SATISFACTION OF TERMS OF AGREEMENT
City of Clearwater, through its undersigned attorney, does
hereby acknowledge the satisfaction of the terms of the Agreement
entered into by and. between the. CITY OF CLEARWATER, FLORIDA, ,and
MENNA-DIGIOVANNI, 'a Florida General Partnership, on September 23,
1981, recorded at O.R. 5276, page 2068, and amended on December 6,
1982, recorded at O.R. 544~, page 807, and does hereby give notice
that all moneys due the City were paid in full on the 17th day of
October, 1983.

Mr. Emil Pratesi recently contacted our office and asked for a document from the City
that would show satisfaction of the attached "Amendment to Agreement" between the
City of Clearwater and Menna - DiGiovanni. Mr. Pratesi said the agreement had been
recorded and that anytime a title search is performed, questions come up as towhether
provisions of the agreement have been satisfied.
Regarding this subject, I have attached a copy of the agenda item dated November 4,
1982 which addresses the "Amendment to Agreement" and the original "Agreement". I

have also attached copies of checks and collection vouchers showing that' all monies have
been paid. According to our records, everything was satisfied on October 17, 1983, when
we received a check in the amount of $27, 923.08.
If possible, as discussed on the phone, I would appreciate your preparing and providing
Mr. Pratesi an appropriate document evidencing satisfaction of the agreement that
could be recorded. Your assistance is appreciated and please let me know if I can
provide further information.

BACKGROUND:

On September 23t 1981, the City and Menna/DiGiovannit '8 Flo~ida General Partnershipt
entered into an agreement setting out requiremente for $30tqOO to be paid to the City
in lieu of the dedication of l~nd. I
Mr. Gus Menna has made an oral request ,to extend deadline for this payment to November I, 19B
a period of one year.
It is reconnncnded that Buch extension be granted with the condition that accrued interest
of $4,080 be paid immediately.
