AN ORDINANCE OF THE CITY OF CLEARWATER, FLORIDA,
ANNEXING CERTAIN REAL PROPERTY LOCATED ON THE
SOUTH SIDE OF ALEMANDA DRIVE, APPROXIMATELY 670
FEET WEST OF SOUTH BELCHER ROAD, CONSISTING OF
LOT 93, SUNSET GARDENS, WHOSE POST OFFICE ADDRESS
IS 2141 ALEMANDA DRIVE, INTO THE CORPORATE LIMITS OF
THE CITY, AND REDEFINING THE BOUNDARY LINES OF THE
CITY TO INCLUDE SAID ADDITION; PROVIDING AN EFFECTIVE
DATE.
WHEREAS, the owner of the real property described herein and depicted on the map
attached hereto as Exhibit A has petitioned the City of Clearwater to annex the property into the
City pursuant to Section 171.044, Florida Statutes, and the City has complied with all applicable
requirements of Florida law in connection with this ordinance; now, therefore,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
CLEARWATER, FLORIDA:
Section 1. The following-described property is hereby annexed into the City of Clearwater
and the boundary lines of the City are redefined accordingly:
Lot 93, Sunset Gardens, according to the map or plat thereof, as recorded in Plat
Book 41, Page 6, Public Records of Pinellas County, Florida
(ANX2009-06009)
Section 2. The provisions of this ordinance are found and determined to be consistent
with the City of Clearwater Comprehensive Plan. The City Council hereby accepts the dedication
of all easements, parks, rights-of-way and other dedications to the public, which have heretofore
been made by plat, deed or user within the annexed property. The City Engineer, the City Clerk
and the Planning Director are directed to include and show the property described herein upon the
official maps and records of the City.
Section 3. This ordinance shall take effect immediately upon adoption. The City Clerk
shall file certified copies of this ordinance, including the map attached hereto, with the Clerk of the
Circuit Court and with the County Administrator of Pinellas County, Florida, within 7 days after
adoption, and shall file a certified copy with the Florida Department of State within 30 days after
adoption.

family dwelling. It is located on the south side of Alemanda Drive, approximately 670 feet west of South Belcher
Road. The applicant is requesting this annexation in order to receive solid waste service from the City. The property
is located within an enclave and is contiguous to existing City boundaries to the east. It is proposed that the property
be assigned a Future Land Use Plan designation of Residential Urban (RU) and a zoning category of Low Medium
Density Residential (LMDR).
The Planning Department determined that the proposed annexation is consistent with the provisions of Community
Development Code Section 4-604.E as follows:
The property currently receives water service from Pinellas County. The closest sanitary sewer~ine is located
in the adjacent Alemanda Drive right-of--way, and the applicant is aware of the additional costs to extend City
sewer service to this property. The applicant has chosen not to connect to sanitary sewer at this time and is
aware of the associated monthly fee. Collection of solid waste will be provided by the City of Clearwater.
The property is located within Police District III and service will be administered through the district
headquarters located at 2851 N. McMullen Booth Road. Fire and emergency medical services will be
provided to this property by Station #47 located at 1460 Lakeview Road. The City has adequate capacity to
serve this property with sanitary sewer, solid waste, police, fire and EMS service. The proposed annexation
will not have an adverse effect on public facilities and their levels of service; and
• The proposed annexation is consistent with and promotes the following objective of the Clearwater
Comprehensive Plan:
Objective A.6.4: Due to the built-out character of the City of Clearwater, compact urban development
within the urban service area shall be promoted through application of the Clearwater Community
Development Code.
Objective A.7.2 Diversify and expand the City's tax base through the annexation of a
variety of land uses located within the Clearwater Planning Area.

After speaking with you today regarding setting a meeting up with Planning, Engineering, and Customer Service I spoke
with Catherine. She recalled a chain of e-mails (see below) dealing with a similar issue. So, according to these e-mails I
need to determine (through Public Utilities) if sewer service is reasonably available (see a-mail from Scott Rice dated
November 17, 2008). Last time Scott coordinated with Utilities, is it possible again in this situation for you or Scott to
see if it is reasonably available? The address is 2141 Alemanda Drive (ANX2009-06009).
According to these e-mails, if it is reasonably available and Ms. Drysdale chooses not to connect, she would be charged a
monthly fee based on water consumption. 1 hope this clears the air on the issue? If not then perhaps a meeting should
be coordinated, but if we're all in agreement then one isn't necessary.

Code allows us to bill if sewer service is "available" regardless of whether the customer is hooked-up.
Prior experience with sewer "availability" is instructive. We have previously had an instance (Tropic
Hills - Burnice Dr.) where we were instructed to and did bill monthly sewer charges to a customer
whose residence was annexed into the City and who was on septic system. It was discovered after
several years that sewer service was "available" only if customer installed a lift station (something
about differences in elevation between customer's property and City system). Decision was made to
refund previously billed monthly sewer charges.
For what it's worth, would advise determining "availability" of sewer service before proceeding.

how you want us to proceed. We would like to annex this property as it makes us contiguous

Rob can probably add to this but, it is my understanding that the City does not force
anyone with an operating septic system to connect. I believe this is because we do not
have City-wide availability. I understand that if there is sewer available, the property
owner would be billed for sewage based upon water consumption. This being the case,
unless there is some compelling reason not to do so it would seem to me to be in the
best interest of the owner to connect.
Pinellas County Environmental Division handles permitting of septic systems. The City
cannot issue a permit for a project that includes a septic system without the County's
prior approval. I believe the County can force connection to sewer under certain
conditions.

As we discussed, Katie Cole and the applicant want to know whether he would be
forced to hook into the sewer system if he annexed. I have some written policies
from Engineering that says a person must hook up within 90 days of sewer becoming
available. When I discussed with Steve Doherty, he said they do NOT force people
to hook up. You were going to get further direction. Please advise.
