1. Upon the execution of this Agreement Owner shall only
have to pay to the City part of the Parkland dedication, to-wit:
the sum of $6,000.00.
2. Owner shall pay the balance of the Parkland dedication
upon either the termination of the Moratorium or November 1, 1982,
whichever shall first occur.
3. Interest shall accrue on the unpaid balance at the rate
of seventeen percent (17%) per annum and shall be paid at the time
the balance of Parkland dedication is paid.
4. This Agreement shall be binding on the successors and
assigns of the Parties hereto and shall be deemed to be a covenant
which shall run with the land.

The Ci ty of Clearwater is canstructing transmissian lines fram the East Sei"age
Treatment Plant which, upon their campletian, will alleviate the seriaus prablems
presently being experienced at the East Plant. This'canstructian is estimated to.
be campleted within 18 manths. Until its campletian, the fallawing limited
administrative maratarium far new units within the East Plant area will be in effect:
1. The City Manager will not apprave any De~artment af Enviranmental Regulatian
permits far additians to. the East Treatment Plant.
2. Single family residences within 450 feet af an existing sei"er main are permitted.
3. Caffi~ercial prajects up to. faur (4) units and within 450 feet af an existing
sewer main are permitted.
4. Any praject aver 450 feet away fram an existing main is nat permitted.
5. New multi-family prajects af mare than faur (4) units are nat permitted. New
single-family subdivisians are nat pracessed withaut special approval fram
the City Manager.
6. New cammercial prajects aver faur (4) units are nat permitted. New cammercial
prajects faur (4) units and under are permitted.
7. No. mo.re than seven (7) units may be cannected per cantinuaus parcel aimership.
8, Develaper has the aptian to. install a State-appraved temporary treatment facility
subject to. the appraval af the City. . The City shall retain the right to. deter-
mine when the temporary treatment facility will be phased aut and the praject
cannected to. the City system.
9. The Planning Department will receive and review any site plans cansisting af the
equivalent af eight (8) ar mare units if the awners sign an agreement far sanitary
sewer service. (See attached.)
Shauld canstruction af the transmissian lines proceed an schedule, these requirements
may be revised to. alleviate same restrictians.
