Also, allow direct access to a major arterial street and increase the height from 25' to 35'. WRITTEN SUBMITTAL REQUIREMENTS 1. The proposed development will be in harmony with surrounding properties as this property is located on a heavy traffic, commercial corridor and the lot area being added to the site as a result of the proposed vacation will provide ample lot area for the proposal. The request contained herein to allow direct access to a major arterial street is a "technical" request due to the fact that the access already exists for the existing Fairfield building on-site. No additional curb cuts will be added, all existing curb cuts for the site will remain. 2. The proposal should encourage the development of adjacent lands and surrounding uses as this retail space will provide additional jobs and with the hotel on the same site, the proposed business, along with local businesses in the immediate area will benefit Clearwater as a whole. 3. The proposed development will not adversely affect the health or safety of persons within the immediate area as the proposed retail center is designed to meet all setback, additional parking, all sight visibility triangles are being observed and no additional curb-cuts are being requested. 4. The proposed development will not create a traffic congestion problem. More than enough parking is being provided for the site, the curb cut along Gulf-to- Bay Blvd., although existing, is far enough from the intersection and no additional curb cuts are being added. 5. The proposed development is consistent with the character of the adjacent corridor. This is a small addition to an existing site. Retail space is an acceptable use within the current zoning district and the site being located on a major corridor intersection and not mixed in with residential is a plus. 6. No adverse impacts are anticipated to adjacent sites as a result of the request. The proposed 12,648 square foot retail building is on the corner of McMullen Booth Road and Gulf-to-Bay Boulevard. There will be plenty of low lighting for security measures and hours of operation will be consistent with those in the area. . ~ • FLEXIBILITY CRITERIA -Retail Services 1. The proposed parcel for development exceeds the required lot size and width and is not in common ownership with any contiguous property. 2. a. The height of the building is per the Land Development Code as well as landscaping buffer, parking lot interior landscaping and foundation landscaping. Since the proposed retail space is within a parcel which houses a hotel with a height of 48.33', the increase in the building height from 25' to 35' will be more consistent with the hotel building. The proposed retail center is actually 25' to the parapet with additional rooftop pavilions taking the additional 10' for a more architecturally appealing building. This will reduce the boxed look. b. The increased height will not reduce the vertical component of the view from any contiguous residential property. The site is situated on a busy intersection and a 27' landscape buffer (existing, established 26 dbh & larger trees will remain along with additional landscaping to buffer the building from the residential home west of Bay Street. 3. a. The contiguous owned property is 191,097 sf and consists of the construction of an additional retail building with associated parking, road infrastructure, storm management system and utilities and results in the following: • Removal of 15,564 S.F. of impervious vehicular use area Construction of 39,534 S.F. of impervious vehicular use area and 17,505 S.F. of new building and sidewalk. This will yield a 23,970 S.F. INCREASE of impervious vehicular use area and overall there will be a 57,039 S.F. INCREASE in total impervious area. Design Criteria Discharge is into the City of Clearwater storm system and the design criterion is the more stringent of the City of Clearwater's and SWFWMD storm requirements. The more stringent requirement results in a minimum pond volume based on the Clearwater's requirement that the 25yr peak post-development discharge is attenuated so that the 25yr peak pre-development discharge is not exceeded at a time of concentration of 60 minutes. In addition only 50% of the existing impervious prior to the existing pond being built is eligible for credit. '/2" of water quality and 6" of freeboard will be provided between the highest design stage and top of pond. Water Quality Treatment 1/2" water quality treatment over the total rainage area of 191,097 sf yielding a total requirement volume of 7,962 cf is provided in the detention pond which has a volume capacity of 8,304 cf between elevations 7.00 and 7.80. This water quality volume is filtered through 110 I.f. of 6" underdrain within 22.0 hours of the end of the rainfall event. Water Quantity Attenuation Water quantity attenuation was provided so that the pre-development peak discharge rate prior to the construction of the current storm water and taking credit for'/2 of the impervious at that time is not exceeded by the built-out post-development peak discharge rate for the 25 year storm. This modification, Construction Permit No. 44021050.001, amends the previously issued Construction Permit No. 44021050.000, and adds conditions. All other original permit conditions remain in effect. 7. This permit is issued based upon the design prepared by the Permittee's consultant. If at any time it is determined by the District that the Conditions for Issuance of Permits in Rules 40D-4.301 and 40D-4.302, F.A.C., have not been met, upon written notice by the District, the Permittee shall obtain a permit modification and perform any construction necessary thereunder to correct any deficiencies in the system design or construction to meet District rule criteria.
