On-March 30, 2006 the Development Review Committee (DRC) reviewed your application for Flexible Standard Development approval to reduce the required side (west) setback from five feet to zero feet (to new shared driveway) at 309 Jasmine Way and a reduction to the side (east) setback from five feet to zero feet to an existing driveway at_ 307 Jasmine Way in the Low Medium Density Residential District (LMDR) under the provisions of Section 203.B. The DRC recommended approval of the application with the following bases and conditions: Bases for Approval 1. The proposal complies with the Flexibility criteria for detached dwellings under the provisions of Section 2-203.B.3; 2. The plan complies with General Applicability Criteria under the provisions of Section 3-913; and 3. The proposed development is compatible with the surrounding area. Conditions for Approval: 1. That prior to building permit, the request for a release of unity of title be completed; 2. That prior to building permit an easement be recorded regarding the shared driveway; 3. That any future pool and associated pool deck shall not exceed 12 inches above existing grade; and 4. That any new residence, comply with Section 3-911, regarding underground utilities. I concur with the findings of the Development Review Committee and, through this letter, approve your application for Flexible Standard Development with the above conditions. The site plan also shows the planned location of the utilities. We no more apply for reduction of the rear setback from 10 to 5 feet. I have had the chance to review the drawings submitted and have the following concerns regarding the proposal. 1. The request noted is for a reduction of rear yard setback for the proposed inground pool. There is an existing utility easement that runs adjacent, if not through the 5'-0" proposed setback. Currently, there are both underground and overhead (specifically electric service) utilities in that space. I would assume that Progress Energy would be opposed to having a swimming pool abut an easement, or at the very least have all utilities buried in that easement. 2. The "landscape plan" appears to be vague as to the placement of the arrows pointing to trees to be removed. Words like "at the end of their lifes" (sic) seems arbitrary at best. I have a genuine concern as to what trees will be preserved, as the Harbor Oaks neighborhood takes great pride in its trees and landscapes. At the very minimum, I would like to have assurances that "preservation" will be done with this property as well. As a side bar, when I developed the property immediately behind this proposed development, I had to pay a large sum of money to "root-prune" Mr. Drazkowski's trees, in order to protect them from damage. I did so willingly, as I benefited from the shade they provided, as well as a beautiful backdrop to my home. Needless to say, within 6 months of my root pruning, Mr. Drazkowski secured a tree cutting permit for the very same trees, and had them removed. The rationale given was that the trees were "in decline". If that were the case, why did I have to pay to save them just a short time prior? I will be perfectly honest in that I am not at all comfortable with the amount of mature trees being removed with this development. 3. The site plan does not indicate the impervious calculations that are required in the LMDR district. Not having those specific percentages, I must point out that it "appears" to be more than allowed. Not having the benefit of even a basic floor plan, there is no way to be sure that the driveway even lines up with the garage. 4. I realize that this may not be the forum to address the following, however, I feel it bears noting for it impacts the character of the neighborhood. There are no building elevations shown with the application. There is no way to indicate whether or not the proposed structure follows the character of the surrounding homes. I don't believe there is a design review board requirement for this type of development, although I feel there should be. I am currently redeveloping the 1 ~;:-:~ r property at 323 Lotus Path. I too had a flexible standard request, and with my application, I had to show proposed building elevations, to assure that everything I proposed blended harmoniously with the neighborhood. My flexible standard was for a detached building and I had to provide assurances (and drawings) of the main house and the detached dwelling, noting building materials and specifics. I realize this request is only for the pool setback, but perhaps you should be concerned with the "overall" project. Lastly, I must point out that I am not opposed to Mr. Drazkowski's desire to develop his property. I wish him only the best. However, with that being said, I feel that this proposal, as presented, is not totally suitable. It needs to be more sympathetic to the site, and the neighborhood. More information, including specific drawings needs to be analyzed before anything can be decided. I thank you for your time in reviewing my objections.
