THIS AMENDMENT TO AGREEMENT made and entered into by
and between the CITY OF CLEARWATER, FLORIDA, hereinafter referred
to as "City", and MENNA-DIGIOVANNI, a Florida General Partnership,
hereinafter referred to as "Owner";
WITNESSETH:
WHEREAS, The City and the Owner entered into an Agreement
dated September 23, 1981, agreeing to pay the balance of money due for
parkland dedication by November I, 1982; and
WHEREAS, the Owner has requested a one year extension in
which to pay the said balance of money due;
NOW, THEREFORE, IT IS MUTUALLY AGREED
BY AND BETWEEN THE PAR TIES, AS FOLLOWS:
1. That Paragraph 2 of that certain Agreement dated September
23, 1981, be and the same is hereby amended to read as follows:
"2. Owner s hall pay the balance of the Parkland dedication
on or before November I, 1983, with interest to
November I, 1982, in the amount of $4,080 to be
paid on the date of execution of this amendment. II
2. Except as amended hereby, all of the terms, covenants and
provisions contained in that certain Agreement dated September 23, 1981,
are hereby ratified and confirmed.
