hereina{ller referred to as "C~ty"; and Melvin and Lois HcKnight
hercina.eer referred to as \"Ov.mcr";
WITNESSETH:
WHEREAS, the.: Ovner owns the following described real property situated in the
City of Clearwater, PiAi"eHas County, Florida, to wit: 180 Baywood
Lot 27 - Block D
Eastwood Terrace 2nd Addition

WHEREAS, Section 7 -6 of the Code of Ordinances of the City requires that all land
that abuts a public right-of-way, which is to have new construction on it, either for resi-
dential, comm.ercial, industrial or other purposes, shall have sidewalks constructed by
the owner on, across or adjacent thereto; and
WHEREAS,. 'dhe Owner is eI'ecting certain new construction on said property and has
reC?p.ested the City :J3f; this time not ibo require the imn1.ediate installation and co nstruction
of sidewalks in crmn.ection therewiotll:.1; and
WHEREiAS" the Owner has :agreed that if in the future the City, in its sole discretion,
determines that fit rs advisable o~ I'lecessary to have such sidewalks installed, that the
Owner will, upon notification by.tfu:e City, have sidewalks immediately installed at his ex-
pense, and if he should fail to den ~~.o then the City may have said installation made and impOSE
a lien against the described reali:;property for the cost hereof;
NOW, THEREFORE, it: cm:nsideration of the foregoing premises and other good and
valuable consideration between eWe parties, receipt of which is hereby acknowledged, the
parties hereto covenant and agr('9..e as follows:
1. The City will not at tilii.!. time require the installation and construction of
sid,ewalks as part of the erection' al the building and improvements by thc Owner on the
above described re,al property.
2. The Ci't:ymay at any tiime in the future notify the OvVner, his heirs, personal
representatives, sutcessors or :1s.s-5gns that the City in its sole discretion has determined
that it is advisabl'C and necessar~~ to) have sidewalks installed in connection with said
described real propt:"l"ty.

3. The Owner or his hei::;os" }personal representatives, successors or assigns shall
at hi:> expense within ninety (90) days from the notification by the City have sidewalks in-
stalled for said de scribed real property in accordance with City specifications and standarcs
as es~~ablished.
4. If the Owner or his heirs, personal representative$, successors or assigns shall

fail to have sid~walks installed for the described real property in accordance with City,.. ~ 00
speciDcations and standards v,rithin ninety (90) days from the r.otification by the City, .t' ~;:!-\
then fbe City may havc~ the sidewalks installed and assess and impose a lien against theg ~ : ~

of whether it is specifically mentioned in any deeds or conveyance subsequently execu11.~ :....~
