Dear Mayor Garvey:
This letter acknowledges the Department's receipt on May 14,.
1993, of the Development Agreement entered into between the City
of Clearwater and Murray Sorin and executed on April 30, 1993.
Pursu~nt to Section 163.3239, Florida Statutes (F.S.), a
development agreement or amendment shall not be effective until
it is properly recorded with the clerk of the circuit court in
the county where the local government is located and until 30
days after having been received by the state land planning agen-
cy. As the subject Development Agreement appears to have been
properly recorded with the Clerk of the Circuit Court in Pinellas
County, it shall not become effective before June 14, 1993.
The Department is reviewing the Development Agreement for
compliance with the "Florida Local Government Development Agree-
ment Act" (Act), Section 163.3220-163.3243, F.S. The Department
has completed an initial review and is providing the enclosed
draft comments for your information. The Department reserves the
right to revise the draft comments upon completion of our review.
Please note, the 30 day period of deferred effectiveness con-
tained in Section 163.3239, F.S., as indicated above, does not
limit when the Department may exercise its rights under the Act,
including the right to challenge the compliance of a development
agreement with the Act pursuant to Section 163.3243, F.S.

Pursuant to section 36.121, City of Clearwater Code of Ordinances,
we enclose for filing a recorded copy of a development agreement
between the City of Clearwater, Florida and Murray Sorin.
Also enclosed is a copy of Clearwater Ordinance No. 5354-93,
outlining the recording and filing requirements.
We understand the agreement will become effective 30 days after it
is received in your office. Please acknowledge receipt of this
document at your earliest convenience.
