WHEREAS, the City and Developer entered T 0 an
Annexation Agreement which was recorded in O.R. Book 5397, Pages
2022 through 2031, inclusive, of the Official Records of Pinellas
County, Florida; and
WHEREAS, said Annexation Agreement was amended and
restated in its entirety in the First Amended and Restated
Annexation Agreement attached as Exhibit liB" to City Ordinance
No. 3205-83; and
WHEREAS, said Annexation Agreement is thus superceded
and replaced and constitutes an unnecessary cloud upon the title
to the real property described therein.
NOW, THEREFORE, in consideration of the sum of Ten
Dollars ($10.00) and other good and valuable consideration, the
receipt and sufficiency of which are hereby acknowledged, the
parties hereto agree that the Annexation Agreement recorded in
O.R. Book 5397, Pages 2022 through 2031, inclusive, of the Public
Records of Pinellas County, Florida, be and it is hereby
terminated and cancelled as a matter of record. Nothing herein
contained shall be construed as In any m.anner affecting the
enforceability of the First Amended and Restated Annexation
Agreement attached as Exhibit IIBII to 'City Ordinance No. 3205-83,
as the same may from time to time have been or be hereafter
amended. '
