On August 31, 2006, the Development Review Committee (DRC) reviewed your application for Flexible Standard Development approval for a Retail Sales and Service use in the Commercial (C) District. The request includes a reduction to the front (north) setback from 25 feet to 15 feet (to pavement) and an increase in building height from 25 feet to 30 feet under the provisions of Section 2-703.R. The DRC recommended approval of the application with the following bases and conditions: Bases for Approval: 1. The proposal complies with the Retail Sales and Services criteria under the provisions of Section 2- 703.R.; 2. The plan complies with General Applicability Criteria under the provisions of Section 3-913; and 3. The proposed development is compatible with the surrounding area. Conditions of Approval: 1. That all signage must be permitted separately and the entire site must comply with the current sign code; 2. That the entire site be architecturally compatible with regard to but not limited to style, color and architecture; 3. That all building colors and architecture are consistent with the submitted plans; 4. That all landscaping be installed per the proposed plan; 5. That a Tree Preservation and Demolition Plan including root preservation be submitted to, and satisfy the Land Resource Specialist prior to building permit; and 6. The approval is based on and must adhere to the application received July 28, 2006 and other supporting documents received Apri12, 2007. Pursuant to Section 4-303, an application for a building permit shall be made within one year of Flexible Standard Development approval (August 31, 2007). All required certificates of occupancy shall be obtained within one year of the date of issuance of the building permit. Time frames do not change with successive owners. The issuance of this Development Order does not relieve you of the necessity to obtain any building permits or pay any impact fees that maybe required. POLLACK and H. SARA GOLDING SC'I-lER (collectively, the "Trustee"), which designation shall include all successor trustees, and SUNSET SQUARE GENERAL PARTNERSHIP, a Florida general partnership (the "Beneficiary"), which designation shall include all successors in interest to any beneficiary or beneficiaries. WITN$SSETH: WHEREAS, Loren M. Pollack and Robert M. Golding are co-trustees of that certain Trust Agreement created for the benefit of Sunset Square General partnership, a Florida general partnership (the "Trust Agreement"); and WI~REAS, Trustee acquired the fee simple title to property located in Pinellas County, Florida, more particularly described in Exhibit ~°A" attached hereto and made a part hereof (the "Pro a "); and WHEREAS, Roberta M. Golding desires to resign as co-trustee under the Trust Agreement and name as her replacement, H. Sara Golding Scher; and WI~REAS, H. Sara Golding Scher has agreed to replace Roberta M. Golding, as co-trustee, and Loren M. Pollack has agreed to continue to act as co-trustee; and, WHEREAS, to evidence the change in identity of one of the co-trustees of the Trust as a matter of the Public Records of Pinellas County, Florida, the Initial Successor Trustees will convey the Property by deed to Trustee so that, when Trustee has taken title to the Property, and to any other property conveyed to Trustee under this Agreement, Trustee will hold the title, in trust, for the uses and purposes and subject to the terms and conditions hereinafter set forth; and, WHEREAS, it is advisable and in the best interests of the parties to amend and restate the Original Trust Agreement on the terms and conditions set forth in this Trust Agreement; WHEREAS, it is fiuther the intent of Trustee to take and hold title to the Property in accordance with the provisions of Section 689.071, Florida Statutes; and, NOW, THEREFORE, for and in consideration of the premises and the mutual covenants set forth in this Trust Agreement, the parties, each intending to be legally bound, hereby agree and declare as follows: 1. Pro e .Title to the Property shall be conveyed to Trustee in accordance with and the rights of the parties shall be governed (to the extent applicable) by, the provisions of Section 689.071, Florida Statutes. Trustee agrees to accept the deed to the property and to cause the deed to be recorded in the Public Records of Pinellas County, Florida, and to hold title to the properly for the uses and purposes herein stated. Beneficiary shall advance to Trustee all funds required by Trustee to record the deed, including, but not limited to, all appropriate documentary stamp taxes. Beneficiary may not dedicate or cause any other property to be conveyed to Trustee under this Trust Agreement unless Trustee consents to such action in writing. Should other property subsequently be conveyed to and held by Trustee pursuant to this Trust Agreement, the term "property" as used herein shall mean and refer to all property, the title to which is held by Trustee pursuant to this Trust Agreement. 2. Identity. Interest and Rights of Beneficiary: (a) The following is the Beneficiary of this Trust, and as such shall be entitled to all of the earnings, avails and proceeds of the trust properly according to the percentage interest set forth opposite its name: NAME OF BENEFICIARY INTEREST IN TRUST SUNSET SQUARE GENERAL PARTNERSHIP 100% (b) The interest of Beneficiary shall consist solely of the following rights respecting the trust property; (1) Power to direct Trustee to deal with title to the Property, which power shall include, but is not limited to, directions to Trustee to execute deeds, leases, mortgages, promissory notes and all other instruments relating to the Property, provided, however, as set forth in paragraph 22 of this Trust Agreement, Trustee shall have no individual liability whatsoever, nor shall Trustee be required to furnish any warranties that would result in any individual liability in regard to the execution of any such instruments. (2) Power to manage, possess, use and control the Property. (3) Right to receive the earnings, avails and proceeds from leases and other uses and from mortgages, sales and other dispositions of the Property. (4) Enjoyment of all rights and privileges regarding the Property as if Beneficiary was the legal and equitable owner of the Property. Such rights and powers, as well as the interest of Beneficiary under this Trust Agreement, shall be personal property. Beneficiary shall not have any right, title or interest in or to any portion of the legal or equitable title to the Property. Dissolution of Beneficiary, or the death or dissolution of any of the partners of Beneficiary, shall not terminate this Trust Agreement or the trust created hereby or affect the rights or powers of Trustee. The interest of Beneficiary under this Trust Agreement shall pass to the persons or entities entitled to receive the assets of Beneficiary upon its dissolution. 3. Obligation of Trustee with Respect to Properly. Beneficiary shall make all returns and reports and pay all real estate and all other taxes, assessments, fees or charges payable with respect to the Property, the earnings, avails and proceeds of the Property, and Beneficiary's interest under this Trust Agreement. Trustee shall have no obligation to file any income, profit or other tax reports or returns or pay such or any other taxes relating to the Properly; provided, however, that Trustee shall have the right (but not the obligation) to file any tax return or pay taxes relating to the Property which it, in its absolute discretion, deems should be filed by it. In such event, Beneficiary will cooperate with Trustee in providing such information as is necessary for the proper and correct preparation of such return and Beneficiary shall promptly pay to Trustee the amount of such taxes, as set forth in paragraph 12 hereof. 4. Objects and Purposes of Trust. The objects and purposes of this Trust shall be to hold title to the Property until the sale or other disposition of the Properly, revocation of this Trust Agreement as provided in Paragraph 26 hereof, or expiration of this Trost Agreement as provided in paragraph 20 hereof. Trustee shall not manage or operate the Property, nor undertake any other activity not strictly necessary to the attainment of the foregoing objects and purposes, nor shall this Agreement be deemed to be, or create or evidence the existence of a corporation (de facto or de 'ure , a Massachusetts Trust or any other type of business trust, an association in the nature of a corporation, or a partnership or joint venture by or between Trustee and Beneficiary. 5. Beneficiary Manages and Operates Trust PronertX. Beneficiary, either in its own name or through its agent(s), shall have the sole possession, management and control of the selling, renting, repairing, maintaining and handling of the Property and Trustee shall have no right or duty in respect to such matters unless specifically instructed by Beneficiary. Beneficiary shall have the right to execute leases and collect rents in its own name or through its agents. Protection of Third Parties Dealing with Trustee. (a) No party dealing with Trustee in relation to the Property in any manner whatsoever, and (without limiting the foregoing) no party to whom the Property or any part of it or any interest in it shall be conveyed, contracted or sold, leased or mortgaged by Trustee, shall be obliged: (1) to see to the application of any purchase money, rent or money borrowed or otherwise advanced on the Property; (2) to see that the terms of this Trust Agreement have been complied with; (3) to inquire into the authority, necessity or expediency of any act of Trustee; or (4) to inquire into any of the terms of this Trust Agreement (nor shall any such party be privileged to do so). (b) Every deed, mortgage, lease or other instrument executed by Trustee in relation to the Property shall be conclusive evidence in favor of every person claiming any right, title or interest under the Trust that: (1) at the time of its delivery the Trust was in full force and effect; (2) the instrument was executed in accordance with the terms and conditions of this Trust Agreement and all its amendments, if any, and is binding upon all beneficiaries under it; (3) Trustee was duly authorized and empowered to execute and deliver each such instrument; and, (4) if a conveyance has been made to a successor or successors in trust, that the successor or successors have been appointed properly and are vested fully with all the title, estate, rights, powers, duties and obligations of its, his or their predecessor in trust. 7. Trust Agreement not to be Recorded. This Agreement shall not be placed on record in the county in which the Property is situated, or elsewhere; but if it is recorded, such recording shall not be considered as notice of the rights of any person under this Agreement derogatory to the title or powers of Trustee. 8. Beneficiary Cannot Bind Trustee or Other Beneficiary. No Beneficiary shall have the authority to contract for or in the name of Trustee, unless Trustee expressly consents in writing. 9. Forbiddinu Use of Name of Trustee for Publicity. The name of Trustee shall not be used by Beneficiary in connection with any advertising or other publicity whatsoever without the written consent of Trustee. 10. Insurance. Beneficiary shall during the term of this Trust Agreement maintain and purchase at its expense insurance either in the name of Trustee or showing Trustee as an additional insured thereunder, with such insurance to protect Trustee against public liability in the amount of not less than $1,000,000.00 (single limit) and to protect Trustee against such other hazards or liabilities as Trustee may reasonably require and in such amounts as Trustee may reasonably require. All such insurance shall be written on insurance companies reasonably acceptable to Trustee. At the request of ORIGINAL RECEIVED -3- JUL 2 8 2006 PLANNING DEPARTMENT CITY OF CLEARWATER • Trustee, certificates reflecting such coverage to be in effect currently shall be delivered to Trustee. All policies of insurance and certificates shall contain a provision that thinly (30) days notice shall be given to Trustee by the insurance company issuing such policies prior to cancellation or tennination of such policies of insurance. In the event Beneficiary fails to make any payment for premiums on such policies of insurance Trustee may, but is not required to, make such payment and such payment shall be considered an advance made by Trustee under the provisions of paragraph 12 of this Trust Agreement. 11. Multiple Beneficiaries. In the event that, now or at any time hereafter, the term "Beneficiary" as used in this Trust Agreement includes more than one beneficiary, then, in that event, all persons included in the term "Beneficiary" shall be jointly and severally liable for the obligations of Beneficiary under this Trust Agreement. 12. Trustee Responsibility to Make Advances or Incur or Pay Expenses. (a) Trustee shall have the right, but not the duty, to make any advances or incur or pay any expenses on account of this Trust Agreement or the Property, If Trustee shall make any such advances or incur or pay any such expenses on account of this Trust Agreement of the Property, or shall incur any expenses by reason of being a party to any litigation in connection with this Trust Agreement or the Property, or if Trustee shall be compelled to pay money on account of this Trust Agreement or the Property, whether for breach of contract, injury to person or property, taxes of any kind, fines or penalties under any law, or otherwise, in any manner under this Trust Agreement, then Beneficiary, on demand by Trustee, shall pay to Trustee, together with interest computed on a daily basis at an annual rate equal to three percent (3%) in excess of the prime rate of interest published in the Wall Street Journal, the amount of all such expenses, advances or payments made by Trustee, plus all of the trustee's expenses, including attorneys' and paralegal assistants' fees incurred by Trustee in such matters, including attorneys' and paralegal assistants' fees for representation through any appeals. (b) Trustee shall have the right, but not the duty, to employ and consult with attorneys regarding Trustee's rights, obligations and liabilities under this Trust Agreement and the Property, and any and all costs and expenses incurred by Trustee by virtue of such employment and consultation shall be deemed to be an advance or expense made or incurred by Trustee under this paragraph to be paid by Beneficiary on demand. Any other funds expended by Trustee under any other provision of this Trust Agreement shall also be deemed to be an advance made by Trustee under this paragraph 12. Beneficiary further agrees to indemnify and hold Trustee harmless of and from any and all expenses, including but not limited to, all costs and attorneys' fees, advances, payments or liabilities incurred by it for any reason whatsoever as a result of this Trust Agreement or Trustee holding legal title to the Property under this Trust Agreement. (c) Trustee shall not be obliged to convey, transfer or otherwise deal with the Property or any part of it or to follow any instructions of Beneficiary unless and until all of the payments, advances and expenses made or incurred or paid by Trustee on account of this Trust Agreement or the Property shall have been paid, with interest at the rate set forth herein. Further, after making written demand on Beneficiary to pay to Trustee all payments, advances and expenses made or incurred by Trustee on account of this Trust Agreement or the Property, Trustee shall be entitled to and shall have a lien on the Property to secure all such payments, advances and expenses, together with interest thereon at the rate set forth herein and all costs and expenses, including attorneys' fees, which Trustee may incur or become liable for in collecting such amounts from Beneficiary. 13. Trustee Responsibility with Resroect to Leal Proceeding. Trustee shall be under no duty to take any action, to pay any money or to incur any expenses in regard to any legal proceeding involving this Trust Agreement or the Property unless it shall elect, in its absolute discretion, to do so. As a condition of such action, Trustee must first be funushed with cuff cient funds or be indemnified to its satisfaction by Beneficiary. If Trustee is served with process or notice of legal proceedings or of any other matters concerning this Trust Agreement or the Property, the sole duty of Trustee shall be to forward the process or notice to Beneficiary. In such case, Beneficiary shall defend such action in the name of Trustee with counsel reasonably acceptable to Trustee; provided, however, that Trustee may at any time resign as such under this Trust Agreement or personally appear in such proceeding. (a) Either or both of the trustees who are included in the meaning of the terns "Trustee" under this Tnast Agreement may resign at anytime by giving written notice of such intention to resign to Beneficiary. The resignation shall become effective after Trustee has executed any and all documents furnished to the either or both of the trustees by Beneficiary and satisfactory to Tnistee for execution, which documents shall be for the purpose of conveying to any successor trustee all existing rights of Trustee under this Trust Agreement and title to the Property; provided, however, that such resignation shall become effective no later than thirty (30) days after notice of resignation has been delivered to Beneficiary. ff Trustee is advised in writing by Beneficiary as to who the successor trustee is to be, Trustee has the right, but not the duty, to prepare, execute, deliver and/or record any and all documents which are necessary, in the absolute discretion of Trustee, to convey or transfer title to the Property to such successor trustee. If notice of the successor trustee is not given to Trustee in writing within twenty (20) days after notice of resignation has been delivered to Beneficiary or if Beneficiary fails to furnish documents satisfactory to Trustee for execution within twenty (20) days after notice of resignation has been delivered to Beneficiary, Trustee may convey title to the Property to Beneficiary and the deed of conveyance may be recorded by Trustee. Notwithstanding the resignation by Trustee as provided herein, Beneficiary shall, upon such resignation, immediately pay to Trustee all payments, advances or expenses made or incurred by Trustee in regard to this Trust Agreement or the Property and Trustee shall continue to have a lien on the Properly to secure the payment of such sums as set forth in pazagraph 12, which lien Trustee may evidence by causing to be recorded in the Public Records of Hillsborough County, Florida, a notice of lien specifying the amount of money owed to it by Beneficiary. Trustee may thereafter enforce its lien against the Property by appropriate judicial proceeding and, in such proceeding, Trustee shall be entitled to recover from Beneficiary, and the same shall be a lien on the Property, all its costs and expenses, including attorneys' and pazalegal assistants' fees and costs. (b) Upon the death or incapacity of either of the two trustees included in the meaning of the term "Trustee," the survivor of them shall continue to act as Trustee until a successor to the deceased or incompetent trustee is appointed by Beneficiary. ff both of the trustees die or become incompetent, Beneficiary will immediately appoint a successor or successor trustees to act as Trustee under this Trust Agreement. Beneficiary will be responsible for taking such action and/or preparing such documents as may be necessary to cause the public records of Hillsborough County, Florida to reflect the true identity of the new Trustee. 15. Amendment of Tnust A Bement. This Agreement contains the entire understanding between the parties and maybe amended only by a written agreement signed by Trustee and Beneficiary. 16. Florida Law Governs. This Agreement shall be construed, governed, interpreted and enforced in accordance with the laws of the State of Florida. 17. Notices. Any notice which must or may be given under this Trust Agreement or by any applicable law shall be in writing and shall be deemed given on the date hand delivered, or one day after deposit in Federal Express or other guazanteed overnight courier, or three (3) business days after deposit in the United States Mail, certified or registered, return receipt requested. Certified Copies Satisfactory Evidence. Copies of this Trust Agreement or any amendment to it, certified by Trustee to be true and correct, shall be satisfactory evidence of such Trust Agreement for all purposes. 19. Successors Bound by this Agreement. The terms and conditions of this Agreement shall inure to the benefit of and be binding upon any successor trustee under it, as well as upon the personal representatives, administrators, heirs, assigns and all other successors in interest of Beneficiaries. Every successor trustee shall become fully vested with all the title, estate, rights, powers, trusts and shall be subject to the duties and obligations of its predecessor under this Trust Agreement. The term Trustee shall thereafter mean and refer to such successor trustee. 20. Term. The term of this Trust Agreement shall be for a period of twenty (20) years from the date of this Trust Agreement, unless sooner revoked as otherwise provided in this Trust Agreement. Upon expiration of this Trust Agreement, Trustee shall convey the Property to Beneficiary, unless Trustee and Beneficiary have agreed to an extension of the term of this Trust Agreement. 21. Trustee Acts Only on Written Authorization. It is agreed by the parties hereto that Trustee will deal with the Property, including cash or other assets of any kind which may become subject to this Trust Agreement, only when authorized and directed to do so in writing by Beneficiary. On the written direction of Beneficiary, Trustee shall execute deeds for, or mortgages or trust deeds (which may include a waiver of the right of redemption from sale under an order or decree of foreclosure) or execute leases all in regard to the Property or otherwise deal with the title to the Properly, including cash or other assets subject to this Trust Agreement. All documents to be executed by Trustee shall be prepared by Beneficiary and furnished to Trustee with written directions by Beneficiary to execute and redeliver such documents to Beneficiary or to any third person or persons. Trustee shall not be obligated to execute any instrument which may, in the opinion of Trustee, result in personal liability to Trustee and rather than executing any instruments under this paragraph, Trustee may resign as Trustee under this Trust Agreement as provided in pazagraph 14. In the event Trustee so resigns, Trustee shall be under no duty to execute any instruments other than instruments provided in paragraph 14 regarding conveyance of title to the Property. Trustee shall not be required to inquire into the propriety of any written direction by Beneficiary or the authority of the person signing such directon. To the extent Trustee follows any written direction received from Beneficiary, including, but not limited to, the execution and delivery by Trustee in accordance with written direction of Beneficiary of any deed or other instrument relating to the Property, Trustee shall have no duty, liability or obligation whatsoever. Beneficiary shall indemnify and hold Trustee harmless from and against all claims, demands, costs and expenses (including attorneys' fees and costs), losses, liabilities and obligations which Trustee may pay, incur or sustain by virtue of Trustee following such written instructions. 22. Trustee Not Individuall Liable. Trustee shall have no individual liability or obligation whatsoever arising from its ownership of or holding legal title to the Property, or with respect to any act done or contract entered into or indebtedness incurred by it in dealing with the Property or in otherwise acting under this Trust Agreement upon the direction of Beneficiary, except only so far as the Property and any trust funds in the actual possession of Trustee shall be applicable to the payment and discharge of such liability or obligation. Upon receipt of notice of revocation, Trustee shall convey title to the Property in accordance with the procedures set forth in paragraph 14 of this Trust Agreement. 27. Residency of Beneficiary. Beneficiary represents that it is a Florida general partnership, duly organized and authorized to act as Beneficiary under this Trust. 28. Assignment of Beneficial Interest. Beneficiary may not assign any or all of its interest as Beneficiary under this Trust Agreement unless and until both of the following two (2) conditions have been met: (a) The original or executed duplicate of an assignment subscribed in the presence of two witnesses is delivered to Trustee and Trustee has accepted in writing such assignment; provided, however, that Trustee shall be under no duty or obligation whatsoever to so accept any assignment, and Trustee may in its absolute discretion determine whether or not to accept such assignment and may in its discretion reject such assignment; and (b) The assignee of any beneficial interest agrees in writing to be bound by all the duties and obligations of Beneficiary under this Trust Agreement including, but not limited to, the duty and obligation to pay to Trustee all advances and expenses set forth in paragraph 12. Upon the acceptance by Trustee of an assignment as set forth in subparagraphs (a) and (b) hereof, the Beneficiary so assigning its interest under this Trust Agreement shall have no further liability or obligation under this Trust Agreement but only for any acts of Trustee taken or performed after the acceptance by Trustee of such assignment, provided such assignment conveys the entire interest of such assigning Beneficiary under this Trust Agreement. Beneficiary shall continue to be liable for matters occurring prior to the acceptance by Trustee of such Assignment. Every assignment of any beneficial interest, the original or duplicates of which shall not have been delivered to and accepted by Trustee in writing, shall be wholly ineffective as to Trustee and all subsequent assignees or purchasers without notice. 29. Leakage tests are specified requiring that: 1) the leakage exfiltration or infiltration does not exceed 200 gallons per inch of pipe diameter per mile per day for any section of the system; 2) exfiltration or i~ltration tests be performed with a minimum positive head of 2 feet; and 3) air tests, as a minimum, conform to the test procedure described in ASTM C- 828 for clay pipe, ASTM C 924 for concrete pipe, ASTM F-1417 for plastic pipe, and for other materials appropriate test procedures. Design provides sufficient head and appropriate pipe sizes to secure velocities of at least 3.0 fps for design average flows. Inside drop connections (when necessary) are designed to be secured to the interior wall of the manhole and provide access for cleaning. Specified construction materials are appropriate under conditions of exposure to hydrogen sulfide and other corrosive gases, greases, oils, and other constituents frequently present in wastewater. [RSWF 42.25] 41. Except for low-pressure grinder or STEP systems, multiple pumps are specified, and each pump has an individual intake. Where only two units are specified, they are of the same size. Specified units have capacity such that, with any unit out of service, the remaining units will have capacity to handle the design peak hourly flow. [RSWF 42.31 and 42.36] 42. Bar racks are specified for pumps handling wastewater from 30 inch or larger diameter sewers. Where a bar rack is specified, a mechanical hoist is also provided. The design includes provisions for appropriate protection from clogging ~j~~ for small pump stations. [RSWF 42.322] !%~.t'/ 43. Pumps handling raw wastewater are designed to pass spheres of at least 3 inches in diameter. Pump suction and discharge openings are designed to be at least 4 inches in diameter. The design requires: 1) suitable shutoff valves be placed on the suction line of dry pit pumps; 2) suitable shutoff and check valves be placed on the discharge line of each pump (except on screw pumps); 3) a check valve be located between the shutoff valve and the pump; 4) check valves be suitable for the material being handled; 5) check valves be placed on the horizontal portion of discharge piping (except for ball checks, which maybe placed in the vertical run); 6) all valves be capable of withstanding normal pressure and water hammer; and 7) all shutoff and check valves be operable `~~ from the floor level and accessible for maintenance. [RSWF 42.5] 51. The effective volume of wet wells is based on design average flows and a filling time not to exceed 30 minutes unless the facility is designed to provide flow equalization. The pump manufacturer's duty cycle recommendations were utilized in selecting the minimum cycle time. [RSWF 42.62] ~~ 52. The design requires wet well floors have a minimum slope of 1 to 1 to the hopper bottom and the horizontal area of hopper bottoms be no greater than necessary for proper installation and function of the inlet. For covered wet wells, the design provides for air displacement to the atmosphere, such as an inverted " j" tube or other means. [RSWF 42.64] `~~ 54. The design provides for adequate ventilation all pump stations; mechanical ventilation where the dry well is below the ground surface; permanently installed ventilation if screens or mechanical equipment requiring maintenance or inspection are located in the wet well. Pump stations are designed with no interconnection between the wet well and dry well ventilation systems. [RSWF 42.71] 55. The design requires all intermittently operated ventilation equipment to be interconnected with the respective pit lighting system and the manual lighting/ventilation switch to override the automatic controls. [RSWF 42.73] 56. The design requires the fan wheels of ventilation systems be fabricated from non-sparking material and automatic heatin \~ and dehumidification equipment be provided in all dry wells. [RSWF 42.74] J~ 57. If wet well ventilation is continuous, design provides for at least 12 complete 100% fresh air changes per hour; if wet well ventilation is intermittent, design provides for at least 30 complete 100% fresh air changes per hour; and design requires air to be forced into wet wells by mechanical means rather than solely exhausted from the wet well. [RSWF 42.75] g 58. If dry well ventilation is continuous, design provides at least 6 complete 100% fresh air changes per hour; and dry well ventilation is intermittent, design provides for at least 30 complete 100% fresh air changes per hour, unless a system of two speed ventilation with an initial ventilation rate of 30 changes per hour for 10 minutes and automatic switch over to 6 changes per hour is used to conserve heat. [RSWF 42.76] ~~ 59. Pump stations are designed and located on the site to minimize adverse effects from odors, noise, and lighting. [62- 604.400(2)(c), F.A.C.] /~ 60. The design requires pump stations be enclosed with a fence or otherwise designed with appropriate features to discourage the entry of animals and unauthorized persons. Posting of an unobstructed sign made of durable weather resistant material at a location visible to the public with a telephone number for a point of contact in case of emergency is specified. [62-604.400(2)(d), F.A.C.] ~d~ 61. The design requires suitable devices for measuring wastewater flow at all pump stations. Indicating, totalizing, and recording flow measurement are specified for pump stations with a 1200 gpm or greater design peak flow. [RSWF 42.8] `~~ 62. The project is designed with no physical connections between any potable water supplies and pump stations. If a potable water supply is brought to a station, reduced-pressure principle backflow-prevention assemblies are specified. [R5WF 42.9 and 62-555.30(4), F.A.C.] Additional Items to be Completed for Suction-Lift Pumn Stations ~~~ 63. The design requires all suction-lift pumps to be either self-priming or vacuum-priming and the combined total of dynamic suction-lift at the "pump off' elevation and required net positive suction head at design operating conditions not to exceed 22 feet. For self-priming pumps, the design requires: 1) pumps be capable of rapid priming and repriming at the "lead pump on" elevation with self-priming and repriming accomplished automatically under design operating conditions; 2) suction piping not to exceed the size of the pump suction or 25 feet in total length; and 3) priming lift at the "lead pump on" elevation to include a safety factor of at least 4 feet from the maximum allowable priming lift for the specific equipment at design operating conditions. For vacuum-priming pump stations, the design requires dual vacuum pumps capable of automatically and completely removing air from the suction-lift pumps and the vacuum pumps be adequately protected from damage due to wastewater. [RSWF 43.1] ~~~ 64. The design requires: 1) suction-lift pump equipment compartments to be above grade or offset and to be effectively isolated from the wet well to prevent a hazardous and corrosive sewer atmosphere from entering the equipment compartment; 2) wet well access not to be through the equipment compartment and to be at least 24 inches in diameter; 3) gasketed replacement plates be provided to cover the opening to the wet well for pump units to be remove for service; and 4) no. valuing be located in the wet well. In submersible pump stations, the design requires the motor control center to be located outside the wet well, readily accessible, and protected by a conduit seal or other appropriate measures meeting the requirements of the National Electrical Code, to prevent the atmosphere of the wet well from gaining access to the control center. If a seal is specified, the motor can be removed and electrically disconnected without disturbing the seal. The design requires control equipment exposed to weather to meet the requirements of weatherproof equipment NEMA 3R or 4. [RSWF 44.32] ~f~j~ Additional Items to be Completed for Submersible Pump Stations ~~~' 65. Submersible pumps and motors are designed specifically for raw wastewater use, including totally submerged operation during a portion of each pump cycle and to meet the requirements of the National Electrical Code for such units. Provisions for detecting shaft seal~failure or potential seal failure are included in the design. [RSWF 44.1] 66. The design requires submersible pumps be readily removable and replaceable without dewatering the wet well or disconnecting any piping in the wet well. [RSWF 44.2] . 67. In submersible pump stations, electrical supply, control, and alarm circuits are designed to provide strain relief; to allow disconnection from outside the wet well; and to protect terminals and connectors from corrosion by location outside the wet well or through use of watertight seals. [RSWF 44.31] 69 In submersible pump stations, the design requires: 1) pump motor power cords be flexible and serviceable under conditions of extra hard usage and to meet the requirements of the National Electrical Code standards for flexible cords in wastewater pump stations; 2) ground fault interruption protection be used to de-energize the circuit in the event of any failure in the electrical integrity of the cable; and 3) power cord terminal fittings be corrosion-resistant and constructed in a manner to prevent the entry of moisture into the cable, provided with strain relief appurtenances, and designed to facilitate field connecting. [RSWF 44.33] In submersible pump stations, the design requires all shut-off and check valves be located in a separate valve pit. Provisions to remove or drain accumulated water from the valve pit are included in the design. [RSWF 44.4] M ~~ 70. `"lid 71. Emergency Operations for Pump Stations Pump stations are designed with an alarm system which activates in cases of power failure, sump pump failure, pump failure, unauthorized entry, or any cause of pump station malfunction. Pump station alarms are designed to be telemetered to a facility that is manned 24 hours a day. If such a facility is not available and a 24-hour holding capacity is not provided, the alarm is designed to be telemetered to utility offices during normal working hours and to the home of the responsible person(s) in charge of the lift station during off-duty hours. Note, if anaudio-visual alarm system with a self-contained power supply is provided in lieu of a telemetered system, documentation is provided in Part II.C. showing an equivalent level of reliability and public health protection. [RSWF 45] 72. The design requires emergency pumping capability be provided for all pump stations. For pump stations that receive flow from one or more pump stations through a force main or pump stations discharging through pipes 12 inches or larger, the design requires uninterrupted pumping capability be provided, including an in-place emergency generator. Where portable pumping and/or generating equipment or manual transfer is used, the design includes sufficient storage capacity with an alarm system to allow time for detection of pump station failure and transportation and connection of emergency equipment. The design requires: 1) emergency standby systems to have sufficient capacity to start up and maintain the total rated running capacity of the station, including lighting, ventilation, and other auxiliary equipment necessary for safety and proper operation; 2) special sequencing controls be provided to start pump motors unless the generating equipment has capacity to start all pumps simultaneously with auxiliary equipment operating; 3) a riser from the force main with rapid connection capabilities and appropriate valuing be provided for all pump stations to hook up portable pumps; and 4) all pump station reliability design features be compatible with the available temporary service power generating and pumping equipment of the authority responsible for operation and maintenance of the collection/transmission system. [RSWF 46.44] Force Mains 78. Force mains are designed to maintain, at design pumping rates, a cleansing velocity of at least 2 feet per second. The minimum force main diameter specified for raw wastewater is not less than 4 inches. [RSWF 48.1] 79. The design requires: 1) branches of intersecting force mains be provided with appropriate valves such that one branch maybe shut down for maintenance and repair without interrupting the flow of other branches; and 2) stubouts on force mains, placed in anticipation of future connections, be equipped with a valve to allow such connection without interruption of service. [62-604.400(2)(f), F.A.C.] 80. The design requires air relief valves be placed at high points in the force main to prevent air locking. [RSWF 48.2] 81. Specified force main pipe and joints are equal to water main strength materials suitable for design conditions. The force main, reaction blocking, and station piping are designed to withstand water hammer pressures and stresses associated with the cycling of wastewater pump stations. [RSWF 48.4] 82. When the Hazen and Williams formula is used to calculate fi-iction losses through force mains, the value for "C" is 100 for unlined iron or steel pipe for design. For other smooth pipe materials, such as PVC, polyethylene, lined ductile iron, the value for C does not exceed 120 for design. [RSWF 48.61] 83. Where force mains are constructed of material, which might cause the force main to be confused with potable water mains, specifications require the force main to be clearly identified. [RSWF 48.7] 84. Leakage tests for force mains are specified including testing methods and leakage limits.
