IT IS HEREBY AGREED as of this /5<+-1' day of Ft:I)lUttly, 1988, by and
between METCO DEVELOPMENT CORPORATION, a Florida corporation, and the
CITY OF CLEARWATER, a Florida municipality, as follows:
1. The CITY OF CLEARWATER will provide water service to that certain
property owned by METCO DEVELOPMENT CORPORATION and known as the White
House Apartments, located on N. Mercury Avenue, in Tract A, Central Park
Resubdivision, for a term of two (2) years beginning on the date of this Agreement.
Metco Development Corporation shall pay the fees and charges for the water service
at the normal and usual rates charged by the City of Clearwater to its water
customers similarly situated, and shall otherwise comply with the applicable rules and
regulations of the City of Clearwater for water service generally.
2. This Agreement shall in no way prejudice either party's position in the case
that is presently pending before the Florida Supreme Court known as CITY OF
CLEARWATER, Petitioner vs. MET CO DEVELOPMENT CORPORATION and COUNTY
OF PINELLAS, Respondents (Case No. 71,961), wherein the CITY OF CLEARWATER
is seeking review of the decision of the Second District Court of Appeal in that court's
Case No. 86-2864. This Agreement shall not be admissible in such litigation, nor shall
this Agreement be recorded in the public records of Pinellas County, Florida. In the
event that the CITY OF CLEAR WATER is ultimately not successful in its petition to
the Supreme Court and the trial court's decision in that case becomes final, the water
service provided by the CITY OF CLEAR WATER to METCO DEVELOPMENT
CORPORATION shall continue indefinitely, subject to termination only for good and
sufficient cause in the same manner and for the same kind of good cause that would be
sufficient to terminate water service to any other water customer of the CITY OF
CLEARWATER.
