime as well as an approachable source of assistance and information. The officers act as liaisons to downtown visitors, businesses, employees and residents and work to build partnerships through daily visibility and community • involvement and organization. They also help solve neighborhood problems and work to foster a sense of safety and security in public as well as private spaces. Community policing innovations focus on a variety of issues including those that are unique to the CRA such as homelessness, prostitution, drugs and street crimes, and a large immig ant population. In October 2002, the Board approved the designation of the 2(J2-acre eas#em expansion to the Downtovm Redevelopment D'~striCt as a slum or blighted area and authorized the City Commission to create a redevelopment agency (for the expansion area) and to prepare a redevelopment plan. The txxmdaries of the expanded Downtown Redevelopment District are generally fangs and grew $tre~s on the north, Highland Avenue on the east, Court and Tamer Streets on the south, and GleatvYater Warbor on the west. '(see Attachment 1) The Board reviewed and approved the new Downtown Redevelopment Plan for the expanded t~develvpment District an December 7C, 2003. The new Plan lnduded some provisions from the original Redevelopment Plan that eovered the original community redevelopmgrrt district; an analysis and plans covering the expansion area of the redevelopment district; and piarts fcr two pesiphvry areas {known as Northwest Periphery and Southwest Periphery Areas) that are adjacent to,but not part of the Downtown Redevelopment District. Pursuant to Board t?esolution No. 93 248, which approved me Radevetopmettt Plan, the City is required to submit any amendm~tss to the Redevelopment Plan to the Board for consideration and approval. The Baard, on February 3, 20U4, approved amendments to Giearwater's Redevelopment Trust Pund so that the City could correct both city and county wax increments from the expansion area. In 2005, the Board approved additional amendments bo the towntown Redevetoprnent Flan. Cl1RREAlT PE''22OPC)$AL: The City of Clearwa#er proposes two basic amendments to the Clearwwater Downtown Redevelopment Plan. The first propose{ is to create a new Strategy for the Downtown Redevelopment Plan to support the location of a perfarrrring arts theater in the powntown and provide land acquisition, building , rehabilitation, -and parking facility assistance, as needed, to support such use. Furthermore, Table 7 of the Downtown Strategies will be amended accardingfiy to include a performing arts theater. (see Exhibit A of Attachment 2, Board Resolution) The second proposal is to amend the Goals, objectives, and Policies Section, the powntown Strategies Section, and the Tax Increment Revenue Projections Section of the Downtown Redevelopment Plan by including community policing innovations as a new CRA initiative for the Downtown. Community policing innovations are eligible redevelopment projects that can be funded by tax increment revenues accord"mg tv Section 463.387(6}(h), Florida Statutes. Community policing represents a variety of activities that increase the presence of 1oc~l police a visible deterrent to crime as well as provide a source of assistance and irrformatian on the street. in the past, among the firs# effort to incn~se police presence in the Redevelopment District was the placement of a police sub-stafion at the Clearwater Homeless Intervention Program (CHIP) shelter in the Fist Gateway Character District of the Downtown_ Another past effort of the City was the establishment of a Downtown (Police) Bicycle Team. The proposal is #o increase the level of community policing in the Downtown area and to pay for this police activity by budgeting $1 million from the City's portion of tax increment revenues over the remaining life of the E~owntawn R~evelopment Plan (to the Year 2034}. No County funds are being requested to turd this ini~ative. The proposed amendments to the Downtown Clearwater Redevelopment Dian are consistent with the goats, objectives, and policies of the Pinellas County Comprehensive Pian, and they meet the requirements for redevelopment plans as required by Chapter 183, Park ill, pf the Florida Statutes.
