letter dated November 21, 2002. The adopted amendment package received by the Department is incomplete
because it does not include all of-the information required in Section 163.3184, F.S. and Rule 9J-11.011,
F.A.C. Your submittal package for the adopted amendment does not include:
A copy of the ordinance adopting the comprehensive plan or amendment pursuant to Rule 9J-
11.011(5), F.A.C. for Amendment LUZ 02-02-01;
The adoption ordinance, as required by Section 163.3184(15)(a), Florida Statutes, and Rule
9J-11.011(3), Florida Administrative Code, was not executed for Amendment LUZ 01-09-08;
Please provide the City's Courtesy Information List as required by 163.3184(8)(b), F.S. (copy
enclosed); and
An explanation why Amendment 02-02-03 was not submitted with the City's adopted amendment
package.
The adopted amendment, received on November 25, 2002, will not be processed until the required

Thank you for submitting copies of the City of Clearwater's plan amendment (DCA No. 02-1)
adopted by Ordinance Nos. 6924-02 and 6972-02 on November 7, 2002 for our review.
We have conducted an inventory of the plan amendment package to verify the inclusion of all
required materials. The submission package appears to be complete and your adopted plan amendment will
be reviewed pursuant to Chapter 163, Florida Statutes. Once the review is underway, you may be asked to
provide additional supporting documentation by the review team to ensure a thorough review. The
Department will conduct a compliance review and issue a Notice of Intent regarding the adopted
comprehensive plan amendment on of about February 9: 2003.
Please be advised that Section 163:3184(8)(c)2, Florida Statutes, requires a local government that
has an Internet site to post a copy of the Department's Notice of ]ntent on the site within 5 days after receipt

The Department has completed its review of the proposed Comprehensive Plan Amendment
for the City of Clearwater (DCA No. 02-1), which was received on June 17, 2002. Copies of the
proposed amendment have been distributed to appropriate s±ate, regional and local agencies for their
review and their comments are enclosed.
The Department has reviewed the proposed amendment for consistency with Ruie 9J-5,
Florida Administrative Code (F.A.C.), Chapter 163, Part II, Florida Statutes (F.S.), and the adopted
City of Clearwater Comprehensive Plan. The Department raises no objections to the proposed
amendment, and this letter serves as the Department's Objections, Recommendations and Comments
Report.
In order to expedite the regional planning council's review of the amendments, and pursuant to
Rule 9J-11.011{5), F.A.C., please provide a copy of the adopted amendment directly to the Executive
Director of the Tampa Bay Florida Regional Planning Council.

TRANSMITTAL PROCEDURES
This letter and the enclosed external agency comments are being issued pursuant to Rule 9J-
11.010, F.A.C. Upon receipt of this letter, the City of Clearwater has 60 days in which to adopt, adopt
with changes, or determine that the City will not adopt the proposed amendment. The process for
adoption of local comprehensive plan amendments is outlined in s.163.3184, F.S., and Rule 9J-11.011,
F.A.C.
Within ten working days of the date of adoption, the City of Clearwater must submit the
following to.the Department:
Three copies of the adopted comprehensive plan amendments;
A listing of additional changes not previously reviewed;
A listing of findings by the local governing body, if any, which were not included in the
ordinance; and
A statement indicating the relationship of the additional changes to the Department's Objections,
Recommendations and Comments Report.
The above amendment and documentation are required for the Department to conduct a
compliance review, make a compliance determination and issue the appropriate notice of intent.

9J-11.006(1)(a)3: "The City of Clearwater requests the Department to review the proposed
amendments.
The substance of the amendments are to promote consistency and guidance, and to
distinguish implementation between the City's Future Land Use Element's use plan
categories. The effect is in compliance with Florida Statutes 163.3177.(6)(a).
9J-11.006(1)(a)4: The amendments are proposed for adoption subsequent to receipt of the
Department objections, recommendations, and comments report and preparation of changes
required by the report. The anticipated month of adoption is September 2002.
9J-11.0061(1)(a)5: The proposed amendment does not pertain to an area of critical state
concern.
9J-11.0061(1)(a)6: The plan amendment is not within Orange, Lake or Seminole Counties.
9J-11.0061(1)(a)7.e: The proposed plan amendment does not qualify as an exemption under
the twice per calendar year limitation on the adoption of comprehensive plan amendments. The
amendment is directly related to the Future Land Use Element pursuant to Florida Statute
163.3177.

been submitted with this letter. A copy of the proposed comprehensive plan amendments has
been transmitted to the Pinellas Planning Council, the Tampa Bay Regional Planning Council, the

Dear Mr. Conger:
This letter is in response to your July 23, 2002 letter that identified that the City's
proposed amendment package received by your department was incomplete. Please find
enclosed those items that were identified to complete all requirements of Rule 9J-11,
Florida Administrative Code.
Enclosed are the items as prescribed in Rule 9J-11, "Procedural Rule for Review of Local
Government Comprehensive Plans and Amendments." The following items are enclosed:
Copy of letter of mailing list that the proposed amendment package was mailed to
all reviewing agencies. Two letters, one dated July 16, 2002 and second letter
dated July 29, 2002 indicate the date the letters were sent to the reviewing
agencies. Please note that a copy of the proposed amendments was sent to the
Pinellas County Planning Department on July 16, 2002 and was signed for on July
17, 2002. The City will provide an additional copy to the County if the signed
copy cannot be located.
• Reference maps for proposed amendment case LUZ 01-09-08. Three (3) complete
copies are enclosed with this letter that include the future and existing land use
maps with adjoining/abutting properties shown. All reviewing agencies will be
sent a complete package for LUZ 01-09-08.

Initial transmittal package letter dated July 16, 2002.
In addition, case LUZ 02-02-03 Dimmitt Plan Amendment application was reduced from
the requested Residential-Urban Future Land Use of 7.5 units per acre to Residential Low
Future Land Use of 5.0 units per acre. This reduction in intensity was requested by the
applicant and approved by the City Commission at their public meeting. Your letter dated
July 23, 2002 indicated otherwise.
The enclosed items should complete the City's first submittal package for 2002. If you
