On August 3, 2006, the Development Review Committee (DRC) reviewed your application for Flexible Standard Development approval to allow an accessory alcoholic beverage sales use in the Commercial District, per Section 2-703.C. The DRC recommended approval of the application with the following bases and conditions: Bases for Ap rp oval: 1. The proposal complies with the Alcoholic Beverage Sales criteria under the provisions of Section 2-703.C.; 2. The plan complies with General Applicability Criteria under the provisions of Section 3-913; and 3. The proposed development is compatible with the surrounding area. Condition of Ap rp oval: 1. That all signage meet Community Development Code requirements and be consistent with the attached signs currently on the building; 2. That all required Occupational Licenses be obtained; and 3. That the Fire Department requirement be met prior to the issuance of any building permits. I concur with the findings of the Development Review Committee and, through this letter, approve your application for Flexible Standard Development with the above conditions. The approval is based on and must adhere to the application received June 30, 2006 and other supporting documents received August 16, 2006. Pursuant to Section 4-303, an application for a building permit shall be made within one year of Flexible Standard Development approval (August 21, 2007). All required certificates of occupancy shall be obtained within one year of the date of issuance of the building permit. Response: Fire specifications will be submitted with the permit application once the planning case is approved. Door will have aself-closing device installed. Solid Waste: That dumpster enclosure(s) needs to brought up to City specifications, and shown on site plan not blocked by parking spaces. Response: The landlord/owner for the property (George Alexiou) currently has a permit outstanding to complete the dumpster area upgrade. The landlord has received the comments of the DRC on this planning case. Mr. Glen agreed that this comment would not hold-up this planning case. Planning: 1. Site Plan indicates 41 parking spaces available, site visit shows 34 available. Two are blocked by Two Buks and four are blocked by advertising trailers on the south side. Not sure where the other one is missing? Revise site plan. All blocked parking spaces must be made available 24 hours a day. 2. Justify any parking reduction request by a parking demand study approved by the Planning Department. 3. Replace sod on southwest corner and any other landscape in decline/missing. Remove all trash and debris from the landscape (beer .bottles, paper, etc) and provide a plan to remedy this problem. 4. Provide a-means for prohibiting parking by patrons on City property to the north of the establishment. (Signs, fence?) 5. Provide hours of operation for the package store. Response: 1. Site Plan is off by one parking space on the east side of the parking lot. A revised Site Plan and Site Data Table are attached to this response showing 40 parking spaces (not 41). The two parking spaces "blocked" by Two Buks are actually spaces reserved for motorcycle parking., the signs have been broken off the poles. The spots reserved for motorcycle parking are-wider than other spaces, allowing 6-8 motorcycles to park in these spaces. The "Reserved for Motorcycle Parking"signs-have been replaced (photos attached). On rainy days, when motorcycles are not on the road, the signposts are removed from the spaces to allow for additional cars. Hercules (Bed Store), this trailer was removed from the properly on Wednesday 8/9/06: The other trailer belongs to-the tenant at 1901 N Hercules (Jewelry/Pawn Store), this trailer s.used on a regular basis to transport items to various shows, the trailer has been moved so that it occupies only one space.
